The type of program that they schedule are artists who would not have otherwise been brought to the City of San Bernardino. The San Bernardino Valley Community Concert Association intends once again to present a season of great classical music and dance to be enjoyed by citizens of all ages, ethnic groups and economic situation. They will present five subscription-paid concerts and two free Youth Concerts during 1991-1992 Season and they are as follows: Ballet British Columbia, Prague Symphony Orchestra, Anna Maria Alberghetti, Soprano, Musical Magic of Harpo Marx, Empire Brass Quintet and two free Youth Concerts for elementary children of city and county. SEPT.30. 1991 i\~ o o SAN BERNARDINO VALLEY COMMUNITY CONCERT ASOCIATION Supplemental Page I ARTICLE IV Period of Support This grant request is to cover the 1991-1992 fiscal year which will be the 53rd year the Concert Association has been in existence. The program for this season was approved by the Board of Directors in November, 1990. A fund raiser Yard Sale was held in February, 1991. The Membership Drive began in April and is continuing. Our first concert of the season will be offered October 21, 1991 and the following four in November, 1991, January of 1992, March, 1992 and April 1992. The Youth Concerts will be offered again at the end of the school year--either Mayor June, 1992. o o SAN BERNARDINO VALLEY COMMUNITY CONCERT ASSOCIATION Supplemental Page 2 ARTICLE V Summary of CateRorv Description The SAN BERNARDINO VALLEY COMMUNITY CONCERT ASSOCIATION will present five subscription-paid concerts and two free Youth Concerts during our 1991-1992 season. Two free Youth Concerts for elementary children of city and county Spring, 1992 (date not yet set) Our memberships (tickets) are sold by season only and range from $25.00 to $60.00 for the season depending on location in the California Theatre of Performing Arts. Our sales of memberships at this date stand at about 1400 with hopes of reaching 1500 before the season starts. Income from memberships will be approximately $60,000 and attendance for the five regular concerts should average 1500 persons. Free tickets are provided to Senior Citizens, visually handicapped and students. Attendance at the two free Youth Concerts will be 3,400 students. o o Supplemental Page 3 SAN BERNARDINO VALLEY COMMUNITY CONCERT ASSOCIATION ARTICLE VI. Estimated number of persons expected to benefit from pro;ect. A. Approximately 1500 will pay to see each of the five scheduled concerts. B. Approximately 100 Senior Citizens, Handicapped persons and Students will be admitted free to each of the five concerts. C. Approximately 3400 elementary school students of city and county will be admitted free of charge to the Youth Concerts. ARTICLE VII Needs Statement The SAN BERNARDINO VALLEY COMMUNITY CONCERT ASSOCIATION is the oldest continuing performing arts association in the Valley and is the only one in the Inland Empire presenting world and nationally recognized professional musical artists and dance groups in concert on a regular basis. Such programs lift the cultural level of the area. It also satisfies the need of people to see and hear the very best performers of the world without traveling to Los Angeles to do it. With" our Youth Concerts we introduce young people to the uplifting spirit of the performing arts. The C9ncert Association is a great community asset which business and community leaders can point to with pride when trying to sell our city to new businesses to this area. Our programs appeal to all segments of society, ethnic groups and economic levels who enjoy the very best in live classical music and dance. Membership prices are so modest that even those people on Social Security incomes find it possible to attend. o o Supplemental page 4 SAN BERNARDINO VALLEY COMMUNITY CONCERT ASSOCIATION ARTICLE VIII Intended Results The SAN BERNARDINO VALLEY COMMUNITY CONCERT ASSOCIATION intends to once again present a season of great classical music and dance to be enjoyed by citizens of all ages, ethnic groups and economic situations. With our Youth concerts we hope to educate youngsters to classical music and urge their performance in the performing arts. We feel our programs uplift the image of our City by fulfilling the need for such programs right here where they are available to people of the Inland Empire. Our concerts are presented in the California Theater which seats 1760 people. We have high hopes of filling most of those seats this season with our varied program of national and international artists. We hope to sell 1500 memberships. Free tickets will be given to Senior Citizens, Lighthouse for the Blind members, enlisted military personnel and students in area high schools, colleges and private dance schools. The two Youth Concerts are performed free to elementary school students throughout the city and county. GUTH R I E September 29, 1991 Members of the Fine Arts Commission City of San Bernardino City Hall San Bernardino, CAlifornia 92401 Dear Commission Members: In my opinion, the contribution by the San Bernardino Valley Community Concert Association to the cultural life and growth of the entire San Bernardino area is and has been of inestimable value. We in the Inland Empire are provided each year with really unusual opportunites to hear performances by the greatest musical artists of our time solely through the efforts of the Association-- and at admission prices far below those in other areas. The quality of our community life is vastly enriched thereby. The Association's efforts to bring an understanding of and an appreciation for good music to our Youth through its long-standing program in the public schools is another very important reason for providing as much community and governmental support to its efforts as possible. With the musical wasteland created in our city by the near- sighted policies of our public schools, the activities of the San Bernardino Valley Concert Association have become even more vital and deserving of encouragement and backing. s ft.. RESOLUTION OF THE CITY OF SAN BERNARDINO AUTHORIZING THE EXECUTION OF AN AGREEMENT WITH THE SAN BERNARDINO VALLEY COMMUNITY CONCERT ASSOCIATION OF SOUTHERN CALIFORNIA FOR THE PROMOTION OF ARTS AND CULTURE. BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: SECTION 1. The Mayor of the city of San Bernardino is hereby authorized and directed to execute on behalf of said City an Agreement with the San Bernardino Valley Community Concert Association a copy of which is attached hereto, marked Exhibit "A" and incorporated herein by reference as fully as though set forth at length. SECTION 2. The parties agree as follows: 1. Recitals. A. organization has requested financial assistance from city for the fiscal year 1991-92, in order to assist in defraying the expense of certain concerts, shows, festivals or events or activities sponsored by Organization as set forth in Organization I s grant proposal (hereinafter "the proposal") approved by the Fine Arts Commission of the City, a copy of which proposal is on file in the Office of CUltural Affairs. The terms of the proposal are incorporated herein by reference and shall govern the uses of the funds provided herein. The financial assistance provided for in this agreement is made on a one-time only basis, and receipt of said funds shall not imply a continuing obligation of the City beyond the terms of this Agreement. B. The expenditure is for a valid municipal public purpose, to wit: for the promotion of art appreciation in San Bernardino, as more fully set forth in the proposal submitted by Organization. 2. PaYment. Upon presentation of a claim to the City 1 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 o o Finance Director, City shall pay to Organization from the budget for the 1991-92 fiscal year, the total sum of twenty thousand dollars, to cover the costs per the Fine Arts grant application agreement. 3. Use of Funds. The funds paid to Organization shall be used solely for the purposes set forth in Paragraph 1 and in strict compliance with the provisions set forth in the proposal. No deviation from the proposal shall be made without the express approval of the City of San Bernardino. Said funds shall be expended by June 30, 1992, and any unexpended funds shall be returned to City by Organization. 4. Accountinq. At such time or times as may be requested by the City Administrator or Director of Finance of City, Organization shall submit to the City Administrator, with a copy to the Director of Finance and the San Bernardino Fine Arts Commission, an accounting of the proposed and actual expenditures of all revenues accruing to the Organization for the fiscal year ending June 30, 1992. Financial records shall be maintained in accordance with generally accepted accounting principles by Organization in such a manner as to permit City to easily trace the expenditures of the funds. All books and records of Organization are to be kept open for inspection at any time during the business day by the City or its officers or agents. 5. Hold Harmless. Organization covenants and agrees to defend, indemnify, and hold harmless the city and its 2 . 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 o o employees and agents from all liabilities and charges, expenses (including counsel fees), suits or losses however occurring, or damages arising or growing out of the use or receipt of the funds paid hereunder and all operations under this agreement. Payments hereunder are made with the understanding that the City is not involved in the performance of services or other activities of Organization. Organization and its employees and agents are independent contractors and are not employees or agents of the City in performing said services. 6. Termination. City shall have the right to terminate this Agreement and any funding remaining unpaid hereunder for any reason by mailing a ten-day written notice to Organization and this agreement shall terminate ten days after the mailing of such notice. In the event this Agreement is terminated for reasons of improper use of funds or use of funds for any purpose other than those authorized, any unexpended portion of the funds provided by city shall be returned to city. In addition, Organization shall reimburse to city any funds expended which were used for any purposes other than those authorized under this Agreement. 7. Assianment. Organization shall not assign its interest in this Agreement without the prior written approval of city. 8. Insurance. maintain during the Organization shall take out and life of this Agreement such public 3 , 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 o o liability and property damage insurance as shall insure City, its elective and appointive boards, commissions, officers, agents and employees, permittee and its agents performing acts covered by this Agreement from claims for damages for personal injury, including death, as well as from claims for property damage which may arise from Organization's or its agents' operations hereunder, whether such operations be by Organization or its agents or by anyone directly or indirectly employed by either Organization or its agents, and the amounts of such insurance shall be as follows: (a) Public Liability Insurance. In an amount not less than $100,000 for injuries, including, but not limited to, death, to anyone person, and subject to the same limit for each person, in an amount not less than $100,000 on account of anyone occurrence: (b) Property Damage Insurance. In an amount of not less than $50,000 for damage to the property of each person on account of anyone occurrence. (c) Workers Compensation. Organization shall provide workers compensation insurance in the amount required by state law if the funds provided hereunder are to be paid as salary to any employee of organization. Organization shall require that all rights of subrogation under such policy of workers compensation insurance shall be waived as to City. Obliaation. Organization hereby covenants that it has taken all actions necessary to make the adherence to the obligations imposed by this agreement a binding obligation of the organization. 10. Notices. In the event of conflict between the terms, conditions or provisions of this Agreement, and any such document or instrument, the terms and conditions of this Agreement shall prevail. 12. Non-Discrimination. Organization agrees that for the term of this Agreement it shall not discriminate in employment, recruitment, hiring, admission practices, advertising or in any other manner on the basis of race, color, creed, religion, national origin, sex, physical handicap, or marital status.
