CITY OF SAN BERNA~DINO - REQUEST Fbit COUNCIL ACTION o o o STAFF REPORT The proposed creation of Underground Utility District No. 20 was approved by the City's Underground Utility District Committee at their meeting of 10-04-90. Utility companies are required by Rule 20 of the Public Utilities Commission to set aside a certain portion of their revenues to finance the cost of undergrounding overhead facilities within districts established by local agencies. Each agency is allocated a certain amount of funds based upon the total number of overhead services within the agency's boundaries. The Underground Utility Committee of that agency reviews and designates areas proposed for the establishment of a district. Property owners within the district will be required to complete the undergrounding from their property lines to the service points at their own cost. No City funds will be required. Underground utilities improve the appearance of a street by removing visual clutter. Undergrounding eliminates the hazard from broken wires which result from violent windstorms or earthquakes, both of which are frequent occurrences in the area. On December 17, 1990, authorization to proceed was granted, and on February 1B, 1991, resolution No. 91-49 was adopted, setting a public hearing for March 1B, 1991. This project is a joint project with the County of San Bernardino, and the County's portion of the project will be funded by their Rule 20 allocations. RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO CREATING UNDERGROUND UTILITY DISTRICT NO. 20, ALONG 40TH STREET, BETWEEN KENDALL DRIVE AND PALM DRIVE. WHEREAS, a public hearing was held on March 18, 1991, at the hour of 10:00 a.m., at the Council Chambers, 300 North "D" Street, San Bernardino, California, to determine whether the public necessity, health, safety or welfare required the formation of an Underground Utility District 8 No. 20 located along 40th Street, between Kendall Drive and Palm Drive, San 9 Bernardino, California; and WHEREAS, notice of such hearing has been given to all affected 11 property owners as shown on the last equalized assessment roll and to all 12 13 14 15 16 17 18 19 20 21 22 23 utilities concerned in the manner and for the time required by law; and WHEREAS, such hearing has been duly and regularly held and all persons interested have been given an opportunity to be heard; NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF TIlE CITY OF SAN BERNARDINO, AS FOLLOWS: SECTION 1. It is hereby found and determined pursuant to Chapter 13.36 of the San Bernardino Municipal Code of the City of San Bernardino, and to definitions contained therein that the public necessity, health, safety and welfare require the formation of an underground utility district located along 40th Street, between Kendall Drive and Palm Drive, in the City of San Bernardino, State of California, public streets which are extensively used by the general public and carry a heavy volume of vehicular 24 traffic, in order to remove utility poles, overhead wires and associated 25 structures and to underground utilities along said portions of 40th Street. 26 27 SECTION 2. SECTION 3. All poles, overhead wires and associated overhead structures shall be removed and undergroUIld installations made for that area lying 100 feet North of and South of the Centerline of 40th Street within said underground utility district within the following times: a. Underground installation by utility companies and property owners and reconnections not later than October 31. 1992. b. Removal of poles, overhead wires and other associated structures not later than March 1. 1993. c. Said times may be extended by the Director of Public Works, as deemed necessary. for the proper scheduling and coordinating of appurtenant work. SECTION 4.
