Indicate dates when action .Ult be taken. ~\P- IItl llA -- - , - Q S T ~ F R E P 0 R T ( The League of California Cities, In their February 3, 1989 Legislative Bulletin, has brought to our attention the need to strongly oppose Assembly BIII-160 (AB-I60) (Mountjoy). The Agency received the bulletin on February 13, 1989 and given the time constraints Imposed by the Assembly Housing and Community Development Committee It was not possible to submit this Item to the Redevelopment Committee first. In summary, AB-160 would prohibit a redevelopment agency from acquiring any real property without the consent of the owner for any purpose other than publlcly-owned public facilities or Improvements, unless the property constitutes a pUblic nuisance or Is maintained In violation of zoning ordinances, buIldIng or housIng codes, or other health and spfety laws. AB-160 would apply to projects for which a redevelopment plan Is adopted after January I, 1990, or areas added by plan amendment after that date. The bill Is a clear attempt to halt what the author perceives as unwarranted use of emInent domain authority by redevelopment agencies for "private" or commercial-Industrial redevelopment purposes. The effect of AB-160 would be devastatIng on redevelopment agenCies. It Is our understandIng that the author wants to hear thIs legIslation as soon as possible. The first hearing of the Assembly Housing and CommunIty Development CommIttee may be as early as February IS, 1989, but no later than March I, 1989. This legislation, If passed would have a drastIc Impact on our development enticement actlvltes for amended plans In existIng projects as well as new project areas. It Is, therefore, recommended that the CIty/CommissIon formally oppose AB-160 and authorize the Mayor/ChaIrman to ta~e the necessary steps to communicate this oppositIon to the approprIate State officials. ~( ( 1 673R/JLV/mv 02120/87
