CITY OF SAN BERADlNO - REQUEST .QR COUNCIL ACTION STAFF REPORT Federal-Aid Urban Funds have been allocated by SANGAG to finance approximately 86% of the cost for rehabilitating Waterman Avenue, from Redlands Boulevard to Mill Street. Program Supplement No. 52 will serve to obligate $88,322 in Federal-Aid Urban Funds to finance the costs for preliminary engineering. The local agency funds, in the amount of $12,278, will be provided by the City and County, in proportion to the area of the project under their respective jurisdiction. RESOLUTION OF OF SAN BERNARDINO SUPPLEMENT NO. 52 IMPROVEMENT PROJECTS, CALIFORNIA, ACTING TRANSPORTATION. THE MAYOR AND COMMON COUNCIL OF THE CITY AUTHORIZING THE EXECUTION OF PROG~~ OF LOCAL AGENCY FEDERAL-AID SAFETY BETWEEN SAID CITY AND THE STATE OF BYl'.ND THROUGH ITS DEPARTMENT OF BE IT RESOLVED BY THE MAYOR AND CO~~ON COUNCIL OF THE 6 CITY OF SAN BERNARDINO AS FOLLOWS: 7 SECTION ONE: The Mayor of the City of San Bernardino 8 is hereby authorized to execute, in behalf of said City, 9 Program Supplement No. 52 of Local Agency Federal-Aid Safety 10 Improvement Projects, between said City and the State of 11 California, acting by and through its Department of Trans- 12 portation, a copy of which is attached hereto marked Exhibit 13 "A" and incorporated herein by reference as fully as though 14 set forth at length herein. 15 SECTION TWO: Execution and amendMents. This agreement 16 and any amendments or modifications thereto shall not take 17 effect or become operative until fully signed and executed by 18 the parties and no party shall be obligated hereunder until the 19 time of such full execution. No oral agreements, amendments, 20 modifications or waivers are intended or authorized and shall 21 not be implied from any act or course of conduct of any party. This Program Supplement is adopted in accordance with Paragraph 2 of Article II of the aforementioned Master Agreement under authority of Resolution No. , approved by the Local Agency on (See copy attached). The Local Agency further stipulates that as a condition to payment of funds obligated to this project, it accepts and will comply "with the covenants or remarks set forth on the following pages. M-MG-R035(005) OATE:February 3, 1989 PAGE: 2 SPECIAL COVENANTS OR REMARKS ~ 1. All maintenance, involving the physical condition and the operation of the improvements, referred to in Article VI MAINTENANCE of the aforementioned Master Agreement will be performed by the Local Agency and/or the respective agencies as determined by agreement at regular intervals or as required for efficient operation of the completed improvements. 2. The Local Agency will advertise, award, and administer this project and will obtain the state'. concurrence prior to either award or rejection of the contract. 3. The Local Agency agrees the payment of Federal funds will be limited to the Detail Estimate amounts approved by the Federal Highway Administration in the Federal-Aid Project Agreement (PR-2), or its modification (PR-2A), and accepts any increases in Local Agency Funds as shown on the Finance or Bid Letter or its modification as prepared by the Division of Local Streets and Roads. 4. This program Supplement will be revised at a later date to include other phases of work. 5. In executing this Program Supplemental Agreement, Local AgencI hereby reaffirms the "Nondiscrimination Assurances" conta ned in the aforementioned Master Agreement for Federal-Aid Program. 6. Whenever the local agency uses Federal or State Funds to pay a consultant on a cost plus basis, the local agency is required to submit a post audit report covering the allowability of cost payments for each individual consultant or sub-contractor incurri~ over $25,000 on the project. The audit report must state the applicable cost principles utilized by the auditor in determining allowable costs as referenced in CPR 49, part 18, Subpart C - 22, Allowable Costs.
