STAFF REPORT
This action is based on a request from the developers of Tract
No. 13470 located North of Piedmont Drive at Indian Canyon
Court to comply with a condition imposed by the City to
establish an assessment district for the maintenance of
landscaping. The district will be maintaining a South facing
slope in the back yards of certain lots in Tract No. 13470
which face the rear lots of existing dwellings in Tract No.
8277. Tract No. 13470 adjoins Assessment District No. 982 on
the North. hence the joining of the two areas.
On March 20. 1989. the Resolution of Intention to Amend the
Boundaries of Assessment District No. 982 was adopted which
declared the City's intention to proceed with the expansion of
the District to include additional territory within the
boundaries of. the District.
Due to the fact of 1001 participation by the owners of the area
to be included in the district. notice and hearing was not
necessary (Section 12.90.040C(5) of the Municipal Code) and
this Resol ution is the next formal step in the proceedings.

A RESOLUTION OF THE CITY OF SAN BERNARDINO FINDING AND
DETERMINING THAT THE PUBLIC CONVENIENCE AND NECESSITY REQUIRE
THE AMENDMENT OF BOUNDARIES OF ASSESSMENT DISTRICT NO. 982 BY
EXPANDING THE BOUNDARIES THEREOF TO INCLUDE ADDITIONAL
TERRITORY IN THE DISTRICT; TO EXPAND THE SCOPE THEREOF TO
INCLUDE THE MAINTENANCE OF LANDSCAPING OF ADDITIONAL TERRITORY
IN THE DISTRICT IN T~E AREA OF PIEDMONT DRIVE; ORDERING THE
AMENDMENT AND EXPANSION OF THE BOUNDARIES AND SCOPE OF THE
DISTRICT AND THAT THE SPECIAL ASSESSMENT, INVESTIGATION AND
LIMITATION ACT OF 1931 SHALL NOT APPLY AND APPROVING AMENDED
ASSESSMENT DISTRICT DIAGRAM MAP NO. 982.
WHEREAS, by Resolution No. 87-139 adopted May II,
19.B7, the Mayor and Common Council of the City of San
Bernardino created Assessment District No. 982 for the
maintenance of landscaping in the area of Piedmont Drive and
Citrus Street; and
WHEREAS, the Mayor and Common Council of the City of
San Bernardino have preliminarily found that the public
interest, convenience, and necessity require the amendment of
the boundaries of Assessment District No. 9B2 by the expansion
thereof to i ncl ude addi ti ona 1 terri tory and by expandi ng the
18 scope thereof to include the maintenance of additional
terri tory wi thin the boundaries of the di stri ct; and
WHEREAS, the Mayor and Common COuncil of the City of
San Bernardino have, on the 20th of March, 1989, passed and
adopted Resolution No. 89-81 entitled:

PRELIMINARILY DETERMININ~ THAT THE PUBLIC
CONVENIENCE AND NECESSITY REQUIRE THE AMENDMENT OF
SCOPE AND BOUNDARIES OF ASSESSMENT DISTRICT NO. 982
BY EXPANDIHG THE BOUNDAR IES THEREOF TO INCLUDE
ADDITIONAL TERRITORY IN THE DISTRICT; TO EXPAND THE

NOW. THEREFORE. BE IT RESOLVED BY THE MAYOR AND
COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AS FOllOWS:
SECTION 1.

necessfty requfre. and the Mayor and Common Councfl of the
Cfty of San Bernardfno hereby declares by not less than a

Bernardfno Munfcfpal Code. that the pUblfc fnterest.
convenfence. and necessfty requfres and hereby orders. the
amendment of the boundarfes and scope of Assessment Dfstrfct
No. 982 by expandfng the boundarfes and scope thereof to
fnclude addftfonal terrftory fn the dfstrfct and to fnclude
the mafntenance of landscapfng of addftfonal terrftory fn the
dfstrfct; the work descrfbed fn safd Resol utfon No. 89-91 to
be done as provfded fn safd Resolutfon and that the Specfal
Assessment. Investfgatfon and lfmftatfon Act of 1931 shall not
apply.

SECTION 2. Reference hereby is made to said
Resolution No. 89-91 for a description of the work, the extent
of the assessment district and the extent of the additional
scope of the assessment district, the financing alternatives
and for further parti culars.
SECTION 3. That Amended Assessment Diltrict Diagram
Map No. 982 is hereby approved.
