Clark, City Clerk October 26, 1998 Resolution of the Mayor and Common Council of the City of San Bernardino Requesting That The Board of Supervisors Of The County Of San Bernardino Permit The County Registrar of Voters To Render Services To The City of San Bernardino Relating To A Special Municipal Election To Be Held on February 2, 1999. Background Information: In a letter dated October 16, 1998 to the Honorable Judith Valles, Rita C. Arias submitted her resignation as a member of the City Council representing the Third Ward of the City of San Bernardino. Her resignation was effective October 19,1998. Section 14-A of the City Charter provides that a vacancy in the Common Council, from whatever cause arising, shall be filled for the unexpired term thereof through the election of a successor Councilman by the qualified electors of the ward in which the vacancy has occurred. Mrs. Arias' term would have expired on March 6, 2000. The agenda item preceding this one presented a Resolution calling for a Special Election on February 2,1999 in the Third Ward to fill the vacancy created by Mrs. Arias' resignation. Elections Code Section 10002 provides that the governing body of any city may by resolution request the county board of supervisors to permit the county elections official to render specified services to the city relating to the conduct of an election. In planning to conduct the special Third Ward election, careful consideration was given to the pros and cons of having the City Clerk's Office conduct the election versus contracting with the County Registrar of Voters to have their office conduct it. It is my recommendation that we contract with the County and have the Registrar of Voters Office provide the required services to conduct the Special Municipal Election in the Third Ward. The County Registrar of Voters Office already has contracts in place for various election services/supplies vendors and can take advantage of those contracts to help keep costs down. If the City Clerk's Office were to conduct the election, it would require an additional expense over and above routine election costs, since a temporary election room would have to be built to make room for the computer equipment designed to be used for elections. By permitting the County Registrar of Voters to conduct this special election, the City Clerk's Office will not only avoid the additional expense required for setting up a temporary election room, but it will allow staff to give its full attention to other critical tasks, such as being able to devote full resources to business registration renewals at a time when they are at their highest, and 2 . inaugurate the passport acceptance center, which we anticipate will bring in much needed revenues. Additionally, basic services provided by the City Clerk's Office will not be disrupted as they usually are during an election cycle. For the above reasons, coupled with the fact that we have reduced staffing levels and more responsibilities, staff and I recommend that you adopt this resolution. The citywide runoff election held in February of this year (Mayoral race) was conducted by the Registrar of Voters Office and we worked closely with the Registrar's Office, as we would with any other election services vendor, to ensure accuracy of sample ballot content, location of polling places, etc. We maintain an excellent working relationship with the County Registrar of Voters and her staff and have already met to begin planning for this special election. I have requested that an adequate number of polling places be established and that the Saturday prior to the February 2nd election be designated as an "early voting" day to encourage greater voter turnout. A centrally-located polling place will be selected in the Third Ward where Third Ward voters can go to vote between 9 a.m. and 3 p.m. on Saturday, January 30,1999. Nomination papers will be issued by the City Clerk's Office and candidates will file their nomination papers, campaign statements, and statements of economic interests with the City Clerk's Office. The nomination period will open on Thursday, November 5, 1998 and close at noon on Monday, November 30,1998. Recommended Motion: That said resolution be adopted. ~h.~ Rachel G. Clark, C.M.C. BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: SECTION 1. Reauest for County Services. As authorized 8 by Section 10002 of the Elections Code of the State of 9 California, the Mayor and Common Council request that the Board 10 of Supervisors of the County of San Bernardino permit the 11 County Registrar of Voters to furnish services and supplies to 12 this city for the Special Municipal Election to be held on 13 February 2, 1999. o 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 o SECTION 2. Conduct of Election. The special municipal election shall be held in such precincts and at such polling places as shall be determined by the City Clerk of the City of San Bernardino and the Registrar of Voters of the County of San Bernardino. The polls for said election shall be open from 7:00 a.m. of the day of said election and shall remain open continuously from said time until 8:00 p.m. of the same day when said polls shall be closed, except as provided in Section 14401 of the California Elections Code.
