That the hearing be closed, and that the resolution amending Table 1 of the General Plan relative to the Development Code and adopting the Negative Declaration be approved (Exhibit 2). 2. That the hearing be closed, and that the resolution amending Table 1 of the General Plan relative to the Verdemont Area Plan and adopting the Negative Declaration be approved. (Exhibit 3). 3. W MINUTES Q EXHIBIT 1 Pam a~ioFi ~ \ . ` CITY OF SAN BERNARDINO PLANNING CASE 6PA No. 91-04 AND BUILDING SERVICES DEPART'rtAENT gGENDA ITEM OBSERVATIONS HEARING DATE - - PAGE The request is to modify the text of the General Plan includ- ing Table 1, Relationship to Other Plans, Table 6, Open Space Resource and General Plan Relationship, Table 7, Open Space Resource and Programs, Figure 61, Fire Hazard Areas, and various policies and implementation measures fn the General Plan relative to the Foothill Communities Protective "Green belt" Program, to permitted uses in CO, Commercial Office and to a development standard in CR-2, Commercial Regional, Downtown. f }ACRGROLJND When the General Plan was adopted on June 2, 1989, it inclu- ded Table 1, Relationship to Other Plans, other various tables, Section 1, Land Use, and Section 15, Wind and Fire. Also included in the General Plan are Implementation Measures I 1.1 and I 1.2 which require the revision of the zoning Ordinance {Sffi+IC Title 19) in order to be consistent with the General Plan. CEOA STATUS The Environmental Review Committee reviewed the proposed amendment at their regularly scheduled meeting of February 28, 1991. A Negative Declaration is recommended. The Initial Study will be made available for public review and comment from March 7, 1991 through March 27, 1991. No final action on the amendments may be taken until the public review period ands and response to any comments received has been prepared. ~N~T.VQTC To enable the City to adopt the Development Code consistent with the General Plan, Table 1, Relationship to Other Plans and Documents, (p. 2-i) need to be amended in the following manner (Attachment A): (a) Development Code, incorporated by reference, not yet adopted - delete the entire line. (b) Verdamont Area Plan - partially incorporated by reference - move to superseded column and delete the word (portion) under that column. (c) Central City South Overlay District - delete the word "overlay" and add under comments "as amended." vuwaor r~~oc+ w~ CITY OF SAN BERNARDINO PLANNING CASE GPA N0. 91-04 AND BUILDING SERVICES DEPARTMENT gGENDA ITEM 3 OBSERVATIONS HEARING DATE 3-6-91 PAGE 3 These changes are necessary for the following reasons: (a) The Development Code is an implementation program of the General Plan. Zt should not be incorporated by reference. (b) The Verdemont Area Plan Standards were incorporated in the General Plan so that the Standards could be imposed until the Development Code was adopted. Those standards now are incorporated into the Development Code so the reference in the General Plan no longer is necessary. (c) The Central City South Overlay District document has bean rewritten and is no longer and overlay District. Zt has become a land use district. "As amended" will incorporate the re-written document into the General Plan. other General Plan amendments required due to the pending adoption of the Development Code include: (a) List of Figures, (p. iv), delete Number 61, Fire Hazard Areas. (Attachment B) (b) Table 6, Opan Space Resource and General Plan Relationship, (p. 1-33). The table references Figure 61, Fire Hazard Areas. {Attachment C) (c) Table 7, Open space Resource and Programs, {p. 1- 38) also refers to Figure 61, Fire Hazard Areas. Since it is recommended that the figure be deleted, it is necessary to delete reference to it. Refer- ence on both Table 6 and 7 will be to "the map on file in the Planning Division." (Attachment D) (d) Policy 1.14.41, p. 1-67, requires adherence to the standards of the "Foothills Communities Protective Greenbelt Program." Some of the standards listed in the original document have been modified during the Development Code process and so adherence to the standards is inconsistent with the standards incorporated in the Development Code. It is necessary to rephrase the Policy. The proposed policy will read: 1.14.41 Incorporate the provisions of the "Foothill Communities Protective Greenbelt Program into the Development Code." Fire , the last paragraph references Figure 51. The reference will be changed to "the map on file in the Planning Division" since Figure 61 will be deleted. (At- tachment F) (f) Page 15-5 depicts figure 61. It duplicates the map from the Foothill Community Protective "Greenbelt" Program. The map and the 3 hazard categories have been modified somewhat over the years, primarily due to development, topography, and access. During the Development code process, the Fire Department personnel involved, agreed to tlse map on file in the Planning Division. It is therefore necessary to delete Figure 61. (Attachment G) (g) Policy 15.2.1, p. 15-8, also requires that develop- ment "ndhere to development standards specified" in the greenbelt program. Because those standards are somewhat modified in the Development Code, it is necessary to rephrase the policy as follows: 15.2.1 Require that development in the High Fire Hazard Area, as designated on the En- vironmantai Resources/Hazards Composite Overlay (figure 41) be subject to the provi- sions of the Foothill Communities Protective "Greenbelt" Program for protection of pro- perty. (Attachment H) (h) Implementation programs 215.2 and I15.3 (d), p. 15- 70, require revisions in the following manner: I15.2 Review the City's existing High Fire Hazard Ordinance and incorporate the pertinent provisions o! the Foothill Communities Protective "Greenbelt" Program. By changing the word "requirements" to "provisions", the standards in the Development Code will be consistent with the General Plan. Z 25.3 (d) the words "standards and require- ments" will change to "provisions" for the same reason stated above. (Attachment I) Q CITY OF SAN BERNARDINO PLANNING CASE GPA N0. 91-04 AND BUILDING SERVICES DEPARTMENT AGENDA ITEM 3 OBSERVATIONS HEARING DATE 3-6-91 PAGE 5 (i) Policy 1.16.16, pg. 1-72 reads: "Require that a percentage of the ground floor of all commercial and office structures incorporate "pedestrian-active" retail uses (restaurants, florists, gift shops, book- stores, clothing, shoe repair, etc) (I 1.1)." The policy has created difficulties for proposed development projects in the CR-2, Commercial Regional Downtown land use district. The intent was to avoid long, warehouse type walls that dis- courage pedestrian activity. It is proposed that the Policy be changed to read: "Require that new construction incorporate store front windows, arches, breezeways, or other architectural features which present a pedestrian-active environment." (Attachment J) (j) Add Policy 1.28.13 to pg. 1-93 and add Policy 1.29.12 to pag. 1-94 as follows: "Allow for the use of an office within an existing occupied residence if no major external structural alterations or additions are made. No advertising, is permitted except for an identification sign, of up to 2 square feet. The six topics and subsec- tions are as follows: GPA 91-04 (A) - Development Code (Table 1, Attachment A); GPA 91-04 (B) - The Verdemont Area Plan (Table 1, Attachment A); GPA 91-04 (C) - Central City South Overlay District (Table 1, Attachment A); GPA 91-04 (D) - Foothill Fire Zones (p. iv, 1-33, 1-38, 1-67, 15-3, 15-5, 15-8, 15-10, Attachments B through I); GPA 91-04 (E) - Ground floor retail uses Commercial Regional-Downtown - (CR-2) District (Attachment J); and, GPA 91-04 (F) - Combination residential/office use in the Commercial Office (CO-1 and CO-2) districts (Attachment K). These minor amendments are necessary to ensure that the Development Code adopted is consistent with the General Plan. RECOMMENDATION Based on the attached Findings of Fact (Attachment lA [GPA 91-04 (A) through (f)J), it is recommended that the Planning Commission recommend to the Mayor and Common Council: 1. Adopt the Negative Declaration; and 2. Approve General Plan Amendment No. 91-04. F3Lt The San Bernardino planning area is subject to wildland fires due to the steep terrain and highly flammable chaparral vegetation of the foothills of the San Bernardino Mountains and high winds that correspond with seasonal dry periods. Major fires have endangered the City of numerous occasions in the past and in several instances, have spread into the City and caused extensive damage. The US. Department of Forestry has records of wildland foes dating back to the begin- ning of the 20th century. The data indiates that fires occur on a regular basis almost every year and that very large fires occur fairly regularly every ten years. According to the Department of Forestry, the large fires correspond m the age of the vegetation which, if not burned regularly, begins m accumulate dead material that is more easily ignited and spreads fire faster than newer growth. Consequently, a decade will pass with few fires followed by a decade with several large foes. The occurrence of the largest fires also rnrresponds to periods of extremely high wind wnditions. The largest fires in recent history are indicated on Figure 60. Much of the burn areas overlap. Consequently for some fires only the extremities are depicted. The large fires that are spread by winds periodically approaching and exceeding 90.100 miles per hour are rnnsidered uno~ntrollable by the California Department of Forestry and US. Forest Service. Other areas in southern California ase being burned off period- itally by way of controlled burns to remove older vegetation. The wntrolled burn pro- cess is not used in the San Bernardino Mountains because of the unpredictability and force of the winds in the area which could make controlled burns a potential hazard. As a consequence, the San Bernardino Mountains will experience wildland fires on a regular basis and approxia?ately every ben years fi can be expected m experience a very large fire that will burn out of control for an extended period ~ time. In recognition of these hazards, the City of San Bernardino partidpated in the preparation of the Foothill Communities Protective "Greenbelt' Program in 1983 in wl- laboration with the County of San Bernardino, California Department of Forestry, Foothill Fire Protection District, West End Resource Conservation District, East Valley Resource Conservatian District, US. Soil Conservation Services, and U.S. Forest Service. The purpose of the program is to reduce fire, flood, and erosion losses in the wild- land/urban interface in the foothills of the San Bernardino Valley. The program was prompted, in part, by the Panorama Fire which occurred in 1~. FILE ~./ ~ The San Bernardino planning area is subject to wildland fires due to the steep terrain and highly flammable chaparral vegetation of the foothills of the San Bernardino Mountains and high winds that correspond with seasonal dry periods. Major fires have endangered the City of numerous occasions in the past and in several instances, have spread into the City and caused extensive damage. The U.S. Department of Forestry has records of wildland fires dating back to the begin- ning of the 20th century. The data indicates that fires occur on a regular basis alatost every year and that very large fires occur fairly regularly every ten years. According to the Department of Forestry, the large fires correspond to the age of the vegetation which, if not burned regularly, begins to accumulate dead material that is more easily ignited and spreads fur faster than newer growth. Consequently, a decade will pass with few foes followed by a decade with several large fires. The occurrence of the largest fires also corresponds to periods of extremely high wind conditions. The largest fires in recent history are indicated on Figure 60. Much of the burn areas overlap. Consequently for some fires only the extremities are depicted. The large fires that are spread by winds periodically approaching and exceeding 90.100 miles per hour are omddesed uncm~tr+ollable by the California Department of Forestry and U.S. Forest Service. Other areas in southern California are being bunted off period- . rally by way of controlled burns to remove older vegetation. The controlled burn pro- oess is not used in the San Bernardino Mountains beause of the unpredictability and force of the winds in the area which could make controlled burns a potential hazard. As a oonsequenoe, the San Bernardino Mountains wilt experience wildhu?d fires on a regular basis and approximately every ten years it an be acpected to experience a very large fire that wBl burn out of coattt+ol for an extended period of time. Tn recognition of these hazards, the City ~ San Bernardino participated in the preparation of the Footh~71 Communities Pmteetive "Greenbelt" Program in 1983 in col- laboratian with the County of San Bernardino, California Department of Forestry. Recitals 7 (a) The General Plan for the City of San Bernardino was 8 adopted by the Mayor and Common Council by Resolution No. 89- 9 159 on June 2, 1989. 10 (b) General Plan Amendment No. 91-04 (F) to the General 11 Plan of the City of San Bernardino was considered by the 12 Planning Commission on March 6, 1991, after a noticed public 13 hearing, and the Planning Commission's recommendation of 14 approval has been considered by the Mayor and Common Council. 15 (c) An Initial Study was prepared on February 28, 1991 16 and reviewed by the Environmental Review Committee and the 17 Planning Commission who both determined that General Plan 18 Amendment No. 91-04(F) would not have a significant effect on 19 the environment and therefore, recommended that a Negative ~ Declaration be adopted. 21 (d) The proposed Negative Declaration received a 21 day ~ public review period from March 7, 1991 through March 27, ~ 1991 and all comments relative thereto have been reviewed by ~ the Planning Commission and the Mayor and Common Council in ~ compliance with the California Environmental Quality Act and 26 local regulations. 27 //// 28 //// RESOLUTION..~PTING THE NEGATIV~ DECLARATION OF ENVIRONMENTAL IMPACT AND APPROVING GENERAL PLAN AMENDMENT NO. 91-04 (F) TO THE GENERAL PLAN OF THE CITY OF SAN BERNARDINO. 1 2 (e) The Mayor and Common Council held a noticed public 3 hearing and fully reviewed and considered proposed General 4 Plan Amendment No. 91-04(F) and the Planning Division Staff 5 Report on April 1, 1991. 6 (f) The adoption of General Plan Amendment No. 91-04(F) 7 is deemed in the interest of the orderly development of the 8 City and is consistent with the goals, objectives and 9 policies of the existing General Plan. 10 SECTION 2. Negative Declaration 11 NOW, THEREFORE BE IT RESOLVED, FOUND AND DETERMINED by the 12 Mayor and Common Council that the proposed amendment to the 13 General Plan of the City of San Bernardino will have no 14 significant effect on the environment, and the Negative 15 Declaration heretofore prepared by the Environmental Review 16 Committee as to the effect of this proposed amendment is 17 hereby ratified, affirmed and adopted. 18 SECTION 3. Findings 19 BE IT FURTHER RESOLVED by the Mayor and Common Council ~ of the City of San Bernardino that: 21 A. The proposed amendment would maintain the appropriate 11 balance of land uses within the City in that text 12 amendment proposed does not affect the balance of land 13 uses. 14 SECTION 4. Amendment 15 BE IT FURTHER RESOLVED by the Mayor and Common Council 16 that: 17 A. The text of the General Plan of the City of San 18 Bernardino is amended by adding Policy 1.28.13, p. 1-93 19 and Policy 1.29.12, p. 1-94 entitled Attachment A and B, 20 and is more specifically relative to combination 21 residential/office uses in the CO-1 and CO-2, Commercial ~ Office Districts.
