THIS CONTRACT, lIade and entered into this

, 1991 by and between the COMMUNITY
4 DEVELOPMENT COMMISSION OF THE CITY OF SAN BERNARDINO,
5 ("Commission"), and an individual doing business as CHARLIB GANN
6 DBMOLITION CONTRACTING, P.O. Box 647, Mira Loma, California,
7 91752 ("Contractor").
8 WITNESSETH: That for and in consideration of the payments and
9 agreements hereinafter mentioned, to be made and performed by
10 Commission, to commence and complete the asbestos survey and
11 demolition, and installation of chain link fencing at the
12 property described as:
13 798 West Fourth Street; 772 West Fourth Street
421 North -8- Street; 447 North -8- Street
14 San Bernardino, c.a~~.fo~
15 Hereinafter called the "Project", for the sum of THIRTY
16 THREB THOUSAND SIX HUNDRBD AND 00/100, ($33,600.00) and all extra
17 work in connection therewith, under the terms as stated in the
18 General and Special Conditions attached hereto and incorporated
20 superintendence, labor, insurance and other accessories and
19 herein, and for all supplies, machinery, equipment, tools,

21 services necessary to complete the said project in accordance
22 with the conditions and prices stated in the proposal, the
23 general contract, Supplemental general conditions and special
24 conditions of the contract, and as enumerated in Article "2" of
25 the supplemental general conditions, all of which are made a part
26 thereof and COllectively evidence and constitute the contract.

1 The Contractor hereby agrees to commence work under this
2 contract on or before a date to be specified in a written WNotice
3 to Proceedw of the City and to fully complete the project in
4 phases wi thin ninety (90) calendar days thereafter. The
5 Contractor further agrees to pay, as liquidated damages, the sum
6 of $200,000 for each consecutive calendar day in finishing the
7 work in excess of the number of working days prescribed above.
8 The parties agree that should asbestos be discovered in the
9 proj ect the time to complete the demolition shall be suspended
10 for the period of time during which the asbestos is being
11 removed.
