STAFF REPORT
A request was received by this office to vacate a portion of Sunwest Court,
North of Hospitality Lane, from Sunwest Development. This vacation of the
"knuckle".'is to clean-up a prior street vacation which did. not cover this
small area of land, and is a condition of development.
On 02-20-89. authorization was giVen to proceed with the proposed vacation,
and Plan No. 7523 was approved.
All of the . interested City Departments and Utility Companies were
notified of the proposal on 02-28-89, with a reply due by 03-24';'89. The
responses are attached for your information. No reservations of easements
were requested.

On 05-15-89, a Negative Declaration was adopted and a finding of consistency
with the Interim Policy Document was made.
The remaining fee of $200.00 has been paid and it is recommended that
favorable consideration be giVen to the requested vacation. The Resolution of
I ntenti 011, which sets a protest date of 07-17-89 has been attached hereto
for your action also.
Upon the approval of said Resolution, all adjacent property owners will be
notified by mail of the hearing date.

RESOLUTION NO.
A RESOLUTION OF THE CITY OF SAN BERNARDINO DECLARING ITS INTENTION
TO ORDER THE VACATION OF A PORTION OF SUNIIEST COURT, NORTH OF HOSPITALITY
LANE,
BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN
BERNARDINO AS FOLLOIIS:
SECTION 1. That the Mayor and Common Council of .the City of San
Bernardino hereby declares its intention to order the vacation of a
portion of Sunwest Court, North of Hospitality Lane, described.as follows:
That portion of Sunwest Court, North of Hospitality Lane,
described as follows:
Commencing at the most Westerly corner of Parcell,
Parcel Map No. 9801, as per plat thereof, recorded in
Book 120 of Maps, Pages 50 and 51, Records of County of
San Bernardino, State of California, said corner being on
a non-tangent curve, concave Southwesterly and having a
radius of 70.00 feet, a radtal line of said curve,
through said point, bears North 16" 20' 46" East; thence
continuing Southeasterly along said curve, through a
central angle of 42" 22' 04", an arc distance of 51.76
feet to the True Poi nt of Begi nni ng; thence c!)nti nui ng
along said curve through a central angl e of 41" 14 I 21",
an arc distance of 50.38 feet; thence South 09" 57' 07"
West, a distance of 42.12 feet to the beginning of a
tangent curve, concave Easterly and having a radius of
88.00 feet; thence Southerly along said curve, through a
central angle of 10" 14' 11". an arc distance of 15.72
feet; thence North 00" 17' 04" West, a distance of 105.58
feet to the True Point of Beginning.
SECTION 2. That the Mayor and Common Council of the CHy of San
Bernardino. in vacating the above described portion of said street, elects
to proceed under and in accordance with the provisions of the .Public
Streets, Highways and Services Vacation Law", being Division 9, Part 3, of
the Streets and Highways Code of the State of California. .
SECTION 3. That the hour of 10:00 A.M. on the 17th of July,
1989, in the Council Chamber of the City Hall, San Bernardino, California,
be, and the Same hereby is fixed as the time and place when and .where all
persons interested in or Objecting to the proposed vacation may appear

6 SECTION 4. That the City Engineer of the City of San Bernardino
7 hereby is directed to cause Notices of Street Vacation to be posted as
8 required by the Public Streets. Highways and Services Vacation Law.
9 SECTION 5. That the City Clerk shall certify to the adoption of
10 this Resolution of Intention and shall cause the same to be published once a
11 week for two successive weeks in The Sun. a newspaper pUblished and
12 circulated in the City of San Bernardino. prior to the date of the above
13 pUblic hearing.
