STAFF REPORT
The Board of Water Commissioners entered into a Purchase Agreement
with Van Loon Mutual Water Company whereby the Water Department
would take over their water system on January 1, 1991. The
acquisition of Van Loon Mutual was originally scheduled for April,
1990, but was postponed pending annexation of a major portion of
their service area to the City. The annexation was approved on
December 10, 1990.
A copy of a map depicting their service area is attached. Included
within the assets of the company are two (2) parcels of land which
were well sites, and easements for their distribution system.
A grant deed has been executed by Van Loon Mutual Water Company
transferring the real property to the City of San Bernardino. It
is recommended that the grant deed be accepted and the property
dedicated for Water Department use.

RIGHTS-OF-WAY AND EASEMENTS FOR THEIR DISTRIBUTION SYSTEM, AND
6 DEDICATING THEM FOR WATER DEPARTMENT USE.

RESOLUTION NO.
WHEREAS, the Board of Water Commissioners entered into a
8 Purchase Agreement with Van Loon Mutual Water Company on December
9 20, 1990, whereby all of the assets are transferred to the City of
10 San Bernardino as of January 1, 1991; and
11 WHEREAS, included within the assets transferred to the City
12 are two parcels of land, rights-of-way and easements for their
13 water distribution system.

NOW THEREFORE BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL
15 OF THE CITY OF SAN BERNARDINO AS FOLLOWS:
16 SECTION ONE: That the Corporation Grant Deed from Van Loon
17 Mutual Water Company, a California Corporation, which is attached
18 hereto marked Exhibit "1", and incorporated herein by reference as
19 though fully set forth at length herein, be accepted.
20 SECTION TWO: That the property accepted herein be dedicated
21 for Water Department use.
22 BE IT FURTHER RESOLVED that a copy of this Resolution be
23 attached to said Grant Deed, and that the same be recorded in the
24 Office of the County Recorder of San Bernardino County.
25 I HEREBY CERTIFY that the foregoing resolution was duly
26 adopted by the Mayor and Common Council of the City of San
27 Bernardino at a meeting thereof, held

Lot Two (2) in Block 3 of Tract No. 2307, Van Loon
Subdivision, as per plat recorded in Book 33 of Maps, page 49,
records of said County;
TOGETHER with the well si tuated on said Lot 2, and the
underground domestic water distributing system connected therewith,
which distributing system extends throughout said Van Loon
Subdivision and is in, across and over the streets and the rear
five feet of various lots in said Subdivision; with the right to
use, maintain, operate, repair, reconstruct, replace and enlarge
said distributing system or any part thereof for supplying water
for use on the lots of said Subdivision and on adjoining lands;
ALSO, a right of way in, over and across all highways in and
abutting upon said Subdivision for constructing, maintaining,.
operating, repairing, reconstructing, replacing and enlarging
underground water pipes, gates, valves, meters, above ground
fireplugs, and other accessories for supplying water for use on
said Subdivision and adjoining lands.
PARCEL I
That certain parcel hereinafter called "well site", and upon which
is now situated a certain well, approximately 300 feet deep,
described as follows:
A portion of Tract 2624, being a portion of Lot 14, Block 41,
Rancho San Bernardino, as same is recorded in Book 7 of Maps at
page 2 thereof, Records of San Bernardino County, more particularly
described as:
Beginning at a point on the North line of said Lot 14, said point
being S. 89 51' W. 254.67 feet from the N.E. corner of said Lot 14;
thence S. 0 OS' 30" W. 65.0 feet; thence S. 89 51' W. 84.0 feet;
thence N. 0 OS' 30" E. 65.0 feet to a point on the North line of
said Lot 14; thence N. 89 51' E. along the North line of said Lot
14, 84 feet to a place of beginning.
PARCEL II
That certain water distributing system, including pipe, with lot
laterals, leading and extending from said well site described in
Parcel I above, South along and in that certain street designated
"Canyon Road", as shown on map of Tract 2624, records of the office
of the County Recorder of said County, to a point in an East and
West alley, the South line of which is 150 feet North of the North
line of Base Line, as shown on said map; thence East and West,
along and in said alley, together with the right to maintain,
replace, enlarge, repair, inspect and use the same for carrying
water therethrough to the occupants of said tract, above referred
to, and adjoining lands.

PARCEL III
A right of way in, over and along all public highways in said Tract
2624 or abutting thereon, for laying, repa1r1ng, replacing,
enlarging, inspecting, maintaining and using, pipe lines, hydrants,
valves and related appliances for distributing water to the
occupants of said Tract, and to adjoining lands.
A right of way over and across all that certain real property
situated in the County of San Bernardino, State of California,
described as follows:
The North five (S) feet of Lot 26, of CANYON ROAD SUBDIVISION,
TRACT NO. 2624, as same is recorded in Book 37 of Maps, at page 30
thereof, records of said County.
Said right of way being for the purpose of laying,
constructing, maintaining and enlarging water pipe or pipes,
including the right at all times to enter upon said property for
the purpose of inspecting, repairing, replacing, enlarging, and
controlling any such pipe, all of which rights shall be continuing
rights and shall not be exhausted by any exercise thereof;
provided, however, that any pipe installed upon said right of way
shall be buried so that the top thereof shall be at least eighteen
inches below the surface of the ground.
