Execution of a program supplement is required to obligate the Federal-Aid Urban Funds allocated for the project. Program Supplement No. 53 has been prepared by Caltrans to fulfill this requirement. We recommend that Program Supplement No. 53 be approved. 4-28-89 75.0264 ~ WI a l$ - < .~ o 1 RESOLUTION NO. 2 RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AUTHORIZING THE EXECUTION OF PROGRAM 3 SUPPLEMENT NO. 53 OF LOCAL AGENCY FEDERAL-AID SAFETY IMPROVEMENT PROJECTS, BETWEEN SAID CITY AND THE STATE OF 4 CALIFORNIA, ACTING BY AND THROUGH ITS DEPARTMENT OF TRANSPORTATION. 5 BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE 6 CITY OF SAN BERNARDINO AS FOLLOWS: 7 8 SECTION ONE: The Mayor of the City of San Bernardino is hereby authorized to execute, in behalf of said City, 9 Program Supplement No. 53 of Local Agency Federal-Aid Safety 10 Improvement Projects, between said City and the State of 11 California, acting by and through its Department of Trans- 12 portation, a copy of which is attached hereto marked Exhibit 13 "A" and incorporated herein by reference as fully as though 14 set forth at length herein. 15 SECTION TWO: Execution and Amendments. This agreement 16 and any amendments or modifications thereto shall not take 17 effect or become operative until fully signed and executed by 18 the parties and no party shall be obligated hereunder until the 19 time of such full execution. All maintenance, involving the physical condition and the operation of the improvements, referred to in Article VI MAINTENANCE of the aforementioned Master Agreement will be performed by the Local Agency at regular intervals or as required for efficient operation of the completed improvements. 2. The Local Agency will advertise, award, and administer this project and will obtain the State's concurrence prior to either award or rejection of the contract. 3. The Local Agency agrees the payment of Federal funds will be limited to the Detail Estimate amounts approved by the Federal Highway Administration in the Federal-Aid Project Agreement (PR-2), or its modification (PR-2A), and accepts any increases in Local Agency Funds as shown on the Finance or Bid Letter or its modification as prepared by the Division of Local Streets and Roads. 4. Cal-State University has agreed to contribute a lump sum of $50,000 toward this project. 5. In executing this Program Supplemental Agreement, Local Agency hereby reaffirms the "Nondiscrimination Assurances" contained in the aforementioned Master Agreement for Federal-Aid Program. 6. Whenever the local agency uses Federal or state Funds to pay a consultant on a cost plus basis, the local agency is required to submit a post audit report covering the allowability of cost payments for each individual consultant or sub-contractor incur- ring over $25,000 on the project. The audit report must state the applicable cost principles utilized by the auditor in determining allowable costs as referenced in CFR 48, part 31, Contract Cost Principles.
