STAFF REPORT
On July 29, 1988, a "Notice to Clean Premises" was mailed to Michael
P. and Brenda Allen, 208 South "0" Street, San Bernardino, CA 92401,
regarding property Parcel No: 0151 201 09 and, No. 0151 201 10, located
at 4th and Kendall Streets. A copy of the notices are attached as
Exhibits "A" and "B".
The above parcels were not cleaned within ten (10) days of the
notices. Therefore, the City on or about August 21, 1988, abated the
weeds and debris at the above parcels. Extensive cleanup was necessary.
Copies of the solid waste dump tickets are attached "C", "D", and "E".
In September, 1988, along with their bill, the Allens were sent a
notice of hearing before the Board of Building Conmissioners scheduled
for December 2, 1988, regarding the assessment costs for the abatement of
their parcels. The hearing in December was postponed by the Board until
January 6, 1989, and the Allens were notified of the change of date.
In October, 1988, Mrs. Allen called the Public Services Department,
complaining about the bill and requested copies of the "Notice to Clean
Premises". Later she requested copies of the dump tickets, all of which
were provided by the Department.
The heari ng on the assessments on the Allen's property, Parcel No.
VI 0151 201 09 and No. 0151 201 10, was held January 6, 1989. Evidence was
presented to the Board of Building Conmissioners regarding the Allen's
abatement and assessment costs. The Allen's were not present at this
hearing. '
Based on the evidence presented, the Board unanimously adopted the
sum of $1,667.26 to be assessed against the Allens and ordered that a
lien be placed on their property, if the assessments were not paid. A
copy of the Board of Building Conmissioners resolution is attached as
Exhibit "F".
A reso 1 uti on adopti ng the assessments for abatement of the All en' s
parcels was adopted by the Mayor and City Council on February 2, 1989.
The Allens were also not in attendance at the Council meeting. A copy of
the resolution is attached, and marked as Exhibit "G", along with a copy
of the Board of Building Conmissioners resolution (Exhibit "F").
In March 1989, Mr. Allen contacted both the Ci ty Cl erk 's offi ce
requesting an appeal of the assessment costs. At that time the City,
Clerk's office advised Mr. Allen to send in a written request for an
appeal giving the reasons for appealing and the relief or action sought
from the Council. The written appeal was received by the City Clerk's
office on or about April 7, 1989, marked as Exhibit "H".

RESOLUTION OF THE BOARD OF BUILDING COMMISSIONERS OF THE CITY
OF SAN BERNARDINO ASSESSING COSTS OF ABATEMENT OF PUBLIC SERVICES
WHEREAS, the Director of Public Services of the City of San
Bernardino has given notice of and thereafter abated a public
nuisance found to exist on the properties described in Exhibit
"A" attached to and hereby incorporated in this resolution; and
WHEREAS, a notice of the costs of abatement has been mailed
to the owner of each property described herein advised of the
cost of the abatement to be assessed and of the right to file
a protest before this Board and to have a hearing thereon; and
WHEREAS, every person against whom an assessment has been
proposed has been afforded on opportunity to be heard by the Board
heretofore;
NOW, THEREFORE, BE IT FOUND THAT:
Notice was given to each property owner in accordance with
the provisions of Section 8.27.1000 of the San Bernardino Municipa
code.
The Board has heard and considered the evidence relative
to the amount of the assessments presented by the Director of
Public Services.
These costs are found to have been incurred by the City pur-
suant to proceedings under the San Bernardino Municipal Code,
and the final statement of costs is hereby assessed as a special
assessment against the properties described and in the amounts
set forth in Exhibit "A".
A copy of this resolution shall be filed with the City Clerk,
to be posted with the Notice of Hearing for at least three days
near the main door of the Council Chamber, as required by Section

RESOLUTION OF THE CITY OF SAN BERNARDINO CONFIRMING COSTS OF
ABATEMENT OF PUBLIC NUISANCES AND IMPOSING LIENS ON CERTAIN REAL
PROPERTY LOCATED WITHIN THE CITY OF SAN BERNARDINO FOR THE COSTS
OF THE ABATEMENT
WHEREAS. the City of San Bernardino. pursuant to its author-
ity under Chapter 8.27 of the San Bernardino Municipal Code. did
lawfully cause public nuisances to be abated on the properties
described in Exhibit "A" attached to and incorporated in this
resolution: and
WHEREAS. notice was given to the owners of record of said
properties. and a hearing has heretofore been held to hear pro-
tests and assess the costs of said abatement before the Board of
Building Commissioners.
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COMMON COUN-
CIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS:
SECTION 1. Said costs are found to have been incurred by
the City pursuant to proceedings under the San Bernardino Munici-
pal Code. and the final statement of costs on file with the City
Clerk is hereby confirmed and adopted as special assessments
against the properties listed in Exhibit "A" hereto.
SECTION 2. If said sum is not fully paid to the City Clerk,
City Hall, San Bernardino, within five (5) days after mailing a
notice to the person or persons having an interest in said pro-
perty informing said person or persons of the adoption of this
resolution as to any such individual parcel, then said sum shall
be and become a lien on said property pursuant to said Municipal
Code provisions and applicable laws and shall be collected as a
special assessment thereon.
SECTION 3. In the event any sum is not paid as hereinabove

Regarding: Weed Abatement Lien

Pursuant to the suggestion of Doris, an employee of the City Clerk's Office,
I am advising the Q"fice of the Mayor and .Common Council of my Intentions
to appeal the Weed Abatement Lien, previously assessed against me, by the
City of San Bernardino.
I, personally, feel that the lien was unjustified and not In accordance with
proper laws I regulations of our city, since I had not received proper noti-
fication that the City of San Bernardino was concerned over the condition
of the vacant parcel of land and feel that the city representative that de-
clared the condition of the property a nuisance was In error.
If I had been apprised of the concern of certain parties, I would have de-
finitely initiated actions to prevent a lien in the amount of $1,667.26.
Therefore, I would appreciate a hearing before the appropriate individuals
to discuss my objection to this lien in an attempt to eliminate, what I con-
sider, an unfair lien.
