COUNCIL. ACTION >J o STAFF REPORT The rehabilitation of the pavement on South "E" Street, from Santa Ana River to Orange Show Road, has been approved for funding with Federal-Aid Urban Funds. Execution of Program Supplement No. 54 will serve to obligate $590,000 of Federal-Aid Urban Funds, to finance 86% of the total project cost. The local agency share will be financed from the $94,800 in City funds, allocated under Account No. 242~ 362-57668. The plans for this project have been prepared. by the Engineering Division, and submitted to Caltrans for review and approval. We recommend that Program Supplement No. 54 be approved. o COMMENT: The local matching funds is estimated at $96.949 and $94.800 is available in City funds. STATE OF 4 CALIFORNIA, ACTING BY AND THROUGH ITS DEPARTMENT OF TRANSPORTATION. 5 6 7 BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: SECTION ONE: The Mayor of the City of San Bernardino 8 is hereby authorized to execute, in behalf of said City, 9 Program Supplement No. 54 of Local Agency Federal-Aid Safety 10 Improvement Projects, between said City and the State of California, acting by and through its Department of Trans- portation, a copy of which is attached hereto marked Exhibit "An and incorporated herein by reference as fully as though set forth at length herein. SECTION TWO: Execution and Amendments. This agreement. and any amendments or modifications thereto shall not take effect or become operative. until fully signed and executed by the parties and no party shall be obligated hereunder until the time of such full execution. All maintenance, involving the physical condition and the operation of the improvements, referred to in Article VI MAINTENANCE of the aforementioned Master Agreement will be performed by the Local Agency at regular intervals or as required for efficient operation of the completed improvements. 2. The Local Agency will advertise, award, and administer this project and will obtain the state's concurrence prior to either award or rejection of the contract. 3. The Local Agency agrees the payment of Federal funds will be limited to the Detail Estimate amounts approved by the Federal Highway Administration in the Federal-Aid project Agreement (PR-2), or its modification (PR-2A), and accepts any increases in Local A~ency Funds as shown on the Finance or Bid Letter or its mod~fication as prepared by the Division . of Local streets and Roads. 4. In executing this program supplemental Agreement, Local Agency hereby reaffirms the "NOndiscrimination Assurances" contained in the aforementioned Master Agreement for Federal-Aid program. 5. Whenever the local agency uses Federal or state Funds to pay a consultant on a cost plus basis, the local agency is required to submit a post audit report covering the allowability of cost payments for each individual consultant or sub-contractor incur- ring over $25,000 on the project. The audit report must state the applicable cost principles utilized by the auditor in determining allowable costs as referenced in CFR 48, part 31, contract Cost principles.
