A program was concurrent- ly being developed to authorize payment by the City of 50% of the cost of repair of a sidewalk. Authorization for this program was included in MC-691 as Section 12.92.080, "Participa- tion by City." Resolution No. 90-8 establishes procedures for City property owner participation in the reconstruction and/or repair of sidewalks, curbs and gutters. On 5-21-90, the allocation of was approved, to provide funds participation in these projects. $100,000 from bond proceeds to finance the ci ty' s At the Council meeting of 7-16-90, Resolution No. 90-289 and Ordinance No. MC-737 were adopted to amend the procedures for these projects. Resolution No. 90-289 authorized the City to pay 50% of the cost for removal of abandoned drive-way approaches and infilling the curb depression, and reconstruction of curb, gutter and sidealks. Eligible projects for City parti- cipation were limited to those for which the City has initiated Chapter 12.92 proceedings. Ordinance No. MC-737 added Chapter 12.93 to the SBMC to provide for the City to contribute 50% of the costs for repair of existing sidewalk, curb, gutter or paved parkway improve- ments. A public hearing was held on 1-23-91. Some property owners appeared to protest the proceedings. The hearing was closed and the City's policy on Chapter 12.92 projects was re- ferred to the Legislative Review Committee. During the review of this policy, it was found that existing legislation authorizes the City's participation in the cost for removing abandoned driveways and repairing (reconstruction) of curbs gutters and sidewalks. The Committee felt that the City's participation should be extended to include 50% participation in the cost for installing new in-fill street improvements. The proposed resolution adds the construction of new curb, gutter and sidewalk to the list of projects eligible for City participation for 50% of the cost. A program is being developed by the Development Department to finance 50% of the cost for the three types of projects (removal of abandoned driveway approaches, repair of existing improvements and installation of new improvements), for 3-15-91 - - - A .I'i CITY' ~F SAN BERaRDINO - REQUEST Q,R COUNCIL ACTION STAFF REPORT Page 2 of 2 any property owner whose income is below the established level. Therefore, the City would pay full cost for any property owner that qualified under this program. At their meeting of 3-14-91, the Legislative Review Com- mittee recommended approval of this resolution.
