Backus, by letter dated 12-31-90, for a waiver of the requirement to connect to the City I S sewer system. This request is for a single family home to be constructed on a 12,600 square foot parcel at 25008 Hardt Street, Assessor's Parcel No. 281-117-12. The nearest sewer is located more than 500 I from the site. This project qualifies as "in fill" because -it is ,("'Ir.: /: proposed to be built on an existing lot where at least 75% of the lots on the block have structures, none of which are connected to the sewer system. We recommend this waiver be approved based on ordinance No. MC-663, Subsection 182, which provides for such waiver for residential projects which qualify as "in fill." Granting a waiver to connect to the City sewer system will not be considered as permission to install a septic tank. The applicant will be required to obtain a permit through the normal environmental review and approval process. " 0 o o o San Bernardino, California December 31, 1990 commom Council of the City of San Bernardino 300 North D Street San Bernardino, California Gentlemen: I am requesting you to waive the requirement that I connect the house that I propose to build to the city sewer system. The basis of this request is that this is an "in-fill project where structures exist on at least 75% of the block and none are connected to the sewer system." The facts in this matter are as follows: The property is commonly known as 25008 Hardt Street. It can also be identified as assessor's parcel 281-111-12. The property is located about 250' east of Tippecanoe and about 500' from the closest sewer which is west of TePFicanoe. All of the other parcels on this street are developed and .- they also are not connected to the sewer. The size of the lot is 12,600 square feet. I propose to build a single family dwelling on it. I understand that this waiver is temporary and that I will be required to connect to the sewer when it is constructed within 300 feet of the ~roperty. I also agree to waive any right to protest the future formation of a sewer assessment district which includes this property and I further agree to formally encumber the property with this agreement.
