Letters from the City Attorney and Director of Public Works/City Engineer were reviewed. Consideration was given to vacating the right-of-way to the curb line. This was rejected due to potential problems with pedestrians access, controlling the height of other encroach- ments in the future, and interferences with utility companies' operations. After carefully considering all available options, the Committee adopted a motion, or a 2 to I vote, that the unauth- orized encroachments be removed from the street right-of-ways. At the Legislative Review Committee Meeting of 5-4-89, a recommendation was adopted on a 2 to 0 vote that the parkways be vacated, with utility easements reserved as appropriate. Adoption of the form motion will authorize this process to be started. 5-05-89 75-0264
