DESIGNATING AGENCY CHECK SIGNERS AND APPOINTING
THE SECRETARY OF THE COMMISSION
BACKGROUND:
On November 6, 2006, the Community Development Commission of the City of San Bernardino
("Commission") adopted a Resolution designating Mayor Patrick J. Morris, who serves as the
Chairperson of the Commission, as the primary signatory on all Agency checks and wire transfers, and
designated Commission Member Esther Estrada as an alternate signatory to Chairperson Morris. At
the same time, the Commission also designated Margarita Pacheco, Agency Executive Director, as the
second signatory on Agency checks and wire transferS, and designated Don Gee, Agency Deputy
Director, as the alternate second signatory to Ms. Pacheco. The Commission also adopted a Resolution
appointing Margarita Pacheco as Secretary of the Commission and Don Gee as Assistant Secretary of
the Commission.
CURRENT ISSUE:
Now, due to the retirement of the Agency's Executive Director and the appointment of Emil A.
Marzullo as the Agency's Interim Executive Director, it is desired to amend the designation of the
Agency's check and wire transfer signatories and to amend the appointment of the Secretary of the
Commission. The designations of Chairperson Morris as primary signatory on all Agency checks and
wire transfers, and Commission Mernber Esther Estrada as the alternate signatory to the Chairperson,
shall remain unchanged. Margarita Pacheco will be replaced by Emil A. Marzullo as secondary
signatory required on all Agency checks and wire transfers, and as Secretary of the Commission. Don
Gee, Deputy Director, will remain as the designated alternate secondary signatory and as Assistant
Secretary of the Commission. The primary alternate and the secondary alternate signatories are only
used in the absence of the Chairperson and/or the Agency's Interim Executive Director.
ENVIRONMENTAL IMPACT:
None.
FISCAL IMPACT:
None.
RECOMMENDATION:
That the Community Development Commission adopt the attached Resolutions.

RESOLUTION OF THE COMMUNITY DEVELOPMENT COMMISSION
OF THE CITY OF SAN BERNARDINO, CALIFORNIA, DESIGNATING
CHECK SIGNERS AND COUNTERSIGNERS FOR THE

AND/OR THE CITY OF SAN BERNARDINO ECONOMIC
DEVELOPMENT AGENCY CHECKS AND WIRE TRANSFERS, AND
REPEALING RESOLUTION NO. CDC/2006-46
WHEREAS, Resolution No. CDC/2006-46 was adopted on November 6, 2006, designated
that the Redevelopment Agency of the City of San Bernardino and/or the City of San Bemardino
Economic Development Agency ("Agency") checks and wire transfers will be signed by
Chairperson Patrick J. Morris, who serves as Chairperson of the Commwrity Development
Commission of the City of San Bernardino ("Commission"), or by Commission Member Esther
Estrada, who will only sign in the absence of the Chairperson; and
WHEREAS, Resolution No. CDC/2006-46 further designated that Agency checks and wire
transfers will be countersigned by Margarita Pacheco, Executive Director of the Agency, or by Don
Gee, Deputy Director of the Agency, who will only sign in the absence of the Executive Director 0

17 WHEREAS, due to the retirement of Margarita Pacheco, Executive Director of the Agency,
18 and the appointment of Emil A. Marzullo as Interim Executive Director of the Agency, the
19 Commission now desires to provide for a different signer for Agency checks and wire transfers.
20 NOW, TIlEREFORE, TIlE COMMUNITY DEVELOPMENT COMMISSION OF TIlE CITY .
21 OF SAN BERNARDINO DOES HEREBY RESOLVE, DETERMINE AND ORDER, AS FOLLOWS:

Section 1.
All checks and wire transfers of the Agency shall be signed by Commission
23 Chairperson Patrick J. Morris, or by Commission Member Esther Estrada, in the absence of the
24 Chairperson.

Section 2.
All Agency checks and wire transfers shall be countersigned by the Interim
26 Executive Director of the Agency, Emil A Marzullo, or by Don Gee, Deputy Director of the
Agency, in the absence of the Interim Executive Director of the Agency.

Section 3.
Resolution No. CDC/2006-46 is hereby repealed and this Resolution shall
2 take effect upon the date of its adoption.

THE APPOINTMENT OF EMIL A. MARZULLO AS SECRETARY OF
THE COMMISSION AND AUTHORIZING THE RECONFIRMATION OF
DON GEE AS ASSISTANT SECRETARY OF THE COMMISSION, AND
REPEALING RESOLUTION NO. CDC12006-47
7 WHEREAS, Resolution No. CDC/2006-47 was adopted on November 6, 2006, appointed
8 Margarita Pacheco, Executive Director of the Redevelopment Agency of the City of San Bernardino
9 and/or the City of San Bernardino Economic Development Agency ("Agency"), as Secretary of the
10 Community Development Commission of the City of San Bernardino ("Commission"), and Don
11 Gee, Deputy Director of the Agency, as Assistant Secretary of the Commission; and
12 WHEREAS, due to the retirement of Margarita Pacheco, Executive Director of the Agency,
13 and the appointment of Emil A. Marzullo as Interim Executive Director of the Agency, it is
recommended that Margarita Pacheco be replaced by Emil A. Marzullo as Secretary of the
Commission and that Don Gee, Deputy Director of the Agency, be reconfirmed as Assistant
16 Secretary of the Commission.
17 NOW, THEREFORE, THE COMMUNITY DEVELOPMENT COMMISSION OF THE
18 CITY OF SAN BERNARDINO DOES HEREBY RESOLVE, DETERMINE AND ORDER, AS
19 FOLLOWS:

Section 1.
Emil A. Marzullo, Interim Executive Director of the Agency, is hereby
21 appointed as Secretary of the Commission, and in such capacity may sign on behalf of the
22 Commission, all official documents of the Commission as approved by the Commission.

Section 2.
Don Gee, Deputy Director of the Agency, is hereby reconfirmed as Assistant
24 Secretary of the Commission, and in such capacity may sign on behalf of the Commission, all
25 official documents of the Commission as approved by the Commission, in the absence of, or as
26 otherwise authorized by the Secretary.
Section 3.
Resolution No. CDC/2006-47 is hereby repealed and this Resolution shall
take effect upon the date ofits adoption.
