This short-term Agreement would allow the PAL Center to occupy a portIon of the Public EnterprIse Center (PEC) upon the approval of a .Condltlona1 Use PermIt. BACKGROUND The PAL Center has approached the Agency requestIng that they be allowed to lease space in the PEC. The PAL Center Is a subsIdIary corporatIon of the ProvIsional EducatIonal ServIces, Inc., whIch is Incorporated under the CalIfornIa Corporations Code as a non-profIt communIty-based educatIonal organization. The PAL Center provIdes an elementary school early-Intervention/dropout preventIon program; a secondary school retentIon program, and a dropout recovery program whIch has been certIfIed by the CalIfornia State Department of EducatIon. AdditIonal servIces include an adult lIteracy program; pre-employment and employment skIll training; job placement; IndIvidualIzed tutorIng; counselIng; a hIgh school dIploma program (through Independent study); and GED preparation. TheIr goal is to IdentIfy hIgh-risk populatIons, particularly those based on the Westslde, and help them complete theIr educatIonal goals, prepare for and obtaIn vIable employment, and become successful, productIve citIzens. It Is antIcIpated that 40-50 students wIll attend the varIous programs. PAL wIshes to enter Into a License Agreement with the Agency. for 5,504 square feet of space. ThIs space is proposed to be leased at $.35 a square foot. Currently, there is 20,314 square feet of net leasable space, of whIch 7,277 square feet is leased at thIs time. The Agency Is In the process of evaluating the long-term dIsposItIon of thIs buIldIng, and as such, staff does not thInk It Is feasIble to enter Into long-term contracts at thIs tIme. Therefore, It Is proposed by the parties that this be a short-term License Agreement whIch will expIre on June 30, 1989. Should the long-term use study determIne that contInued occupancy would be feasIble for the PAL Center, the probable rental rate would be at a rate of approximately $1.10 per square foot plus pass-throughs. The PAL Center Is aware of thIs rate dIfferentIal and Is prepared to pay the hIgher rent after June 30, 1989, if they wish to remaIn In the PEC BuIldIng, and the PEC's long-term use plan will allow uses such as the PAL Center to remaIn. ThIs Agreement Is contIngent upon the PAL Center obtainIng approval of a CondItIonal Use Permit (CUP) from the PlannIng Commission. Should a CUP be denied, this Agreement would be null and voId. WIth the approval of the CommIssion, PAL would be able to occupy the premIses ImmedIately upon notIfIcatIon that theIr CUP has been approved. On February 23, 1989, the Redevelopment Committee recommended that the CommIssion approve the attached LIcense Agreement wIth the PAL Center, subject to the Committee ChaIrperson meetIng wIth and discussing the matter wIth a representatIve of the West SIde Task Force of the Chamber of Commerce. ThIs meeting has taken place and was satIsfactory to all particIpants. The Agreement has been approved as to form and legal content by Agency Counsel and signed by the PAL Center. It Is, therefore, recommended that the CommIssIon approve the attached Real Property LIcense Agreement wIth the PAL Center. f .
