STAFF REPORT

A request was received by this office to vacate a portion of an East/West
alley. North of 11th Street. between Lugo Avenue and Sepulveda Avenue. from
two-thirds of the owners who adjoin the area proposed for vacation.
On 04~03-89. authOrization was given to proceed with the proposed vacation.
and Plan No. 7751 was approved.
All of. the interested City Departments and UtilityCompanfes were
notified of the proposal on 04-05-89. with a reply due by 05-05-89. The
responses are attached for your information. A reservation of an easement
public utility purposes. which will have to be reserved. as set forth in the
attached Resolution of Intention.
The remaining fee of $200.00 been paid and it is recommended that favorable
consideration be given to the requested vacation. The Resolution of
Intention. which sets a protest date of 07-17-89 has been attached hereto
for your action also.
Upon the approval of said Resolution. all adjacent property owners will be
not1fied by mail of the hearing date.

A RESOLUTION OF THE CITY OF SAN BERNARDINO DECL^RING ITS I.NTENTlON
TO ORDER THE VACATION OF A PORTION OF THAT CERTAIN EAST/WEST AlLEY, NORTH OF
11TH STREET, BETWEEN LUGO AVENUE AND SEPULVEDA AVENUE AND RESERVING A PUBLIC
UTILITY EASEMENT THEREIN
BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN
BERNARDINO AS FOLLOWS:
SECTION 1. That the Mayor and Common Council of the City of San
7 Bernardino hereby declares its intention to order the vacation of a
8 portion of that certain East/West alley, North of 11th Street, between Lugo
Avenue and Sepulveda Avenue, and reserving a public utili ty easement
therein, described as follows:
That portion of that certain East/West alley located
North of 11 th Street, between Lugo Avenue and Sepul veda
Avenue, described as follows: .
Beginning at the Southwest corner of Lot 5 of BlOCk "B"
of Fairbanks' Addition, as per map recorded in Book 4 of
Maps, Page 17, in the office of the County Recorder of
San Bernardino County, State of California, said point
also being in the East line of Lugo Avenue, 60.00 feet
wide; thence East, along the South line of said Lot 5, a
distance of 152 feet, more or less, to the Southeast
corner of said Lot 5; thence South, along the Southerly
prolongation of the East line of said Lot 5, a distance
of 13 feet, more or less, to a point on the North line of
Lot 3, Block C of said Fairbanks' Addition; .thence West,
along the North lines of Lots 3, 2 and 1 of said Block C,
a distance of 152 feet, more or less, to the Northwest
corner of said Lot 1; thence North along the Northerly
prolongation of the West line of said Lot I, a dfstance
of 13 feet, more or less, to the Point of Beginning.
SECTION 2. That the Mayor and Common Council of the City of San
Bernardino, in vacating the above described portion of said street, elects
to proceed under and in accordance with the provisions of the "Public
Streets, Highways and Services Vacation Law", being Division 9, Part 3, of
the Streets and Highways Code of the State of California.
SECTION 3. That the hour of 10:00 A.M. on the 17th of July,
1989, in the Council Chamber of the City Hall, San BernardinO,' California,

o 1 be, and the same hereby is fixed as the time and place when and where all
2 persons interested in or Objecting to the proposed vacation may appear
3 before the said Mayor and Common Council and offer evidence in
4 re 1 a ti on thereto. For further parti cul ars as to the proposed vaca ti on of
5 the hereinbefore described portion of said street, reference is made to that
6 map marked .Plan No. 7751. approved April 3, 1989, on file in the office
7 of the City Clerk of said City.
8 SECTION 4. Nothing in this Resolution shall in anyway affect or
9 disturb any existing easements .for public utility purposes belonging either
10 to the City of San Bernardino or to any public utility, and there is hereby
11 spec1fi cally res.erved an easement for Southern Ca l1fornfa Edfsonto
12 construct, place, operate, inspect, maintain, repair, replace and remove
13 such aerial and underground electrical transmission structures as the
C 14 company may from time to time require, consisting of poles, anchors, wires,
15 cables, conduits, manholes, markers and necessary fixtures and
16 appurtenances, including the right of ingress and egress thereto.
.17 SECTION 5. That the City Engineer of the City of San Bernardino
18 hereby is directed to cause Notices of Street Vacation to be posted as
19 required by the Public Streets, Highways and Services Vacation Law.
20 SECTION 6. That the City Clerk shall certify to the adoption of
21 this Resolution of Intention and shall cause the same to be published once a
22 week for two successive weeks in The Sun, a newspaper published and
23 circulated in the City of San Bernardino, prior to the date of the above
24 pUblic hearing.
