Recommended motion: That the hearing be closed; that the first reading of the ordinance amending San Bernardino Municipal Code Sections 19.56.370 and 19.56.380 be waived, and that said ordinance be laid over for final passage; and, that the Negative Declaration be adopted. Date February 19. 1991 Subject Amendment to San Bernardino Municipal Code 19.56.370/380 Approved I tem No. 5 Date REOUEST At the request of staff, an ordinance Municipal Code has consideration. the Deputy city ~ttorney, Henry Empeno, and to amend Sections 19.56.38 and 19.56.37 of the been drafted for the Planning commission's Among the provisions proposed by the ordinance are the following items : _ section 19.56.37 requires each parcel of land used for public or private vehicular parking, or for outdoor storage to be improved and maintained as required Sect. 19.5638 - 19.56.430. - section 19.56.38 regarding surfacing or paving will be amended to permit storage areas for industrial materials and heavy industrial equipment to be surfaced with slag or other material with the approval of the Director of the Planning and Building Services Department and the Director of the Public Works Department, or their designees, - Approval is contingent on provision that no toxic or hazardous materials, including but not limited to those listed in section 8.80.010 of the Municipal Code are not located in such storage areas. - Any required surfacing or paving shall be maintained in good condition. Please refer to Attachment "A" for the complete text. of the proposed ordinance. currently, outdoor storage surfaces are required to be surfaced with asphalt or concrete. The Department of Public Works requires about three inches of asphalt or concrete to be installed because of durablility and these materials will not create dust hazards, or crack and break under the pressure of heavy loads. Prior to the determination of paving standards, a soils investigation is submitted to the Engineering Division. Minimum standards for slag or other acceptable material will be set by the Department of Public Works. Additional requirements will be determined also by reviewing the type and weight of the proposed storage materials or equipment and the soils report at the project specific stage. The ERC determined that no significant impacts would result from the project and recommended a Negative Declaration. The proposed Negative Declaration was advertised. The Initial Study was available for Public Review and comment from January 17, 1991 to February 6, 1991. During the Public Review Period, no comments were received . Section 19.56.370 of the San Bernardino 7 Municipal Code is hereby amended to read as follows: 8 9 "19.56.370 Treatment of public or private parking and outdoor storage, sales, or display areas. Each parcel of land used for public or private vehicular parking, or for outdoor storage, sales, or display, except the storage area for vehicles in impounded yards, shall be improved and maintained as required in Sections 19.56.380 through 19.56.430 of this Chapter." SECTION 2. Section 19.56.380 of the San Bernardino 18 17 Municipal Code is hereby amended to read as follows: 19 20 21 22 23 24 25 26 27 28 "19.56.380 Surfacing or paving.
