SHD:JW:sm:5074G 3 . o o o o o Redevelopment Agency STAFF REPORT It is recommended that the Mayor and Common Council and the Community Development Commission set a joint public hearing for 11:00 a.m. on July 3, 1989 to approve an Amended and Restated Owner's Participation Agreement for the Auto Plaza. BACKGROUND On December 23, 1985, the Commission approved an Owner Participation Agreement (OPA) with Orange Show Plaza Associates to develop a regional auto plaza containing 11 new car dealerships, an auto service center and ancillary retail and commercial bUildings on Auto Plaza Drive west of 1-215. Master site improvements and six of the new car dealerships have been completed. A seventh dealership (Acura) is under construction. Number eight (Volvo) has closed escrow and Nissan has recently closed escrow on a "two dealership" site. One dealership remains available. The Developer is behind schedule on the commercial parcels, but has identified a substitute developer, B & M. Victor Boyd and Greg McClelland (B & M) have entered escrow, received Planning Commission approval for their development plans, submitted construction plans to Building and Safety for review and will soon be ready to start construction on the general commercial areas of the Auto Plaza (Parcels 12 and 13 of Parcel Map Number 9713). A proposed Amended and Restated OPA will substitute B & M for Orange Show Plaza Associates (the Developer) with respect to the development of these areas and provide for a longer build out than originally planned. On June 6, 1989, the Developer, B & M and Agency staff completed discussions on the basic deal points that are to be reflected in the Amended and Restated OPA. On June 9, 1989, we received the executed agreements from the Developer and B & M. They have also been approved as to form and. legal content by the Agency's special counsel. The Redevelopment Committee reviewed this request on June 8, 1989 and recommended approval. It is, therefore, requested that the Commission and Common Council set a joint public hearing on the matter for 11:00 a.m. on July 3, 1989. SHD:JW:sm:5074G 4
