COUNCIL ACTION STAFF REPORT The proposed foraation of Underground utility District No. 19, was approved by the City's Underground utility District Committee at their meeting of 11-10-88. On November 21, 1988, the Director of Public Works/City Engineer and the City Clerk were authorized to proceed with the establishment of Underground Utility District No. 19, and Resolution No. 86-440, noticing a public hearing for January 3, 1989, at the hour of 10:00 a.m. was adopted. All property owners within the district were notified by mail of the public hearing. On January 3, 1989 , the public hearing was held, determining that the public necessity, health, safety or welfare, requires the creation of the proposed district. No protests were made at that hearing, and neither the City Clerk's office nor this office received any written protests. utility companies are required by Rule 20 of the Public Utilities Commission to set aside a certain portion of their revenues to finance the cost of undergrounding overhead facilities within districts established by local agencies. Each agency is allocated a certain amount of funds based upon the total number of overhead services within the agency's boundaries. The Underground Utility Committee of that agency reviews and designates areas proposed for the establishment of a district. Property owners within the district will be required to complete the undergrounding from their property lines to the service points at their own cost. Only those poles lying within 150 feet of Wateman Avenue will need to be removed at this time. As properties develop, the remainder of poles to the rear property line will then need to be removed. This will ease the cost of conversion on the property owners of large parcels. Approximately one-third of the proposed district lies within jurisdiction of the County of San Bernardino. On April 24, 1989, the County Board of Supervisors adopted a resolution declaring it's intent to fom the proposed district and held a public hearing on May 22, 1989. At that meeting, the Board also adopted a resolution creating the proposed district. The total cost of this project will be approximately $6,000,000, with the City using $4,000,000 of Rule 20 allocations, and the County using their proportionate share of $2,000,000. Since this project will be financed from Rule 20 allocations, no City funds will be used. If the proposed district is created, undergrounding will be done in phases, with final completion scheduled for around May 31, 1993. (j) e @) l- e ,. ~ @ 1 @ i (j) ! e ~ (j) . t . 1 - . o o ~ 1 RESOLUTION NO. 2 RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO CREATING UNDERGROUND UTILITY DISTRICT NO. 19, LOCATED BETWEEN 3 NINTH STREET AND THE SANTA ANA RIVER. 4 WHEREAS, a public hearing was held on January 3, 1989, at the hour 5 of 10:00 a.lI., at the Council Chllllbers, 300 North "D" Street, San 6 Bernardino, California, to determine whether the public necessity, health, 7 safety or welfare required the formation of an Underground Utility District 8 No. 19 generally located along Waterllan Avenue, between the South line of 9 the Santa Ana River and the North line of 9th Street, San Bernardino, 10 California; and 11 WHEREAS, notice of such hearing has been given to all affected 12 property owners as shown on the last equalized assessllent roll and to all 13 utilities concerned in the manner and for the time required by law; and 14 WHEREAS, such hearing has been duly and regularly held and all 15 persons interested have been given an opportunity to be heard; 16 NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF 17 THE CITY OF SAN BERNARDINO, AS FOLLOWS: 18 SECTION 1. It is hereby found and determined pursuant to Chapter 19 13.36 of the San Bernardino Municipal Code of the City of San Bernardino, 20 and to definitions contained therein that the public necessity, health, 21 safety and welfare require the formation of an underground utility district 22 generally located along Waterman Avenue between the South line of the Santa 23 Ana River, and the North line of 9th Street, San Bernardino, California, 24 for the removal of all overhead utilities and appurtenant facilities. 25 SECTION 2. An underground utility district to be known as 26 Underground utility District No. 19 is hereby established in that area 27 generally located along Waterman Avenue, between the South line of the Santa 28 Ana River and the North line of 9th Street, more particularly shown on Plan 05-10-89 .. . All poles, overhead wires and associated structures shall be removed and underground installations _de underground utility district within the following times: a. Underground installation by utility companies and property owners and reconnections not later than April 30, 1990 for that portion of said district lying between the South line of Santa Ana River, and the South line of the Flood Channel located approxi_tely 490 feet north of Mill Street, hereinafter referred to as Zone 1; ~une 30, 1991 for that portion of the district lying between the South line of said Flood Control Channel and the South line of 5th Street, hereinafter referred to as Zone 2; February 28, 1993 for the remaining portion of said district lying between the South line of said 5th Street and the North line of 9th Street, hereinafter referred to as Zone 3. b. Removal of poles, overhead wires and other associated structures not later than June 30, 1990 for Zone 1; September 30, 1991 for Zone 2; May 31, 1993 for Zone 3. c. All parcels lying adjacent to WateI'IIaD Avenue within said district shall be affected by said conversion, with the following exceptions: conversion of all overhead facilities lying beyond 150 feet East of the East line of Waterman Avenue, and beyond 150 feet West 'of the West line of Wateman Avenue, may be deferred until such time as development or redevelopment occurs within the respective parcels. SECTION 4. The City Clerk is hereby directed to mail a copy hereof and a copy of Chapter 13.36 of the San Bernardino Municipal Code, to all affected property owners as shown on the last equalized assessment roll and to all affected utilities within ten (10) days after the adoption of overhead in said \, 05-10-89 2 ~,. .
