Synopsis of Previous Council action:
The conversion from the self insured John Hancock Health Plan to the PERS
Basic Health Plans was approved by the Mayor and Common Council at their
meeting on November 21, 1988.
Recommended motion:
Adopt resolution.

Government Code Section 22850.3 provides that a contracting agency may
elect upon proper application to participate under the PERS Medical
and Hospital Care Act with respect to recognized employee units. It
has been determined that the elected officials and board members would
not fall into one of the categories of the established bargaining units,
and therefore must be recognized as a separate employee unit for the
purpose of being made eligible for participation in PERS Medical Plans
only. This unit consists of Council members and Water Board Commissoners
only. This office was advised by the PERS Health Benefits Division,
Ms Diana Davies on December 19, 1988, that this resolution is required
to cover this category of annuitants.

RESOLUTION ELECTING TO BE SUBJECT TO PUBLIC EMPLOYEES'
MEDICAL AND HOSPITAL CARE ACT ONLY WITH RESPECT TO PART-TIME
ELECTED OFFICIALS AND BOARD MEMBERS FOR THE CITY OF SAN
BERNARDINO.
WHEREAS, Government Code Section 22850.3 provides that a
contracting agency may elect upon proper application to par-
ticipate under the Public Employees' Medical and Hospital
Care Act with respect to a recognized employee group onlYI
and
WHEREAS,
CITY OF SAN BERNARDINO
, hereinafter
referred to as Public Agency is a local agency contracting
with the Public Employees' Retirement Systeml and
WHEREAS, the Public Agency desires to obtain for the
PART-TIME ELECTED OFFICIALS AND BOARD MEMBERS , who are em-
ployees and annuitants of the agency, the benefit of the Act
and to accept the liabilties and obligations of an employer
under the Act and Regulationsl now, therefore, be it
RESOLVED, that the Public Agency elect, and it does
hereby elect, to be subject to the provsions of the Actl and
be it further
RESOLVED, that the employer's contribution for, each
employee who is a member of, and each annuitant who retired
from employment which would be covered by the above identi-
fied Employee Group enrolled in PERS health benefits plan
shall be as follows:

"Sixteen dollars towards the enrollment of each
employee and annuitant including family members."
And that the contribution shall be in addition to those
amounts contributed by the Public Agency for administrative
fees and to the Contingency Reserve Fund, and be it further
RESOLVED, that the executive body appoint and direct,
and it does hereby appoint and direct, DIRECTOR OF PERSONNEL
to file with the Board of Administration of the Public
Employees' Retirement System a verified copy of this Resolu-
tion, and to perform on behalf of said Public Agency all
functions required of it under the Act and Regulations of the
Board of Administration, and be it further
RESOLVED, that coverage under the Act be effective on
February 1. 1989 .
I HEREBY CERTIFY that the foregoing resolution was duly
adopted by the Mayor and Common Council for the City of San
