'CITY OF SAN BERNADINO - REQUEST AM COUNCIL ACTION
STAFF REPORT
Th15 request was initiated by the City of San Bernardino to vacate the
frontage road West of Waterman Avenue. South of Caroline Street.
On 03-20-89, authorization was given to proceed with the proposed vacation,
and Plan No. 7726 was approved.
All of the interested City Departments and Utility Companies were
notified of the proposal on 03-21-89. with .a < reply due by 04-21-89. The
responses are attached for your information;-,fll request for an easement for
'\ storm dra in facil i ti es and traffi c si gna 1 equi pment and appurtenant
facilities was requested. along with a reservation of an easement for public
utility purposes. which will have to be reserved, as set forth in the
attached Resolution of Intention.
As th15 is a City initiated request, the fee has been waived, and it 15
recommended that favorable consideration be given to the requested vacation.
The Resolution of Intention. which sets a protest date of 07-03-89 has been
attached for your action also.
C" The City of Riverside has expressed concern regarding ingress and egress to
, their property. In order to alleviate those concerns. the Resolution'
Ordering Vacation will be contingent upon the granting of an easement for
ingress and egress to the City of Riverside from the adjoining property
owner, The Sunset Group.
Upon the approval of said Resolution of Intention, all adjacent property
owners will be notified by mail of the hearing dat~

RESOLUTION NO.
A RESOLUTION OF THE CITY OF SAN BERNARDINO DECLARING ITS INTENTION
TO ORDER THE VACATION OF A FRONTAGE ROAD, WEST OF WATERMAN AVENUE, SOUTH OF
CAROLINE STREET AND RESERVING EASEMENTS THEREIN
BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN
BERNARDINO AS FOLLOWS:
SECTION 1. That the Mayor and Common Council of the City of San
Bernardino hereby declares its intention to order the vacation of a
frontage road located West of Waterman Avenue, South of Caroline Street,
and reserving easements therein, described as follows:
That portion of Waterman Avenue, lying within Lot 4,
Block 65 of Rancho San Bernardino, as per plat thereof,
recorded in Book 7 of Maps, Page 2, Records of San
Bernardino County, State of California, described as
follows:
Commencing at the intersection of the center1ines of
Waterman Avenue and Caroline Street; thence South 890 47'
49" West, along the centerline of said Caroline Street, a
distance of 195.09 feet; thence South 000 12' II" East, a
distance of 30.00 feet to the South line of said Caroline
Street, said point also being the True Point of
Beginning; thence South 00' 01' 25" East, a distance of
40.00 feet; thence South 360 14' 39" East, a di stance of
160.77 feet to a point 100.00 feet Westerly of the
centerline of Waterman Avenue; thence South 000 01' 25"
East and parallel with said centerline of Waterman
Avenue, a distance of 290.48 feet; thence South 030 29'
11" West, a distance of 256.64 feet; thence South 890 47'
54" West, a distance of 49.66 feet; thence South 000 01'
25" East a distance of 110.00 feet; thence North 890 47'
54" East, a distance of 85.00 feet; thence North 040 39'
41" East, a distance of 367.30 feet to a poi nt 50.00 feet
Westerly of Waterman Avenue; thence North 000 01' 25"
West and parallel with said centerline of Waterman
Avenue, a distance of 375.79 feet; thence North 050 20'
55" West, a distance of 60.19 feet; thence North 470 46'
33" West, a distance of 36.91 feet; thence South 890 47'
49" West, parallel with the centerline of said Caroline
Street, a distance of 112.09 feet to the True Point of
Beginning.
SECTION 2. That the Mayor and Common Council of the City of San
Bernardino, in vacating the above described portion of said street, elects
to proceed under and in accordance with the provisions of the "Public

SECTION 3. That the hour of 10:00 A.M. on the~-Of--JU1Y,

4 1989, in the Council Chamber of the City Hall, San Bernardino, California,
5 be, and the same hereby is fixed as the time and place when and where all
6 persons interested in or objecting to the proposed vacation may appear
7 before the said Mayor and Common Council and offer evidence in relation
8 thereto. For further particulars as to the proposed vacation of the
9 hereinbefore described portion of said street, reference is made to that map
10 marked "Plan No. 7726", approved March 20, 1989, on file in the office of
11 the City Clerk of said City.

SECTION 4. Nothing in this Resolution shall in any way affect or
13 disturb any existing easements for public utility purposes belonging
14 either to the City of San Bernardino or to any public utility and there
15 is hereby specifically reserved, for the City of Riverside, an easement and
16 right at any time, or from time to time to construct, maintain, operate,
17 replace and renew one or more pipelines and appurtenances thereto, for the
18 transportation of water, and for incidental purposes, including the right of
19 ingress and egress thereto, and an easement for Paci fi c Bell and Southern
20 CalHornia Edison to construct, place, operate, inspect, maintain, repair,
21 replace and remove such aerial and underground telephone, telegraph and
22 communication structures and electrical transmission structures
23 respectively, as the companies may from time to time require, consisting of
24 poles, anchors, wires, cables, conduits, manholes, markers and necessary
25 fixtures and appurtenances. There is also speCifically reserved for the
26 City of San Bernardi no, an easement in, over, under and across the North
27 twenty-five feet (25') of the proposed area of vacation, as measured at
28 right angles to the North line thereof, for street light and storm drain

purposes and all appurtenant facilities.
SECTION 5. That the City Engineer of the City of San 8ernard1no
hereby 15 directed to cause Notices of Street Vacation to be posted as
required by the Public Streets, Highways and Services Vacation Law.
SECTION 6. That the City Clerk shall certify to the adoption of
this Resolution of Intention and shall cause the same to be published once a
week for two successive weeks in The Sun, a newspaper published and
circulated in the City of San Bernardino, prior to the date of the above
public hearing.
