STAFF REPORT
Bids for the installation of sidewalk at various locations,
were opened on Tuesday, 3-26-91, at 2:00 p.m.
A total of 16 bids were received, ranging from $75,540.80
to $122,551.95. The low bid of $75,540.80 is 23.7% under the
Engineer's Estimate of $98,992.00.
Below is the total estimated project cost, based upon the actual
low bid price:

At their meeting of 11-7-90 SANBAG approved funding in the
amount of $122,670 from the 1990/91 TDA, Article 3, (SB 821)
Funds. An amount of $8,100 was approved in the 1989/90 Budget.
All costs, except preliminary engineering, will be reimbursed by
SANBAG.
Staff recommends that a contract be awarded to the low
bidder.

OF THE CITY OF SAN BERNARDINO AWARDING A
CONSTRUCTION FOR CONSTRUCTION OF SIDEWALKS AT
BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE
CITY OF SAN BERNARDINO AS FOLLOWS:
SECTION 1. Gosney Construction is the lowest responsible

bidder for: Construction of Sidewalks at various locations, in
accordance with Plan No. 8348. A contract is awarded to said
bidder accordingly for the total amount of $75,540.80, but such
award shall be effective only upon the contract being fully
executed by the parties.
All other bids therefore are hereby
rejected. The Mayor is hereby authorized and directed to execute
said contract on behalf of the City; a copy of the contract is on
file in the office of the City Clerk and incorporated herein by
reference as fully as though set forth at length.
SECTION 2. This contract and any amendment or modifica-
tions thereto shall not take effect or become operative until
fully signed and executed by the parties and no party shall be
obligated hereunder until the time of such full execution.
No
oral agreements, amendments, modifications or waivers
are
intended or authorized and shall not be implied from any act or
course of conduct of any party.
SECTION 3. This resolution is rescinded if the parties
to the contract fail to execute it within sixty (60) days of the
passage of this resolution.
