STAFF REPORT
The Highland-Delmann Heights Quality Water Supply Authority
(Authority), was created for the purpose of the City of San
Bernardino and East Valley Water District to acquire Southern
California Water Company's Highland and Delmann Heights water
systems.
The systems were acquired by a Final Order of Condemnation entered
by the Superior Court on November 20, 1989 and recorded in the
County of San Bernardino by Instrument No. 89-438597.
The Authority was to then deliver title to all of the assets of the
Delmann Heights System to the City of San Bernardino and title to
all of the assets of the Highland System to East Valley Water
District.
The Delmann System includes four parcelS of land, wells, hydro
pneumatic tanks, boosters, pipelines, easements and associated
facilities.
It is recommended that the Corporation Quitclaim Deed be accepted
and the property and related assets be dedicated for Water
Department use.

A RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF

HIGHLAND-DELMANN HEIGHTS QUALITY WATER SUPPLY AUTHORITY FOR THE
5 DELMANN HEIGHTS WATER SYSTEM AND DEDICATING IT FOR WATER DEPARTMENT
USE.

WHEREAS, the Highland-Delmann Heights Quality Water Supply
Authority (hereinafter "Authority"), is a California Joint Exercise
of Powers Authority comprised of the City of San Bernardino and the

East Valley Water District; and
WHEREAS, the Authority has acquired by eminent domain
proceeding in the Superior Court of the County of San Bernardino
(Highland-Delmann Heights Quality Water Supply Authority v.
Southern California Water Company, et al., No. 235250) all interest
in and to the real property, together with any and all improvements
thereon of the defendants in that action; and
WHEREAS, a Final Order of Condemnation was entered by the
Superior Court in the above entitled action on November 20, 1989,
and recorded in the County of San Bernardino on that day by
Instrument No. 89-438597; and
WHEREAS, the Authority has delivered clear title to the City
of San Bernardino.
NOW THEREFORE BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL
23 OF THE CITY OF SAN BERNARDINO AS FOLLOWS:
24 SECTION ONE: The City of San Bernardino hereby accepts the
25 Corporation Quitclaim Deed from the Highland-Delmann Heights
26 Quality Water Supply Authority, a California corporation, for the
27 Delmann Heights water supply facilities, along with all real
28 property and improvements thereon as set forth in Exhibit "1"
