In October 1981, the Mayor and Common Council adopted Ordinance Kumber
MC-10S, which provided for the eatabliahment of the Co_ity
Development Commission of the City of San Bernardino and authorized the
Commiasion to undertake certain functions with respect to the
Redevelopment !aency of the City of San Bernardino. The Ordinance also
provides that certain additional powers, as well as the authority to
administer and manage the operations of the Commission and the Agency,
could be establiahed, delegated, modified or repealed by resolution of
the Mayor and CODlllon Council.
The attached resolution delegates to the C~ity Development
.Commisaion certain expanded powers and authority in connection with the
~stsblishment of the Economic Development !aency and the reorganization
of the C~ity Development Depsrtment and the Redevelopment !aency.
The resolution alao implements previous Council/Commission policy
decisions relatina to the establishment of the Economic Development
Agency and delelatina to the !aency Administrator the authority to
oversee and control activities of the !aency'a diviaions (Development
Department, Main Street, Inc., Convention and Vlaitors Bureau and the
San Bernardino Economic Development Council). Baaed upon previous
discussions and Council/Commission actions, it is appropriate for the
Mayor and Common Council to consider this implementing action.
By taking the recommended action, the Mayor and Common Council will
also rescind Resolution Kumbered 91-99, which was previously adopted.
The attached resolution has been modified in full to address concerns
voiced by the City Attornex. The lasues raised in the City Attorney's
memorandum to the Mayor have been satisfactorily resolved by reason of
the restructuring of the Commission as it is now being proposed.
I recommend adoption of the attached resolution.

RESOLUTION OF THE MAYOR AND COMMON COUNCIL
OF THE CITY OF SAN BERNARDINO AMENDING
RESOLUTION NO. 81-594 AND DELEGATING TO THE
COMMUNITY DEVELOPMENT COMMISSION OF THE CITY
OF SAN BERNARDINO CERTAIN POWERS AND
AUTHORITY IN CONNECTION WITH THE MANAGEMENT
AND OPERATION OF THE ECONOMIC DEVELOPMENT
AGENCY AND RESCINDING RESOLUTION NO. 91-99
WHEREAS, the City of San Bernardino (the "City") has
18 providinq for the establishment of the CODIIIlunity Development

II Commission of the City of San Bernardino (the "Commission"), to
12 undertake certain functions with respect to the Redevelopment
13 Aqency of the City of San Bernardino (the "Aqency") and the
e:; 14 community development activities within the City; and

WHEREAS, Ordinance No. MC-105 provides that the Mayor
17 and Common Council shall act as the Commission and also provides
18 for the exercise of certain powers by the Executive Director of
19 the Commission all as further set forth in Municipal Code
20 Section 2.40.010 throuqh 2.40.060, inclusive; and

22 WHEREAS, Ordinance No. MC-105 also provides that
23 certain additional powers as well as the power and authority to
24 administer and manaqe the operations and activities of the
25 Commission and the Aqency may be established, deleqated, modified
26 or repealed by resolution of the Mayor and Common Council; and

1 WHEREAS, the City has previously adopted its
2 Resolution No. 81-594 dated December 8, 1981, providinq for the
3 deleqation of certain powers to the Commission includinq, but not
4 limited to, the power to manaqe the operations of the Commission
5 and the Aqency throuqh an Executive Director; and

26 WHEREAS, the Mayor and Common Council have previously
27 adopted Resolution No. 91-99 which deleqated certain authority to
28 the Commission with respect to the manaqement and operation of
WHEREAS, the City and the Commission have previously
initiated the restructurinq of certain City departments and City
related functions in order to better orqanize and operate the
functions of housinq, community development, economic development
and redevelopment within the City; and
WHEREAS, pursuant to restructurinq, the Economic
Development Aqency has been established under the authority of
the Commission to oversee and control the activities and
functions of various departments involved in housinq, community
development, economic development and redevelopment activities;
and
WHEREAS, the Economic Development Aqency shall exercise
authority and control over the Development Department, the San
Bernardino Convention and Visitors Bureau, the San Bernardino
Main Street proqram and the San Bernardino Economic Development
Council; and

o 1 the Economic Development Agency, which Resolution should now be
2 rescinded in connection with the Commission's staffing of the
3 Economic Development Agency; and

5 WHEREAS, the Economic Development Agency is
6 administered and controlled by an Agency Administrator (the
7 "Agency Administrator"); and
8
9 WHEREAS, the City deems it desirable to delegate to the
lQ Agency Administrator certain powers and authority; and

12 WHEREAS, the City deems it desirable at this time to
13 further implement Ordinance No. MC-105 and specificallY Municipal
o 14 Code Section 2.40.030 and amend Resolution No. 81-594 to provide
15 for the delegation of certain additional powers to the Commission
16 in connection with the establishment and operation of the
17 Economic Development Agency.

19 NOW, THEREFORE, THE MAYOR AND COMMON COUNCIL OF THE
20 CITY OF SAN BERNARDINO, CALIFORNIA, DO HEREBY FIND, RESOLVE,
DETERMINE AND ORDER AS FOLLOWS:

Section 1. Pursuant to San Bernardino Municipal
Code Chapter 2.40.030, the power and the authority of the
commission are hereby expanded to include the following:
a) The Commission shall have the power and authority
to administer, operate, manage and control the

18 Section 2. The Commission may further delegate and
19 establish any or all of the power and authority of the Commission
20 in the Agency Administrator of the Economic Development Agency.

23 operations and activities delegated by the foregoing Sections
24 shall be subject to the powers of the Mayor as set forth in the
25 San Bernardino Municipal Code Section 2.40.050.

27 Section 4. Resolution No. 91-99 of the Mayor and
28 common Council is hereby rescinded.

Commission shall operate and function as the
Economic Development Agency.

As part of the administration, operation, control
and management of the Economic Development
Agency, the commission shall also administer and
oversee the operations and activities of the
Development Department, the San Bernardino
Convention and Visitors Bureau, the San
Bernardino Main Street Program and the Economic
Development Council which shall be operating and
functional departments within the San Bernardino
Economic Development Agency.
