:ynopsis of Previous Council action: On the ~1arch 6, 1991 Agenda of the Pl anning Commi ssion, proposed
General Plan Amendment No. 91-04, to amend various Tables, policies and implementations
of the General Plan was reviewed by the Planning Commission and recommended for approval
to the Mayor and Common Council by a unanimous vote of 5 to O.
Flecommeno:led motion:
1. That the hearing be closed, and that the resolution amending Table 1 of the
General Plan relative to the Development Code and adopting the Negative D~claration
be approved (Exhibit 2).
2. That the hearing be closed, and that the resolution amending Table 1 of the
General Plan relative to the Verdemont Area Plan and adopting the Negative Declaration
be approved. (Exhibit 3). I
3. That the hearing be closed, and that the resolution amending Table 1 of the
General Plan relative to Central City South Overlay District and adopting the Negative
Declaration be approved (Exhibit 4).
4. That the hearing be closed, and that the resolution amending B pages of the General
Plan relative to Foothill Fire Protection and adopting the Negative Declaration be
approved (Exhibit 5).
5. That the hearing be closed, and that the resolution amending the General Plan relative
to ground floor retail uses in the CR-2 (Commercial Regional-Downtown) and adopting the
Negative Declaration be approved (Exhibit 6).

REOUEST
The request is to modify the text of the General Plan includ-
ing Table 1, Relationship to Other Plans, Table 6, open space
Resource and General Plan Relationship, Table 7, open space
Resource and programs, Figure 61, Fire Hazard Areas, and
various policies and implementation measures in the General
Plan relative to the Foothill communities Protective "Green
belt" Program, to permitted uses in co, commercial Office and
to a development standard in ca-2, commercial Regional,
Downtown.
BACKGROUND
When the General Plan was adopted on June 2, 1989, it inclu-
ded Table 1, Relationship to Other Plans, other various
tables, section 1, Land Use, and section 15, wind and Fire.
Also included in the General Plan are Implementation Measures
I 1.1 and I 1.2 which require the revision of the zoning
ordinance (SBMC Title 19) in order to be consistent with the
General Plan.
CEOA STATUS
The Environmental Review committee reviewed the proposed
amendment at their regularly scheduled meeting of February
28, 1991. A Negative Declaration is recommended. The
Initial study will be made available for public review and
comment from March 7, 1991 through March 27, 1991. No final
action on the amendments may be taken until the public review
period end. and re.ponse to any comment. received has been
prepared.
ANALYSIS
To enable the City to adopt the Development Code consistent
with the General Plan, Table 1, Relationship to Other Plans
and Documents, (p. 1-1) need to be amended in the following
manner (Attachment A):
(a) Development Code, incorporated by reference, not
yet adopted - delete the entire line.
(b) Verdemont Area Plan partially incorporated by
reference - move to superceded column and delete
the word (portion) under that column.
(c) central City South OVerlay District - delete the
word "overlay" and add under comments "as amended."

OBSERVATIONS
These changes are necessary for the following reasons:
(a)

(b) The verdemont Area Plan standards were incorporated
in the General Plan so that the Standards could be
imposed until the Development Code was adopted.
Those standards now are incorporated into the
Development Code so the reference in the General
Plan no longer is necessary.
(c) The central City South Overlay District document
has been rewritten and is no longer and Overlay
District. It has become a land use district. nAs
amendedn will incorporate the re-written document
into the General Plan.
Other General Plan amendments required due to the pending
adoption of the Development Code include:
(a) List of Figures, (p. iv), delete Number 61, Fire
Hazard Areas. (Attachment B)
(b) Table 6, Open Space Resource and General Plan
Relationship, (p. 1-33). The table references
Fiqure 61, Fire Hazard Areas. (Attachment C)
(c) Table 7, Open space Resource and Programs, (p. 1-
38) also refers to Figure 61, Fire Hazard Areas.
Since it is recommended that the fiqure be deleted,
it is necessary to delete reference to it. Refer-
ence on both Table 6 and 7 will be to "the map on
file in the planning Division. n (Attachment D)
(d) Policy 1.14.41, p. 1-67, requires adherence to the
standards of the "FoothillS communities Protective
Greenbelt Program." Some of the standards listed
in the original document have been modified during
the Development code process and so adherence to
the standards is inconsistent with the standards
incorporated in the Development Code. It is
necessary to rephrase the Policy. The proposed
policy will read:
1.14.41 Incorporate the provisions of the
"Foothill communities Protective Greenbelt
Program into the Development Code." (Attach-
ment E)

on page 15-3, under the heading B. ~ , the last
paragraph references Figure 61. The reference will
be changed to "the map on file in the Planning
Division" since Figure 61 will be deleted. (At-
tachment F)
page 15-5 depicts figure 61. It duplicates the. map
from the Foothill Community protective "Greenbelt"
Program. The map and the 3 hazard categories have
been modified somewhat over the years, primarily
due to development, topography, and access. During
the Development code process, the Fire Department
personnel involved, agreed to the map on file in
the Planning Division. It is therefore necessary
to delete Figure 61. (Attachment G)
Policy 15.2.1, p. 15-8, also requires that develop-
ment "adhere to development standards specified" in
the greenbelt program. Because those standards are
somewhat modified in the Development Code, it is
necessary to rephrase the policy as follows:
15.2.1 Require that development in the High
Fire Hazard Area, as designated on the En-
vironmental Resources/Hazards composite
OVerlay (figure 41) be subject to the provi-
sions of the Foothill Communities Protective
"Greenbelt" Program for protection of pro-
perty. (Attachment H)
(h) Implementation programs 115.2 and 115.3 (d), p. 15-
10, require revisions in the following manner:
(g)
115.2 Review the city's existing High Fire
Hazard ordinance and incorporate the pertinent
provisions of the Foothill communities
Protective "Greenbelt" Program. By changing
the word "requirements" to "provisions", the
standards in the Development Code will be
consistent with the General Plan.
I 15.3 (d) the words "standardS and require-
ments" will change to "provisions" for the

(i) Policy 1.16.16, pg. 1-72 reads:
"Require that a percentage of the ground floor
of all commercial and office structures
incorporate "pedestrian-active" retail uses
(restaurants, florists, gift shops, book-
stores, clothing, shoe repair, etc) (I 1.1)."
The policy has created difficulties for proposed
development projects in the CR-2, commercial
Regional Downtown land use district. The intent
was to avoid long, warehouse type walls that dis-
courage pedestrian activity. It is proposed that
the Policy be changed to read:
"Require that new construction incorporate
store front windows, arches, breezeways, or
other architectural features which present a
pedestrian-active environment." (Attachment
J)
(j) Add policy 1.28.13 to pg. 1-93 and add pOlicy
1.29.12 to pag. 1-94 as follows:
"Allow for the use of an office within an
existing occupied residence if no major
external structural alterations or additions
are made. No advertising, is permitted except
for an identification sign, of up to 2 square
feet.
Adding this policy will allow for combination uses
in the commerical Office designation as proposed in
the Development Code.

FINDINGS
At the advice of the city Attorney's Office, General Plan
Amendment No. 91-04, to amend various Tables, figures,
policies and implementations in the General Plan to enable
adoption of the Development Code to be consistent with the
General Plan, has been divided into subsections A through F,
based on the 6 topics discussed. The six topics and subsec-
tions are as follows:

The San Bernardino planning area is subject to wildland fl1"es due to the steep terrain
and highly flammable chaparral vegetation of the foothills of the San Bernardino
Mountains and high winds that correspond with seasonal dry periods. Major fires have
endan~ the City of numerous occasions in the past and in several instances, have
spread into the City and caused extensive damage.
The U.s. Department of Forestry has records of wildland fires dating back to the begin-
ning of the 20th century. The data indicates that fires occur on a regular basis almost
every year and that very large fires occur fairly regularly every ten years. According to
the Department of Forestry, the large fl1"e5 correspond to the age of the vegetation
which, if not burned regularly, begins to accumulate dead material that is more easily
ignited and spreads fire faster than newer growth.
Consequently, a decade will pass with few fires followed by a decade with several large
fl1"es. The occurrence of the largest fires also corresponds to periods of extremely high
wind conditions. The largest fires in recent history are indicated on Figure 60. Much of
the burn areas overlap. Consequently for some fires only the ~tremities are depicted.
The large fires that are spread by winds periodically approaching and exceeding 90-100
miles per hour are considered uncontrollable by the California Department of Forestry
and U.s. Forest Service. Other areas in southern Califoinia are being burned off period-
ically by way of controlled burns to remove older vegetation. The controlled burn pr0-
cess is not used in the San Bernardino Mountains because of the unpreciictabllity and
force of the winds in the area which cou1c1 make controlled burns a potential hazard.
As a consequence, the San Bernardino Mountains will experience wildland fires on a
regular basis and approximately every ten years it can be expected to experience a very
large fire that will burn out of control for an extended period of time.
In recognition of these hazards, the City of San Bernardino participated in the
preparation of the Foothill Communities Protective "Greenbelt" Program in 1983 in col-
laboration with the County of San Bernardino, California Department of Forestry,
Foothill FU"e Protection District. West End Resource Conservation District, East Valley
Resource Conservation Distric:t. U.s. SoU Conservation ServiceS, and U.s. Forest Service.
The purpose of the pl,,&"6D\ is to reduce fire, flood, and erosion losses in the wild-
land/urban interface in the foothills of the San Bernardino Valley. The }Il,,&"am was

The interface zone is divided into three categories of fire hazard as shown on Pil!l..... 61.
These relate to terrain, &CO""dbility, soil stability, and vegetation. The program pre-
scribes development standards to reduce fire risks; including roadway characteristics,
area accessibility, building construction (materials and configuration), location andsit-
ing of strUcture5, landscape and irrigation, vegetation management, and establishment
of a "greenbelt".

BE IT RESOLVED BY THE MAYOR AND THE COMMON COUNCIL OF
THE CITY OF SAN BERNARDINO AS FOLLOWS:
SECTION 1. Recitals
(a) The General Plan for the city of San Bernardino was
adopted by the Mayor and Common Council by Resolution No. 89-
159 on June 2, 1989.
(b) General Plan Amendment No. 91-04 (A) to the General
Plan of the city of San Bernardino was considered by the
Planning commission on March 6, 1991, after a noticed public
hearing, and the planning Commission's recommendation of
approval has been considered by the Mayor and Common Council.
(c) An Initial Study was prepared on February 28, 1991
and reviewed by the Environmental Review Committee and the
Planning commission who both determined that General Plan
Amendment No. 91-04(A) would not have a significant effect on
the environment and therefore, recommended that a Negative
Declaration be adopted.
(d) The proposed Negative Declaration received a 21 day
public review period from March 7, 1991 through March 27,
1991 and all comments relative thereto have been reviewed by
the Planning commission and the Mayor and Common Council in
compliance with the California Environmental Quality Act and
local regulations.

Mayor and Common Council that the proposed amendment to the
General Plan of the city of San Bernardino will have no
significant effect on the environment, and the Negative
Declaration heretofore prepared by the Environmental Review
Committee as to the effect of this proposed amendment is
hereby ratified, affirmed and adopted.
SECTION 3. Findinas
BE IT FURTHER RESOLVED by the Mayor and Common Council
of the city of San Bernardino that:
A. The proposed amendment is internally consistent with the
General Plan in that Table 1, Relationship to Other
Plans, includes the Development Code, however, the
Development Code is an implementation measure of the
General Plan, referenced elsewhere in the General Plan.

RESOLUTION OF THE CITY OF SAN BERNARDINO AMENDING
RESOLUTION NO. 83-201, AND REPEALING RESOLUTION NO. 89-471,
MODIFYING FEES FOR PLANNING SERVICES AND ESTABLISHING NEW FEES
FOR PLANNING SERVICES.
BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE
CITY OF SAN BERNARDINO AS FOLLOWS:
SECTION 1. The Mayor and Common Council find:
A. A hearing has been held by the Mayor and Common
Council pursuant to the provisions of Government Code Section
54990, et seq., to consider the levy of new additional fees and
services charges for various services provided by the Planning
Division, which hearing was held following public notice
published in a newspaper of general circulation in the City of
San Bernardino.
B. None of the proposed increases or new fees exceed
the actual cost of providing such services, and for the service
which is not completely paid for by the proposed fee, the
additional expense, if any, to the City of providing the
services shall be borne by the general fund of the City of San
Bernardino.
C. The proposed fees and charges are reasonable and
necessary to enable the City of San Bernardino to more nearly
meet actual costs of providing such services.
D. The adoption of this resolution is exempt from the
California Environmental Quality Act because it approves fees
for the purpose of meeting a portion of the operating expenses
of the city Planning Department, as set forth in Public
Resources Code 21080 (b) (8).

SECTION 4. "Direct Cost Recovery" shall include all
City labor and material costs, both direct and indirect,
including overhead, charged against the specific item being
processed.

(20%) of the total hours spent by clerical support and the
project planner at a rate of $30 per hour.

SECTION 5.
"Full Consultant Cost" shall include all
costs incurred under contract with a consultant. The applicant
shall pay deposits for the full consultant cost as outlined in

The applicant shall pay at the time of
filing an application in which there is a Full Consultant Cost
fee or Direct Cost Recovery fee the indicated initial deposit

additional deposit has been requested, work may be suspended on
the project when 95 percent (95%) of the deposit previously
received has been expended. Projects shall not be completed or
approved with money due. If additional deposit is not made by
the date specified in the notice, the project shall be deemed
withdrawn on the date specified without further action on the
part of the City of San Bernardino and without refund of any
money deposited for services already performed. Such project
may be reinstated only if the additional deposit is made within
30 days from the date project was deemed withdrawn.
SECTION 7. Refunds shall be made by the City for any
fee which was erroneously paid or collected: for any unused
deposit monies of Direct Cost Recovery Fee of Full Consultant
Cost Fee, after all charges for the project
have been
determined: or, as determined by the Director of Planning and
Building Services.
SECTION 8.
These fees (including the overhead hourly
rate charge) shall be automatically adjusted annually on
January 1 of each year, based on the latest available Consumer
Price Index increase from the prior year. The required initial
deposit may be adjusted as necessary by the Planning Division
to more accurately reflect the average mean cost of processing
a particular permit in a previous twelve month period.
