STAFF REPORT
A request was received by this office to vacate a portion of that certain unnamed
East/West Street,located South of Highland Avenue and East of Elawood Road, fro.
several of the adjoining property owners. This request represents 861 of those
owners who adjoin the area proposed for vacation.
On 10-24-88, authorization was given to proceed with the proposed vacation, and
Plan No. 7604 was approved.
All of the interested City Departaents and utility Companies were notified
of the proposal on 01-31-89, with a reply due by 02-24-89. The responses are.
attached for your inforaation. A reservation of an easement for public utilities
and for water lines and appurtenant facilities was requested, which will have to
be reserved, as set forth in the attached Resolution of Intention.
On 04- 03-89, a Negative Declaration was adopted and a finding of consistency
with the Interi. Policy Docuaent was aade.
The reaaining fee of $200.00 been paid and it is recoBlended that favorable
consideration be given to the requested vacation. The Resolution of Intention,
which sets a protest date of 07-17-89 has been attached hereto for your action
also.

Upon the approval of said Resolution, all adjacent property owners will be
notified by lIllil of the hearing date.

A RESOLUTION OF THE CITY OF SAN BERNARDINO DECLARING ITS INTENTION
3 TO ORDER THE VACATION OF A PORTION OF THAT CERTAIN UNNAMED EAST/WEST STREET
LOCATED SOUTH OF HIGHLAND AVENUE AND BAST OF ELltWOOD ROAD AND RESERVING AN
4 EASEHENT FOR WATER LINES AND PUBLIC UTILITIES THEREIN .

BE IT RESOLVED BY THE KAYOR AND COHIION COUNCIL OF THE CITY OF SAN
6 BERNARDINO AS FOLLOWS:
7 SECTION 1. That the Kayor and Co.on Council of the City of San
8 Bernardino hereby declares it's intention to order the vacation of a

portion of that certain unnued East/West Street located south of Highland
Avenue and east of El.wood Road , described as follows:
That portion of that certain unnllIIed East/West Street
shown on the "Illlp of Tract No. 3879, Highland Park," as per
map recorded in Book 50 of Kaps, page 50, in the office
of the County Recorder of the County of San Bernardino,
State of California, described as follows:
Beginning at the Northwest corner of Lot 2 of said tract;
thence East, along the North lines of Lotsi2, 3, 4, 5, 6
and 7 of said tract, to the Northeast corn~r of said Lot
7; thence North, along the Northerly prolo,gation of the
east line of said Lot 7, a distance of 4O!feet more or
less, to the South line of Highland Avenue, as shown said
map; thence West, along said South line, to it's
intersection with the Northerly prolongation of the West
line of said Lot 2; thence South, along said
prolongation, a distance of 40 feet, aore or less, to the
Point of beginning.
SECTION 2. That the Kayor and Co.on Council of the City of San
Bernardino, in vacating the above described portion of said street ,elects
to proceed under and in accordance with the provlsions of the "Public
Streets, Highways and Services Vacation Law", beiIl$l Division 9, Part 3, of
the Streets and Highways Code of the State of Califotnia.
SECTION 3.
That the hour of 10:00 A.M. on the July" 17, 1989,
in the Council Chamber of the City Hall, San Bernardino, California,

RESOLUTION OF INTENTION: PORTION OF THAT CERTAIN EAST/lIEST STREET SOUTH OF
HIGHLAND AVEHUll, EAST OF ELMWOOD ROAD

1 persons interested in, or objecting to the proposed vacation may appear
2 before the said Mayor and Co..on Council and offer evidence in
3 relation thereto. For further particulars as to the proposed vacation of
4 the hereinbefore described portion of said street, reference is made to that
5 map marked "Plan No. 7604," approved on October 24, 1988, on file in the
6 office of the City Clerk of said City.
7 SECTION 4. Nothing in this Resolution shall in any way affect
8 or disturb any existing easements for public utility purposes belonging
9 either to the City of San Bernardino or to any public utility and there
10 is hereby reserved an easement for future utility purposes for this City and
11 for public utility purposes, more particularly and easement for water lines
12 and appurtenant facilities to East Valley Water District over the entire
13 portion of the real property hereinabove described, and for Southern
14 California Gas Company Company, an easement and right at any time, or from
15 time to time to construct, maintain, operate, replace and, renew
16 appurtenances thereto for the transportation of natural gas, in, over, under
17 and across the Southerly 20 feet of the real property hereinabove
18 described.
19 SECTION 5. That the City Engineer of the City of San Bernardino
20 hereby is directed to cause Notices of Street Vacation to be posted as
21 required by the Public Streets, Highways and Services Vacation Law.
22 SECTION 6. That the City Clerk shall certify to the adoption of
23 this Resolution of Intention and shall cause the same to be published once a

24 week for two successive weeks in The Sun, a newspaper published and
25 circulated in the City of San Bernardino, prior to the date of the above
26 public hearing.
