This request was submitted in behalf of the condominium owners, in response to their desire to control access by installing a security fence. The desire to control access stems from a long series of vandalism and criminal activities, culminating in the murder of a tenant in December, 1989, by an intruder. Authorization to proceed was granted at the Council meeting of 7-2-90. However, the proceedings have been deferred pending receipt of more detailed information from the applicant on their proposal for installing the security fence and providing access to tenants, visitors and service vehicles. The north half of Edgehill Road was dedicated as a condition of the condominium development. The south half is owned by the City of San Bernardino. All street improvements were installed by the developer, at no cost to the City. Whenever a street is vacated, each half normally reverts to the adjoining properties. Therefore, the condominium home owners association will have to enter into a contractual arrangement with the City to gain access rights over the south half of the street. This arrangement could be in the form of a sale, long term lease, or having the City quit claim the south half to the home owners association. It will be necessary for these arrangements to be consummated before the vacation can be finalized. The application for vacation included a request that the street be brought up to an acceptable level of maintenance before it is vacated. An estimate was provided from a Contractor in the amount of about $3,500 for this work. The pavement has been inspected and found to be in a relatively good condition. There is no legal requirement that this work be done. In view of the good condition of the street, we are unable to recommend approval of this request. A copy of the map provided by the Edgehill Management Corporation is attached for reference. This map shows the proposed installation of the 6-foot wrought iron security fence. Automatic gates will be provided for Edgehill Road. Each tenant will be issued two transmitters (similar to an automatic garage door opener) to be used to activate the entrance gate. An ~n- ductive loop will be installed in the pavement to activate the exit gate as a vehicle approaches. It is envisioned that the gates will be locked in the open position for 4 hours per day in the peak traffic flows, in order to reduce wear on the operating mechanism. 1-14-91 75.0264 CITY OF SAN BERNOIDINO - REQUEST F~ COUNCIL ACTION STAFF REPORT Page 2 of 3 Vehicle access gates will be provided from the cul-de- sac at the terminus of Edgehill Road and at the emergency entrance from Little Mountain Drive, as requested by the Fire Department. The emergency access to Little Mountain Drive will be upgraded by replacing the two concrete ribbons with a 16' wide section of turf block and removing the existing cable gate. The Fire Department also requested that a driveway approach be provided from Little Mountain Drive, in order to allow easier access in the event that a fire engine ever needs to use this emergency access. This proposal was unacceptable to our office, due to potential traffic safety and drainage problems. A compromise has been worked out for the curb height to be reduced by about 4 inches, which will leave a curb of about 4 inches for a fire engine to traverse in order to use the emergency access. Four pedestrian gates will also be provided as shown. The one nearest the cul-de-sac will be located at the backflow prevention device, in order to provide easy access for maintenance personnel. Access to the condominium complex by the Fire Department will be provided by means of a "Knox Box," in accordance with their request. A key pad will be installed to activate the automatic entrance gates. Other City Departments needing access, such as Police, Water, Park & Recreation and Refuse, and other agencies, such as Post Office and serving utilities, will be provided with the access codes for the key pad. The corporation proposes to construct a pull-out lane for visitors. A telephone will be installed to enable the visitor to call a tenant. If the tenant wishes to see the visi tor, they will activate their transmitter. In the event that the tenant is not at home, the visitor can turn around and return to Little Mountain Drive. Construction of the pull-out lane will require about 720 square feet of right-of-way from Blair Park. It is recommended that the transfer of this right-of-way be included in the nego- tiations for the south half of Edgehill Road. A public utility easement will be reserved over the entire right-of-way for Edgehill Road, as requested by the serving utility companies. The water main serves the irrigation system for Blair Park, in addition to the condominium complex. Therefore, an easement will also be reserved for this water main, which will retain it as a public facility. An access easement for the condominium owners will be reserved if deemed necessary to satisfy the legal requirement for access to each unit. 1-14-91 75.0264 J.. The responses to these notices are attached for your information. Second notices were mailed on 1-11-91 to the various departments. These notices detailed the proposal by the applicant for fencing and access. No objections have been received, but the Department of Parks and Recreation has not agreed with the loss of 720 square feet of land from Blair Park. They have requested that a concrete mow strip be provided, and details of this item are being worked out. Vacation of this street will reduce the number of calls for Police services and relieve the City from any future main- tenance responsibilities or liability exposure. In addition, vacation is expected to increase property values for the condominiums. The second half of the $750 fee has been paid. RESOLUTION OF THE CITY OF SAN BERNARDINO DECLARING ITS INTENTION TO ORDER THE VACATION OF A PORTION OF EIlGEHILL ROAD, EAST OF LITTLE /1OUNTAIN DRIVE. AND RESERVING AN EASEMENT FOR WATER LINES AND APPURTENANT FACILITIES, AN ACCESS EASEMENT FOR EMERGENCY VEHICLES. AND EASEMENTS FOR PUBLIC UTILITIES THEREIN. BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: SECTION 1. That the Mayor and Common Council of the City of San Bernardino hereby declares its intention to order the vacation of a portion of Edgehill Road, East of Little Mountain Drive. described as follows: All that portion of Section 20, Township 1 North, Range 4 West. San Bernardino Meridian, unsurveyed, in the City of San Bernardino. County of San Bernardino.
