Therefore, the reimbursement for cos ts incurred for extending excess of 300 feet. this property does owner is seeking the sewer main in Total estimated cost for the approximately 900 feet of sewer line is $37,000. There is a good likelihood that other properties would connec t to the sewer in the intervening years and this area does need sewer installed for proper development. Each budget year, we recommend allocation of $50,000 in Account No. 245-365-57704, for such participation and payback to encourage dev- elopmen t in this type of area. This is the second reques t for use of such funds, and staff would recommend approval of funding for the portion of the line in excess of 300 feet from the property. Additional funds are available in the Sewer Line Construction Fund on projects that have not yet begun design or that have no immediate need for construction but are planned for the future. We recommend that the City's participation in the cost of extending the sewer main more than 300 feet, be approved. URGENCY CLAUSE Review of the attached letter indicates that this owner has been delayed several months, but remained unaware of all of the condi- tions on this project. We are unable to determine the cause of the misunders tanding, but feel an expeditious review on the requested payback agreement and resolution of this matter would be appropriate in showing the City's intent to assist development. 75-0264 01/31/91 o o 2160 Roosevelt Street San Bernardino, CA 92411 January 29, 1991 Mr. Roger Hargrave Director of PUblic Works! City Engineer CITY OF SAN BERNARDINO 300 North "D" Street San Bernardino, CA 92418 RE: APN 269-111-10 Roosevelt Street San Bernardino, CA Dear Mr. Hargrave: I own the above referenced vacant lot in the City of San Bernardino. In August, 1990, I purchased two houses to be relocated to this property after Carol Hamil (permit service) and I talked to Paul Scroggs in Planning to determine if I could split the lot, (which is 1.14 acres) to put one house on each lot. We asked Mr. Scroggs if I could split the lot and what was required by the City of San Bernardino to accomplish the lot split and put one house on each lot. He indicated that it looked feasible to him and we should proceed to file a parcel map for the lot split. He gave us the necessary forms to fill out for the parcel map lot split and the house relocations and told us to do everything required on the Plot Plan Check List. At the time, Carol mentioned that there were no sewers in that area and he told her he thought septic tanks were acceptable cut there. Carol contacted an engineer for me and we proceeded to get all the necessary information together, as required in the Plot Plan Check List, and she filed the parcel map for the lot split in December, 1990 after three trips to the Planning Department to try to file it. Each time when she attempted to file it, she was told they needed something different even though she had everything done per the Check List. As an example, she had to physically inspect each parcel within a 500' radius of my property and document where the existing buildings were on the property, if they had a garage, if they had a driveway, what klnd of driveway, etc. The attached three page Property Description is the result of this physical examination. This procedure is not listed on the Plot Plan Check List but was required by Patty Nahill in Planning. After filing the parcel map. Carol tried to file for the house, relocations before the first of January as the fees went up on the first. At that time, she was told that since she filed a o o Mr. Roger Hargrave CITY OF SAN BERNARDINO Page Two January 29, 1991 parcel map and I was going to put two houses on that lot I would have to bring the City sewer line up to my property, which is a distance of approximately one-quarter mile. She was also told that if I put only one house on the lot and did not split it that I would probably fall under one of the exemptions to the sewer requirement and I would not have to pay for bringing the sewer line up Roosevelt Street. S1nce I could not afford to pay for a City sewer line, she 1mmediately rescinded the parcel map and I decided to put just one house on the property. At no time, up to this point in any conversations with any City employees, was she or I advised that I would be required to pay for bringing a City sewer line one-quarter mile up the street. After rescinding the parcel map she then filed for only one relocation permit instead of two thinking that would alleviate the financial burden of paying for putting in a sewer line as advised by the City. By this time, however, it was after the first of January and the fees for the relocation had gone up. Subsequently, Carol talked to you and you told her that my property would not fall under any exemptions, that you would not allow any septic tanks to be installed, and I would be required to pay for the City sewer line which you ind1cated would cost approximately $20-$25 per foot. You did indicate. however, that I could write a letter and request the City pay for the cost of the sewer line up to within 300' of my property and that I would pay for the last 300'. You also indicated to her, however, that you did not think the City would do that but that I could try. Every time I go to the City, they tell me there are additional requirements that will cost more money, but I never get all the requirements at one time. Had I been told in August that sewers were required, when I asked what the requirements were, I never would have started this project. I am getting a loan to pay for this home and I simply cannot afford the exorbitant City fees and requirements. I am respectfully requesting that the City exempt my property from the sewer requirement at this time and at least let me put one house on the property so my family and I can have a home of our own.
