The contents of the tank have leaked into the surrounding soil. After examining laboratory test results, the County Environ- mental Health Department has classified the contaminated soil as hazardous material. Approximately 200 tons of contaminated material have been excavated and stockpiled. This material must now be hauled from the job site, to an approved Class I landfill, in order to allow the project to continue on schedule. The Contractor has submitted a price quote of $136.27 per ton. Therefore, the estimated cost to transport the contaminated soil to a Class I landfill is $27,254.00. The closest Class I landfill is located near Bakersfield. Change Order No. One will authorize the Contractor to transport an estimated 200 tons of contaminated soil, at a unit price of $136.27 per ton, for an increase in the contract price of $27,254.00, from $2,018,625.32 to $2,045,879.32. The contract was awarded on the basis that any additional funds needed for contingencies would be provided from the Park Construction Fee Fund. The sub-contractor, that will be transporting the con- taminated soil, has required that the City execute a "Contract for Shipment of Waste Soil." This contract stipulates that the City will sign manifests and the material will be in the ownership of the City. The Contractor has solicited price quotes from six sub- contractors that haul hazardous waste, and is using the one with the lowest price. Therefore, we recommend that Change Order No. One be approved. URGENCY CLAUSE The contaminated soil has been stockpiled on the job site. The Contractor's project schedule indicates work in this area in the near future. Prompt action is required to effect the removal of the stockpiled material and allow the Contractor to conform to his schedule.
