In November, 1988, the Community Development Commission approved and
adopted an qreement with the Public Employees' Retirement System
(PERS). Included in the agreement, but undisclosed in the staff report
was a clause providing for lifetime medical benefits to eligible
Commission employees. 1'b.is issue was discovered during the
restructuring of the Economic Development Agency.
After some research and fairly extensive discussion by the
Redevelopment Committee and the Community Development Commission, staff
. was directed to amend the existing qreement and to take any necessary
.actions in connection with eliminating any provisiona of the PERS
contract pertaining to lifetime medical benefits or any other
provisiona which may no longer be required in connection with the
functioning of the Economic Development Agency. Adoption of the
attached resolution would accomplish this objective.
I recommend adoption of the attached resolution.

WHEREAS, the City of San Bernardino has caused a restructuring
of its Community Development Department and Community Development Commission
(the "Commission") in order to promote the goals and objectives of community
and economic development and redevelopment activities within the City, and;
WHEREAS, in accordance with the aforementioned restructuring,
the Commission has caused the creation of the Economic Development Agency, andj
WHEREAS, the Commission has previously entered into a certain
contract designated as "Contract Between the Board of Administration Public
Employees' Retirement System and the Commissioners of the San Bernardino
14 Community Development Commission", pertaining to the applicability of the

WHEREAS, in connection with the restructuring of the Community
18 Development Department and the Co_ity Development Commission into the

Economic Development Agency, the Commission deems it desirable to direct staff
of the Economic Development Agency to take such action as may be necessary in
order to cause the provisions of the above referenced contract to be
applicable to the Economic Development Agency and to amend any provisions
thereof, or to take such appropriate action as may be necessary, in order to
24 terminate the applicability of lifetime medical benefits to the Economic

The Commission hereby authorizes the Secretary

The Commission hereby authorizes the Secretary
to the Community Development Commission to take any necessary actions in
connection with eliminating any provisions of the PERS contract pertaining to
lifetime medical benefits or any other provisions which may no longer be
required in connection with the functioning of the Economic Development Agency.

This Resolution shall take effect upon its
