Descriotion) Street Vacation Finance: C4J J1 NJ-~ ,-Council Notes: 7o:;.n7F;7 AQenda Item No. )( CITY OF SAN BERNMDINO - REQUEST FbA COUNCIL ACTION ,."'-'" STAFF REPORT - A request was received to vacate a portion of Lugo Avenue, north of 4th Street, from the owner who adjoins both sides of the area proposed for vacation. This request represents 100% of those owners who adjoin the street. The petitioner has deposited the required $200.00, which represents one-half of the total fee of $400.00. The remaining $200.00 will be due after the investigative proceedings. This portion of Lugo Avenue, termintes on the South at 4th Street, and on the north at 5th Street, and appears to have limited public usage, and is primarily used by the adjacent owner. The northerly half of Lugo Avenue would still remain open, allowing access to those owners north of the proposed area. There are some potential problems that exist with this proposal. The vacation of the South half of Lugo Avenue, would make it difficult for emergency and utility vehicles to turn around. This could be remedied by requiring the petitioner to install a cul-de-sac at the northerly portion of the area proposed for vacation. If authorization to proceed with this proposal is granted, it is then recommended that Plan No. 7531 be approved. ~ Affected agencies and City Departments will be notified of the proposed vacation, and allowed an opportunity to provide comments. The area will be posted as required by State law and the Resolution of Intention published. In addition, adjoining residents and property owners will be notified by mail. They will be afforded the opportunity to appear at the public protest hearing and voice any concerns they may have. After responses are received, the applicant will be advised and allowed an opportunity to resolve any identified problems.
