CITY OF SAN BERNARDINO - REQUEST FOR COUNCIL ACTION Staff Report Subiect: Resolution awarding contract to All American Asphalt for pavement rehabilitation on Northpark Boulevard between University Parkway and Little Mountain Drive, per Plan No. 10075. Background: The existing pavement at Northpark Boulevard between University Parkway and Little Mountain Drive has deteriorated due to aging and increasing traffic to and from California State University San Bernardino. The last substantive improvement to this section of Northpark Boulevard was performed about 30 years ago. In addition, Northpark Boulevard is experiencing in excess of 14,000 vehicles per day (VPD) due to development in this area and University traffic. Consequently, staff recommended, and the Mayor and Common Council approved, this project as part of the FY 2000/01 Capital Improvement Program (CIP). Plans and specifications for this project are complete and it is ready to be awarded. The project consists of installing pavement rehabilitation including cold milling existing pavement, placing asphalt concrete pavement, painting traffic striping and pavement markings, constructing handicap ramps, and installing roadside signs. The estimated project costs are as follows. Construction Estimate $306,473.80 Contingencies $ 46,000.00 Design, Insnection and Contract Administration $ 47,526.20 TOTAL $400,000.00 This project was advertised locally; the following companies responded (successful bidder is in bold type). RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AWARDING A CONTRACT TO ALL AMERICAN ASPHALT FOR PAVEMENT REHABILITATION ON NORTHPARK BOULEVARD BETWEEN UNIVERSITY PARKWAY AND LITTLE MOUNTAIN DRIVE, PER PLAN NO. 10075. BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: SECTION 1. All American Asphalt is the lowest responsible bidder for pavement rehabilitation on Northpark Boulevard between University Parkway and Little Mountain Drive per Plan No. 10075. A contract is awarded accordingly to said bidder in a total amount of $306,473.80, with a contingency amount of $46,000.00, but such award shall be effective only upon being fully executed by both parties. All other bids, therefore, are hereby rejected. The Mayor is hereby authorized and directed to execute said contract on behalf of the City; a copy of the contract is on fIle in the office of the City Clerk and incorporated herein by reference as fully as though set forth at length. SECTION 2. This contract and any amendment or modifications thereto shall not take effect or become operative until fully signed and executed by the parties and no party shall be obligated hereunder until the time of such full execution. No oral agreements, amendments, modifications or waivers are intended or authorized and shall not be implied from any act or course of conduct of any party. SECTION 3. This resolution is rescinded if the parties to the contract fail to execute it within sixty (60) days of the passage of the resolution.
