STAFF REPORT
Upon receiving a request from 50'l. of the adjoining owners to vacate a portion of "J"
street, North of.Oak Street, authorization was given on 10-21-88 to proceed with the
proposed vacation and Plan No. 7603 was approved.
utility companies and City department were notified of the proposed vacation and given
an opportunity to respond to the proposal.
On 04-03-89, a Negative Declaration was adopted for the proposed vacation,
finding of consistency with the Interim Policy Document was made.

On May 15, 1989, Resolution of Intention No. 89-152 was adopted, reserving easements
for public utilities and for sanitary sewer. That resolution sets a public hearing
date of June 19, 1989. On. May 24, 1989, the Resolution of Intention was published in a
local newspaper, Notices were posted in the area proposed for vacation,and property
owners adjacent to the proposed vacation were notified of said hearing.
There appears to be no further necessity fora portion of "J" Street, North of Oak
Street, either for present or future street purposes. Staff reco..end the vacation
on the basis of the following Findings of Fact:
1. The above portion of the street has been dete~ined by the Department of Public
Works to be of no further necessity to the general public:
o
a) Negative Declaration was adopted.
b) Traffic flow does not warrant a street in this area, since this portion of
"J" Street dead-ends at the Lytle Creek Flood Control Channel.
2. 50'l. of the adjoining property owners have requested the proceedings and the
required $400.00 fee has been paid.

By virtue of the mailing, posting and publication of the proposal,
this office nor the City Clerk's office has received any written
against the vacation as of this date.

3. All of the interested City Departments and Utility Companies were notified of the
proposal and all have had the opportunity to respond. A reservation of an easement
for sanitary sewer and appurtenant facilities, and for public utility purposes
has been requested and the same has been provided for in the Resolution of
Intention.
No special requirements have been placed upon the proponents relative to the
proceedings which would require an inspection of the area prior to the adoption of the
Resolution Ordering Vacation. Therefore, we have attached the said Resolution ordering
Vacation for your action.

2 A RESOLUTION OF THE CITY OF SAN BERNARDINO ORDERING THE VACATION
OF A PORTION OF "J" STREET . NORTH OF OAK SmET IN THE CITY. OF SAN
3 BERNARDINO AND RESERVING AN EASEKENT FOR SANITARY SEWER AND PUBLIC
UTILITIES, AND APPURTENANT FACILITIES THEREIN.

BE IT RESOLVED BY THE MAYOR AND COl1KON COUNCIl. OF THE CITY OF SAN
5 BERNARDINO AS FOLLOWS:

SECTION 1: The Mayor and Common Council of the City of San
7 Bernardino. having heard the evidence offered in relation to the proposed
8 vacation of a portion of "J" Street5. North of Oak Street. more
9 particularly described in City Resolution of Intention No. 89-152, hereby
10 find from all of the evidence submitted that such street proposed to be
11 vacated by said Resolution is unnecessary for present or prospective street

purposes.
SECTiON 2. The Mayor dnd Common Council of sai.d City do hereby
vacate a portion' of "J" Street, North of Oak Street,
San Bernardino,
California, more particularly described as follows:
That portion of "J" street, 55.00 feet wide, in the City
of San Bernardino, County of San Bernardino, State of
California, described as follows:
Beginning at the Southwest earner of Lot 16 of.TractNo.
1999, Bunker HUl Park, as per map recorded in Book 29 of
Haps, page 23, in the office of the County Recorder of
said County, said point also being the East line of "J"
Street, as delineated on the map of said Tract; thence
North, along the lines of said Lot 16 and Lot 17 of.slIid
Tract, to the Southerly line of Lytle Creek ChaRnel,
125.00 feet wide; thence Northwesterly, along said
Southerly line, to a point on the West line of said "J"
Street, as dedicated by a document recorded July :t, 1965,
in Book 6462. page 61, Official Records of said County;
thence South, along said West line. to it's intersection
with the Westerly prolongation of the South line of said
Lot 16; thence East. along said prolongation, a distance
of 55.00 feet, more or less, to the Point of Beginning.

SECTION 3. Nothing in this Resolution shall in any way affect
or disturb any existing easements for sanitary sewer and appurtenant
3 facilities and for public utility purposes belonging either to the
4 City of San Bernardino or to any public utility and there is hereby
5 reserved for fut\ure utility purposes for this City an easement reasonably
6 necessary to locate such sanitary sewer and to Southern California Edison
7
Company, an easement and right at any time, or from time to time to
8 construct, maintain, operate, replace and renew app\lrtenan~es thereto for
9 the transportation of electrical energy, and for incidental purposes,
10 including the right of egress and ingress thereto. over, in. under and
11 across the real property hereinabove described .
