HARDGRAVE, Director ~: Public Works /Engineering Ckne: April 24, 1989 Subject: Street Vacation Protest Hearing 10:00 am: Portion of Atlantic Avenue, West of Palm Avenue Synopsis of Previous Council ection: 02/20/89 --- Authorization to proceed was given, and Plan No. 7692 was approved. 04/17/89 --- Resolution of Intention No.89-106 was adopted, which sets a public hearing date of 05/15/89 for the proposed vacation of a portion of Atlantic Avenue, West of Palm Avenue, per attached Plan No. 7692 Recommended motion: 1. That the hearing be closed and the Findings of Fact as set forth in the Staff Report from Roger G. Hardgrave, Director of Public Works/City Engineer as to why that portion of Atlantic Avenue, West of Palm Avenue, is no longer necessary for street purposes, be adopted. J1. West of Palm Avenue. from the State of California. Department of Transportation. which represents 50S of those owners who adjoin the area proposed for vacation. authorization was given on 02- 20-89. to proceed with the proposed vacation and Plan No. 7692 was approved. Utilfty companies and Cfty department were notified of the proposed vacatfon. On 04- 17-89. Resolution of Intention No. 89-106 was adopted. reserving easements for public utilities. That resolution sets a pUblic hearing date of 05-15-89. On 04-26-89. the Resolution of Intention was published in a local newspaper. Notices were posted in the area proposed for vacation. and property owners adjacent to the proposed vacation were notified of said hearing. . There appears to be no further necessity for a portion of Atlantic Avenue. either for present or future street purposes. The entire area of Atlantic Avenue between Palm and O~ange wfll become part of State Highway 30 right-of-way in the near future. Staff recommends the vacation on the basis of the following Findings of Fact: 1. The above portion of the street has been determined by the Department of Public Works to be of no further necessity to the general public: a} Traffic flow will be cut-off when Atlantic Avenue becomes part of the right- Of-way. 2. 100S of the adjoining property owners approve the requested vacation proceedings and the required $400.00 fee has been waived as the primary request was received from a public agency. a} By virtue of the mailing. posting and publication of the proposal. nefther thi s offi ce nor the Cfty Clerk 's offi ce has received any wri tten protests against the vacatfon as of this date. 3. All of the interested City Departments and Utility Companies were notified of the proposal and all have had the opportunity to respond. A reservation of an easement for public utilities was requested. and the same has been provided for in the Resolution of Intention. Staff requests inclusion of the above Agenda item on the 05-15-89 Council Meetfng Agenda. as the Protest Hearing has been scheduled. and all involved parties have been apprised that the hearing will take place at that day and time.
