It Is recommended that the Agency Issue an InvItation for bids for the
demolition of the Improvements on the former Roger Harmon Motors dealershIp at
240 South "E" Street In order to remove health and safety liability risks on
the site and to Improve both the value and the appearance of the property.
. BACKGROUND
On AprIl 20, 19B7 the commIssIon authorIzed acquIsItIon of the former Roger
Harmon Motors dealershIp located at 240 South "E" Street. On J\lly 7, 1988 the
Redevelopment Agency receIved an offer from the Slmchowltz CorporatIon
(Slmchowltz) to purchase the property and develop a 40,000 to 47,000 square
foot neIghborhood retaIl center on the property. A l80-day Pre-DIsposItIon
Agreement (attached) between the Redevelopment Agency and Slmchowltz
CorporatIon was entered Into effectIve October 7, 1988. Slmchowltz has just
now requested a 90-day extensIon to the Agreement to fInalIze negotIatIons
whIch, together wIth a buIlt-In 30-day clause dealIng wIth the purchase of
adjacent property wIll extend the Agreement to August 8, 1989. It Is
estImated that subsequent to approval of a DIsposItIon and Development
Agreement, another four to sIx months wIll elapse before tItle can change.
ThIs addItIonal tIme Is requIred to allow the developer to obtaIn all
development entItlements and fInancIng. Therefore development Is not lIkely
to proceed before January of 1990.
In the InterIm, demolItIon of the Improvements on the sIte wIll remove one of
the reuse ImpedIments that must be overcome prIor to development of the sIte.
The cost of the demolItIon wIll go straIght to the bottom lIne of any reuse
analysIs and wIll dIrectly enhance the value of the property by accomplIshIng
the fIrst step In renovatIng the property.
At the same tIme, there are sIgnIfIcant health and safety problems whIch
expose the Agency to potentIal lIabIlIty costs. Staff and the PolIce
Department have found transIents and homeless persons In the vacant structure,
and the BuIldIng and Safety Department has posted the buIldIng as hazardous
(see attached notIce). There Is evIdence that fIres have occurred wIthIn the
buIldIng whIch lacks proper ventIlatIon. SanItatIon problems and other health
hazards are also present. The Agency currently faces substantIal lIabIlIty
exposure In the event a personal Injury occurs on the sIte.
By InItIatIng the demolItIon now, the Agency wIll elImInate the health and
safety hazards from the property, and development of thIs parcel wIll be
brought one step forward.
The cost to demolIsh and clear the property of all debrIs, leavIng the sIte In
a safe and clean condItIon Is estImated between $90,000 and $100,000. A fInal
decIsIon wIll not be requIred untIl a proposed contract Is brought back to the
CommIttee and commIssIon. The CommIttee has revIewed thIs request and
recommends approval. It Is, therefore, requested that the CommIssIon
authorIze staff to Issue an InvItatIon for bIds for the demolItIon work.
