STAFF REPORT
A request was recefved by thfs offfce to vacate a portfon of Atlantfc Avenue,
West of Palm Avenue, from the State of Calffornfa, Department of
Transportatfon. Thfs request represents 50S of those owners who. adjofn the
area proposed for vacatfon.
The State has requested thfs vacatfon fn conjunctfonwfth the on-gofng
development of the Crosstown Fr.eeway. The portfon of Atlantfc Avenue, West
of the area proposed for vacatfon, wfll be cut off wfth the extensfon of the
Crosstown Freeway. Safd proposed vacated area wfll be a remnant pfece. Thfs
remnant pfece does not appear to be needed for publfc rfght-of-way. .
On 02-20-89, authorfzatfon was gfven to proceed wfth the proposed vacatfon,
and Plan No. 7692 was approved.
All of the fnterested Cfty Departments and Utflfty Companfes were
notiffed of the proposal on 02-28-89, wfth a reply due by 03-24-89. The
responses are attached for your fnformatfon. Requests for a reservation of
an easement for publfc utflity purposes were recefved whfch wfll have to be
reserved, as set forth fn the attached Resolutfon of Intentfon~
It 15 recommended that favorable consfderation be gfven to the requested
vacatfon. The. Resolutfon of Intentfon, whfch sets a protest date of 05-15-89,
has been attached hereto for your actfon also.
Upon the approval of safd Resolution, all adjacent property owners wfll be
notfffed by mafl of the hearfng date.

RESOLUTI ON NO.
A RESOLUTION OF THE CITY OF SAN BERNARDINO DECLARING ITS INTENTION
TO ORDER THE VACATION OF A PORTION OF ATLANTIC AVENUE, WEST OF PALM AVENUE,
AND RESERVING AN EASEMENT FOR PUBLIC UTILITIES THEREIN.
BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN
BERNARDINO AS FOLLOWS:
SECTION 1. That the Mayor and Common Council of the City of San
Bernardino hereby . declares its intention to order the vacation of a
portion of Atlantic Avenue, West of Palm Avenue, described as follows:
Commencing at the intersection of the centerline of
Atlantic Avenue and Palm Avenue, said point also being
the Corporate City Limit Li ne of the Ci ty of San
Bernardino as it now exists; thence Westerly along said
centerline and said Corporate City Limit Line, a distance
of 52.00 feet, to the True Point of Beginning; thence
continuing Westerly along said centerline and said
Corporate City Limit Line, to its intersection with the
Southerly prolongation of the West line of Lot 6, Tract
No 1745, as per Map recorded in Book 25 of Maps, Page 32,
Records of said County; thence North 58' 4' 50" West to
its intersection with the Westerly prolongation of the
South line of said Lot 6; thence Easterly along said
prolongation and the South line of said Lot 6, to a point
52.00 feet West of the centerline of said Palm Avenue, as
measured at right angles; thence Southerly along a line
parallel to the centerline of Palm Avenue, 20.00 feet to
the True Point of Beginning.
SECTION 2. That the Mayor and Common Council of the City of San
Bernardino,. in vacating the above described portion of said streets, elects
21 to proceed under and in accordance with the provisions' of the "Public
22 Streets, Highways and Services Vacation Law", being ivision 9, Part 3, of
23 the Streets and Highways Code of the State of California.
24 SECTION 3. That the hour of 10:00 A.M. on the 15th day of
25 May, 1989, in the Council Chamber of the City Hall, San Bernardino,
26 California, be, and the same hereby is fixed as the time 'and place when and
27 where all persons interested in or objecting to the proposed vacation may
28 appear before the said Mayor and Common Council and offer evidence in

1 relation thereto. For further particulars as to the proposed vacation of
2 the hereinbefore described portion of said street. reference 15 made to
3 that map marked "Plan No. 7692". approved February 20. 1989. ori file in the
4 office of the City Clerk of said City.
5 SECTION 4. Nothing in th15 Resolution shall in any way affect
6 or d15turb any existing easements for public utility purposes belonging
7 either to the City of San 8ernardino or to any public utility and there
8 15 hereby reserved for future general public utility purposes and for this
9 City an easement reasonably necessary to locate such public utility
10 facilities in. over. under or across the real property hereinabove
11 described and to use. maintain. repair. replace or renew such facilities.
12 SECTION 5. That the City Engineer of the City of San Bernardino
13 hereby 15 directed to cause Notices of Street Vacation to be posted as
14 required by the Public Streets. Highways and Services Vacation Law.
15 SECTION 6. That the City Clerk shall certify to the adoption of
16 this Resolution of Intention and shall cause the same to be pUblished once a
17 week for two successive weeks in The Sun. a newspaper published and
18 circulated in the City of San Bernardino. prior to the date of the above
19 public hearing.
