Bids for maintenance of landscaping
Kendall Drive, Shandin Hills Circle and Shandin
opened at 2:00 p.m., on Thursday, 5-18-89.
A total of 3 bids were received, ranging from $13,780.00
to $15,861. 00, for the Basic Bid and the Supplemental Items of
work. The low bid of $13,780.00 is 22.4% under the Engineer's
Estimate of $17,750.00.

The bid documents were prepared to include the routine
maintenance of lawns and trees in accordance witha. .specified
schedule, while replacement of plant materials and irrigation
system components were included as supplemental items. of work.
Quantities for the items in the Basic Bid are definitive, but
are indeterminate for those items included as supplemental.
Listed below is an estimate of the total estimated cost
of providing these landscape maintenance services from 7-1-89 to
6-30-90, based upon the actual low bid price.

Maintenance Contract -

The Notice to Proceed will be effective as of 7-1-89.
The contract will be in effect until 6-30-90, subject to two
one-year extensions, by mutual consent.

Funding o.f the costs incurred for maintenance of this
landscaping will be provided pursuant to Resolution No. 84-448,
adopted on 11-8-84, which orders the maintenance of the
landscaping installed by the subdivider. Formation of an
assessment district for maintenance of landscaping was a
condition of approval for the Shandin Hills Development. This
district was established on 11-8-84 over all tracts within this
development, and will be implemented as the areas are developed.
This development was delayed by the moratorium. The
condition of approval required that the subdivider maintain the
landscaping for a period of one year. This time has elapsed,
and the maintenance will be assumed by the Contractor.

Costs for maintenance of this landscaping will be up-
fronted by the City, as set forth in the Resolution Of Inten-
tion (84-335) . These costs will be reimbursed through
assessments levied on all parcels within the zone of benefit.
Supervision of the Contractor's work will be provided by
the Department of Parks, Recreation and Community Services.
We recommend that a contract be awarded to .the low
bidder.

RESOLUTION NO.
RESOLUTION OF THE CITY OF SAN BERNARDINO AWARDING A
CONTRACT TO C & D LANDSCAPING SERVICES, INC. FOR MAINTENANCE OF
LANDSCAPING IN PORTIONS OF KENDALL DRIVE, SHANDIN HILLS CIRCLE,
AND SHANDIN HILLS DRIVE, IN ASSESSMENT DISTRICT NO. 959.
BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE
CITY OF SAN BERNARDINO AS FOLLOWS:
SECTION 1.
C & D Landscaping Services,' Inc. is the
7 lowest responsible bidder for Landscaping in portions of Kendall
8 Drive, Shandin Hills Circle, and Shandin Hills Drive, in Assess-
9 ment District No. 959, in accordance with Plan No. 6363-B (1989-
10 90), for the total amount of $13,870.00, and a contract for the
11 Basic Bid and Supplemental Items, is awarded to said bidder
12 accordingly, but such award shall be effective only upon the
13 contract being fully executed by the parties; all other bids
c:> 14 therefore are hereby rejected; and the Mayor is hereby authorized
15 and directed to execute said contract on behalf of the City; a
16 copy of the contract is attached hereto, marked Exhibit "A" and
17 incorporated herein by reference as fully as though set forth at
18 length.
19 SECTION 2. This contract and any amendment or modifica-
20 tions thereto shall not take effect or become operative until
21 fully signed and executed by the parties and no party shall be
22 obligated hereunder until the time of such full execution. No
23 oral agreements, amendments, modifications or waivers are
o
24 intended or authorized and shall not be implied from any act or
25 course of conduct of any party.
26 SECTION 3. This resolution is rescinded if the parties
27 0 the contract fail to execute it within sixty (60) days of the
