Reed, Director Dept: Planning and Building Services DIu: January 25, 1991 Subject: Appeal of the Denial of Variance No. 90-13 Mayor and Common Council Meeting of February 5, 1991, 2:00 p.m. Synopsis of Previous Councilection: On December II, 1990, the Planning Commission denied Varinace No. 90-13 by a 6 to 0 vote. On January 23, 1991, Council upheld the appeal and approved Variance 90-13 in concept, and directed staff to prepare appropriate Findings of Fact for consideration at the February 5, 1991 Council meetin9. Recommended motion: That the Findings of Fact for Variance No. 90-13 (Exhibit "A") be adopted; that Variance No. 90-13 be approved; and, that the applicant be issued the appropriate sign permits in compliance with the approved variance applica- tion. There are exceptional circumstances to the property involved which do not apply qenerally to other property in the same zoninq district in that the subject site consists of two separate parcels which could theoretically constitute two seperate shoppinq centers. The variance would result in two free standinq siqns. one per parcel. The qrantinq of this variance is necessary for the preservation and enjoyment of a substantial property riqht of the applicant in that the code allows for one free standinq siqn per shoppinq center and the subject site consists of two separate parcels. 3. The qrantinq of this variance will not be materially detrimental to the public welfare or injurious to property and improvements in the land use district in which the property is located in that properties in the vicinity also have oversized nonconforminq siqns. The qrantinq of the variance will not be contrary to the objectives of the General Plan in that a larqe nonconforminq siqn will be replaced by two smaller siqns. ....
