Synopsis of Previous Council Action:
On December 18, 2006, the Mayor and Common Council adopted Resolution No. 2006-
436, a Resolution of the Mayor and Common Council to appoint speCific directors to the
Big Independent Cities Excess Pool (BICEP) Joint Powers Authority.

Subject:
A Resolution of the Mayor and Common Council to appoint specific directors to the Big
Independent Cities Excess Pool (BICEP) Joint Powers Authority.
Background:
The City of San Bernardino purchases excess liability and excess workers' compensation
insurance through BICEP. The Joint Powers Agreement creating BICEP requires that the City
designate a primary and alternate to serve on the Board of Directors. Previously, Mark Andres,
Risk Manager, served as primary representative, and Linnea Livingston, Director of Human
Resources, served as alternate. With the retirement of Mark Andres and promotion of Kenneth
Hernandez to Risk Manager, changes are necessary to the appointments. The following
individuals are qualified to represent the City on the Board of Directors and various committees:

Changes to the appointments of primary and alternate are being made to allow Kenneth
Hernandez the opportunity to assume a leadership position with BICEP.
The attached resolution appoints designated individuals as follows:

WHEREAS, The City of San Bernardino is a member of the Big Independent Citie
Excess Pool; and

WHEREAS, !he City of San Bernardino is a member of the Liability, Property, an
Workers' Compensation programs; and

WHEREAS, the Joint Powers Agreement creating a Big Independent Cities Excess Poo

require that a Director be appointed by resolution to the Board of Directors of the Authority an
10
an Alternate Director be appointed by resolution to act in the primary member's absence (
11
Director or Alternate Director may be a member of the city councilor an official or staff person).

WHEREAS, the Liability, Property and Workers' Compensation Agreements date
14
October 7, 1993, require that the City should appoint one "Primary Representative" and on
15
"Alternate Representative" (it is expected, but not mandatory, that the Primary and Alternat
Representatives will be individuals designated as Director and Alternate Director on the Bi

Independent Cities Excess Pool Board of Directors) for each Program Committee that the city i
a member of.

t9 NOW, THEREFORE, IT IS RESOLVED BY THE MAYOR AND COMMO
COUNCIL OF THE CITY OF SAN BERNARDINO:

SECTION I. That the City of San Bernardino appoints Kenneth Hernandez to serve 0
22
the Board of Directors of the Big Independent Cities Excess Pool.

SECTION 2. That the City of San Bernardino appoints Linnea Livingston to serve 0
24
the Board of Directors of the Big Independent Cities Excess Pool in the absence of the prima
25
member noted in Section I above.

SECTION 3. That the City of San Bernardino appoints Kermeth Hernandez to serve 0

the Liability Committee.
SECTION 4. That the City of San Bernardino appoints Lirmea Livingston to serve 0

the Liability Committee in the absence of the primary member in Section 3 above.
SECTION 5. That the City of San Bernardino appoints Kermeth Hernandez to serve 0

the Property Committee.

SECTION 6. That the City of San Bernardino appoints Lirmea Livingston to serve 0

the Property Committee in the absence of the primary member noted in Section 5 above.

SECTION 7. That the City of San Bernardino appoints Kermeth Hernandez to serve 0

the Workers' Compensation Committee.

SECTION 8. That the City of San Bernardino appoints Lirmea Livingston to serve 0
14
the Workers' Compensation Committee in the absence of the primary member noted in Section
15
above.

SECTION 9. That the individuals previously designated by this Council as the City'
Director and Alternate to the Big Independent Cities Excess Pool and representatives of th
17

Liability, Property and Workers' Compensation Committees of the Big Independent Citie
19
Excess Pool are hereby confirmed and designated as the City's delegate to the Big Independen
20
Cities Excess Pool Board of Directors for all purposes of representing the City's interests an
21
exercising the authority of the City with respect to the coverage and programs and voting 0
22
behalf of the City on all matters delegated to the Board of Directors and signing suc
23
amendments as are contemplated to be approved by the Board of Directors under the Liabilit
24
Risk Coverage Agreement and the Trust Indenture, and such individuals shall keep this Counci
25
informed of such matters on a timely basis.
