STAFF REPORT
Bids for rehabilitation of parking lots for Lytle Creek
Park were opened on Tuesday, May 2, 1989, at 2:00 p.m.
A total of 6 bids were received, ranging from $59,271.12
to $67,298.20. The low bid was 9.5% under the Engineer's
Estimate of $65,500.00".
The total .project cost, based on the actual low bid
price is:

Engineering & Inspection (W.O. 1836) 8,100.00
Sub Total $ 67,371.12
Contingencies (15%)! 10,128.88

RESOLUTION NO.
2 RESOLUTION OF THE CITY OF SAN BERNARDINO AWARDING A
CONTRACT TO IPS SERVICES, INC. FOR REHABILITATION OF PARKING LOTS
3 AT LYTLE CREEK PARK.
4 BE IT RESOLVED BY THE MAYOR AND CO~ON COUNCIL OF THE
CITY OF SAN BERNARDINO AS FOLLOWS:

SECTION 1. IPS Services, Inc. is the lowest responsible
7 bidder for: Rehabilitation of Parking Lots at Lytle Creek Park,
8 in accordance with Plan No. 7694, for the total amount of
9 $59,271.12, and a contract is awarded to said bidder accordingly,
10 but such award shall be effective only upon the contract being
11 fully executed by the parties 1 all other bids therefore are
12 hereby rejectedl and the Mayor is hereby authorized and directed
13 to execute said contract on behalf of the CitYl a copy of the
14 contract is attached hereto, marked Exhibit "A" and incorporated
15 herein by reference as fully as though set forth at length.

SECTION 2. This contract and any amendment or modifica-
17 tions thereto shall not take effect or become operative until
fully signed and executed by the parties and no party shall be
obligated hereunder until the time of such full execution. No
oral agreements,
amendments, modifications or waivers are
intended or authorized and shall not be implied from any act or
course of conduct of any party.
SECTION 3. This resolution is rescinded if the parties
to the contract fail to execute it within sixty (60) days of the
passage of this resolution.
I HEREBY CERTIFY that the foregoing resolution was duly
adopted by the Mayor and Common Council of the City of San
Bernardino at a
