8/5/02 - The Mayor and Common Council voted to refer the matter back to the Bureau of Franchises to
determine whether the current holder of the permit shall be allowed to increase the number of vehicles in
the same proportions that the total increase bears to the number of such vehicles theretofore operated by
the holder; or to grant the permit to the applicant.
8/5/02 - The Mayor and Common Council voted that the existing ordinance concerning taxicabs (MC
5.76) be referred back to the Legislative Review Committee for review.
9/9102 - The Mayor and Common Council adopted Resolution No. 2002-295 adopting findings in support
of the Council's decision to overturn the Bureau of Franchises' denial of the Petition for a Franchise
Permit for AM Inland Empire Cab Company.
Recommended Motion:
Motion #1: That the hearing be closed, and the Mayor and Common Council uphold the Bureau of
Franchises decision to grant BelllYellow Cab a permit to operate an additional 25 taxicabs in the City of
San Bernardino and that the Bureau of Franchises shall review their decision in 6 months.

Motion #2: That the hearing be closed, and the Mayor and Common Council grant the appeal for

Background:
A Petition for Franchise Permit for AAA Inland Empire Cab was previously denied by
the Bureau of Franchises and a letter sent dated January 10, 2002 to the owners of AAA
Inland Empire Cab notifying them ofthat fact. AAA Inland Empire Cab did not file an
appeal of the decision but elected to re-submit their application based upon new
information. On April 3, 2002, a new application fee was paid by AAA Inland Empire
Cab.
June 11,2002 - The Bureau of Franchises considered the new application submitted by
AAA Inland Empire Cab. A Motion to deny the Petition for Franchise Permit for AAA
Inland Empire Cab carried on a 4-2 vote. Board Members Cole, Tumer, Shultz and
Carson voted in favor of the motion to deny; Members Fernandez and Martindale voted
against the motion.
August 5, 2002 - The Mayor and Common Council voted to overturn the Bureau of
Franchises' denial of a Petition for Franchise Permit for AAA Inland Empire Cab. In
addition, the Council voted to refer the matter back to the Bureau of Franchises for the
determination, pursuant to San Bernardino Municipal Code Section 5.76.060(A), as to
whether Bell CabNellow Cab should receive an increase of25 taxicabs or whether AAA
Inland Empire Cab Company should be granted a permit for the 25 taxicabs it has
requested. Also, the Council voted that the existing ordinance concerning taxicabs be
referred back to the legislative Review Committee for review.
September 9, 2002 - The Mayor and Common Council adopted Resolution No. 2002-295
adopting findings in support of the Council's decision to overturn the Bureau of
Franchises' denial ofthe Petition for a Franchise Permit for AAA Inland Empire Cab
Company.
September 10, 2002 - The Bureau of Franchises heard presentations by both AAA Inland
Empire Cab and BelIN ellow Cab and discussed the matter at length. A motion was first
made to grant the additional 25 taxicabs to AAA Inland Empire Cab Co. This motion
failed on a 3-3-tie vote. Members in favor: Fernandez, Martindale and Cole. Members
opposed: Turner, Enciso and Carson. The Bureau then determined that BelllY ellow Cab
should receive an increase of25 taxicabs. A motion was made to grant the additional 25
taxicabs to BelllY ellow Cab and with that approval BelllY ellow Cab will be required to
address the following service levels:
1. 10-15 minute response time
2. Handicap accessible vans
3. Uniformed drivers
4. Cab stands in the City of San Bernardino
5. Child safety seats
6. All drivers licensed
In addition, they will be required to post a complaint process in each vehicle for customer
complaints. The Board will review the decision in 6 months. The motion carried by a
vote of 4 to 2. Members in favor: Fernandez, Turner, Enciso and Carson. Members
opposed: Martindale and Cole.

September 24, 2002 - Appeal received from AAA Inland Empire Cab Company.

FOR THE CITY OF SAN BERNARDINO
REGULAR MEETING
SEPTEMBER 10, 2002
The regular meeting of the Bureau of Franchises was called to order by Chairman
Dennis Cole at 2:00 p.m., Tuesday, September 10, 2002 in the Management Information
Conference Room located on the 6th floor of City Hall, 300 North "D" Street, San
Bernardino.
Roll Call
Chairman Cole took roll call with the following being present: Board Members
Turner, Carson, Martindale, Fernandez, Encisco and Secretary Cindy Buechter. Also

Public Comments
Chairman Cole asked for public comments on items not on the agenda. No public
comments were made.
Approval of Minutes
Board Member Turner made a motion seconded by Board Member Encisco and
unanimously carried that the minutes ofthe Bureau of Franchises meeting of June II,
2002 be approved as submitted in their type written form.
Old Business
Chairman Cole read into the record the issue that is now before the Board:
Review action taken by the Mayor and Common Council at their meeting of August 5,
2002 and September 9, 2002 regarding the appeal of AAA Inland Empire Cab Co.
Determination pursuant to San Bernardino Municipal Code Section 5.76.060(A), as to
whether Bell Cab/Y ellow Cab should receive an increase of 25 taxicabs or whether AAA
Inland Empire Cab Company should be granted a permit for the 25 taxicabs it has
requested.
Chairman Cole opened discussion by stating that there were representatives
present from each company who would be making a presentation. Chairman Cole
indicated it was the Boards task to act upon the City Council's referral back to the
Bureau. Mr. Empeno distributed copies of Resolution No. 2002-295 which the Mayor
and Council had approved unanimously, without any changes, at their meeting of
September 9,2002. In addition, Mr. Empeno distributed copies ofletters received from
Mark Edwards, Attorney for AAA Inland Empire Cab Co. and Craig Wilson, associate of
Wilfred Lemann, Attorney for Bell Cab/Y ellow Cab. Mr. Empeno indicated that these
letters stated that both law firms had reviewed the draft copy of Resolution No. 2002-295
provided by Mr. Empeno's office and they had no changes or objections to the
Resolution as drafted. Mr. Empeno also distributed copies ofSBMC Section 5.76.060
dealing with taxicab permits.
Chairman Cole asked AAA Inland Empire Cab to make their presentation. Peter
Withers, Vice-President of AAA Inland Empire Cab stated that AAA Inland Empire Cab
had recently gone through a similar process in the cities of Riverside and Redlands and
that they had been awarded the right to operate a minimum of 25 vehicles in Riverside
and 10 vehicles in Redlands. Mr. Withers stated that the San Bernardino City Council, as
evidenced by Resolution 2002-295, ".. .has recognized that there is indeed a proven need
and a strong demand for a competitive choice of taxicab provider. This recognition
similarly was echoed and supported in the editorial columns of both daily newspapers."
Mr. Withers gave examples of"...the way in which the San Bernardino community is
already reaching out to us and seeking our active participation in the City." Mr. Withers
requested that the Bureau grant the 25 vehicles they have requested.
Mr. Edwards, Attorney for AAA Inland Empire Cab, continued AAA's
presentation. Mr. Edwards reviewed past action by the Mayor and Common Council at
their meeting of August 5, 2002. Mr. Edwards stated that it was made clear in the
Resolution and the evidence that was presented that the City found that the current
provider of taxicab service, Bell Cab/Y ellow Cab, was failing in the promises it made to
the City. Mr. Edwards listed these failures as not having the legal ability to put the
number of cabs on the street for which it was already franchised, no service available for
those with children, no service available for the handicapped, and business people staying
at hotels could not get adequate taxi service. Mr. Edwards cited two letters brought forth
at the Mayor and Common Council meeting of August 5, 2002 from representatives of
the Hilton Hotel and LaQuinta Hotel testifying that their guests frequently were left
without taxicab service or service that was delayed.
Mr. Edwards indicated that they had reviewed the September 8, 1998 hearing of
the Bureau of Franchises when Bell Cab was awarded its franchise. Mr. Edwards
indicated that at this hearing Bell Cab had made several promises and that these promises
had been broken. Mr. Edwards then reviewed the promises that he states have not been
kept by Bell Cab/Y ellow Cab; they are summarized as follows:
. 10-15 minute response times
. 6 handicap accessible taxi vans
. All drivers in uniform
. Establish new "taxi stands" in the City of San Bernardino
. All taxis have a child safety seat on board
. More taxicabs available

Mr. Edwards went on to state that these promises were not kept by Bell Cab as they
bought out Yellow Cab, leaving a sole operator and the same lack of competition which
has allowed them to break these promises.
Mr. Edwards then referred to the Resolution 2002-295 and stated, "the City of
San Bernardino Council, in granting our appeal, found that the current taxi service is
inadequate." Mr. Edwards requested that the Bureau grant the available taxicabs to AAA
Inland Empire Cab.
Chairman Cole called for questions regarding AAA's presentation. Board
Member Carson questioned why the businesses had never complained to the City before.
Mr. Edwards responded that there is no indication in BelIN ellow taxis as to how to
complain to the City, there is only reference to BellNellow Cab's phone number. Mr.
Carson responded that customers generally will complain to the business owner and then
they in turn should be the one complaining to the City. Board Member Martindale
brought to member Carson's attention the two letters presented in the back-up provided
by AAA Inland Empire Cab from the Hilton Hotel dated August 2, 2002 and from
LaQuinta Inn dated September 4, 2002 stating their complaints.
Board Member Martindale read a prepared statement indicating that she" had
heard both sides and I have reviewed documentation that has led me to conclude that the
City of San Bernardino needs to have a choice regarding their transportation.. .hearing the
need, I am asking the fellow members to reconsider and allow AAA Inland Empire Cab
Co. to provide choice and fill the gap of our citizens need for the extra 25."
Chairman Cole requested BelIN ellow Cab make their presentation. Rusty
Deaton, Marketing Director for BellNellow Cab, to give overview of BeliN ell ow Cab's
service plans, opened the presentation. Ms. Deaton indicates that BellNellow Cab now
does a drunk driving campaign with the Anheisur-Bush company where they provide
free taxi service and subsidized taxi service during all major holidays. Ms. Deaton also
indicated that they participate in MADD (Mothers Against Drunk Driving). Ms. Deaton
stated that she had addressed the service issues brought forth by AAA and that she had
spoken to the hotels. Ms. Deaton indicated she had proposed a shuttle service to both
hotels. Ms. Deaton also covered the legalities regarding the number of individuals a
sedan vehicle can carry. Ms. Deaton covered the issue regarding child seats and the laws
that have changed regarding the weight of the child for the seat and the capacity the seat
can support. Ms. Deaton stated that "typically parents are given guidelines that they
provide their own car seats. We do have a few that are available." Ms. Deaton further
explained that in regards to the handicapped vehicles, BelIN ellow does have 5 vehicles
and they ask for reservations. Ms. Deaton indicated the reasons for the reservations are
that the vehicles are always busy, but that more vehicles could be added. Ms. Deaton
stated that the drivers for the handicapped vehicles go through a 6-12 hour training
program and she questioned whether AAA's drivers have the same training.
Ms. Deaton then referred to copies of photos submitted to the Board showing
AAA's taxi yard located at 359 E. Front Street, Covina. Ms. Deaton pointed out that the
photos showed a yard overgrown with weeds and inoperable vehicles. Mr. Edwards,

Attorney for AAA Inland Empire Cab, inteljected that this was not AAA Inland Empire's
yard, that their yard was located in Riverside. Chairman Cole asked for clarification from
both parties. Ms. Deaton stated that the commonality between the yard in Covina and the
Riverside yard was that one of AAA Inland Empire Cab's owners was the owner of the
Covina operation. Mr. Edwards then indicated that AAA Inland Empire Cab's yard was
located on Date Street in Riverside. It was concluded that the owner of the Covina yard
owns a 25% interest in AAA Inland Empire Cab Co.
Ms. Deaton continued with the issue of response time by AAA Inland Empire
Cab. Ms. Deaton stated that they called for a driver from the Metrolink in Rialto and the
response time was 34 minutes. Ms. Deaton also provided as evidence, letters from
individuals indicating their long wait times after calling AAA for pick up from locations
within the City of San Bernardino. Ms. Deaton further stated that "No one in this world
can guarantee on time service every single time.. .because each operation has difficulties,
and pluses and minuses."
Scott Schaffer, representing BellN ellow Cab, continued the presentation. Mr.
Schaffer indicated BellN ellow Cab is requesting the 25 additional taxi cabs. Mr.
Schaffer indicated that BellN ellow Cab is proposing to add "clean fuel" cabs such as
those they are providing in their other operations in the Los Angeles basin. In addition,
they will be adding two London type cabs that should be available in December.
Mr. Schaffer proceeded to address issues brought forth by the Board and Mr.
Edwards, Attorney for AAA Inland Empire Cab. Mr. Schaffer stated that when Bell Cab
was awarded their permit in 1998 that "...those were clearly much different economic
times and the situation was clearly much different because of the Onmitrans Dial-A-Cab
program.. .". Mr. Schaffer referred to the issue of response times, stating the issues
".. .are not reflective of the service in an overall picture. They are a snapshot in time of
problems that we've had.. . and what we've done is respond to those issues." Mr.
Schaffer indicated that they are willing to provide more cabs to see if this helps improve
service. However, Mr. Schaffer indicated his concerns on flooding the market and the
driver's ability to make a reasonable amount of money. In reference to the handicap
issue, Mr. Schaffer indicated that". . . we try to encourage reservations to make sure that
the service is there. We have not had as much demand as was indicated at the public
hearing both at the Franchise Board and the Council for wheelchair taxicab service." Mr.
Schaffer went on to indicate that there are many other services available to the handicap
such as Omnitrans and Health Link. In reference to the uniform issue, Mr. Schaffer
stated that both companies have independent contractors and that the drivers can not be
forced to wear uniforms unless they are employees.
Mr. Schaffer referred to the Councils direction for the Legislative Review
Committee to review the current Ordinance. Mr. Schaffer stated ".. . maybe there should
be set and specific standards about the service levels..." Mr. Schaffer stated that the
Board has the ability at any time to look at their records to review the service provided by
BellNellow Cab.
With regards to the child safety seat issue, Mr. Schaffer indicates that the program
has not been successful having the seats in every vehicle due to the problem with space
and luggage. Mr. Schaffer stated "State law does not place the burden on the cab
operator. . . but the burden is on the parents." Mr. Schaffer also indicated the difficulty
with providing the correct seat for the weight of the child. Mr. Schaffer responded to the

< cab stand issues by stating that 95% of the business is telephonic and that cab stands have
no relationship to the demand and market in San Bernardino.
Mr. Schaffer concluded by stating that they are willing to do what the Council has
asked and he further requested that a Franchise Board member attend the Legislative
Review Committee meeting regarding changes to the current Ordinance to make
recommendations.
Board Member Turner questioned what the liability would be should a car seat
provided by the cab company fail in an accident and if it would create substantial liability
for the cab company? Mr. Schaffer responded that scenario probably would create a
liability problem but that was never the reason why the car seat program did or did not
work.
Wilfrid Lemann, Attorney for BellNellow Cab referred to SBMC 5.76.050 which
sets forth the standards that the Bureau must take its responsibility. Mr. Lemann stated
that" . . . the real issue here for the Franchise Bureau and I think the real service you can
give to the City of San Bernardino and its residents, is to establish standards." Mr.
Lemann further stated "That the testimony that we really received up till now has been in
the nature of hearsay." Mr. Lemann indicated that they hoped the Bureau would award
the additional cabs to BellN ellow Cab and work closely with them to monitor the service
being provided.
Boardmember Carson asked why the question keeps arising regarding the number
of active cabs. Mr. Zadurian, representing BelIN ellow Cab, responded stating, .. We
have a total of 45 cabs in San Bernardino. A minimum of35 of them are on the road ..."
Mr. Zadurian indicated that BelIN ellow Cab receives an average of 600-700 calls in 24
hours for the City of San Bernardino. Further discussion ensued regarding the number of
licensed taxi drivers and the discrepancy between the number holding an active business
license, those cleared by the Police Department, and those driving for BelIN ellow Cab.
Deputy City Attorney Henry Empeno referred the Board to SBMC Section 5.76.280
regarding licensed drivers. Chairman Cole summarized that BellNellow Cab does not
have 35 or 45 licensed drivers for the 35 or 45 cabs that are in service. Chairman Cole
further stated that due to the current process, this number could fluctuate and cause a
deficiency in the number of current licensed drivers.
Attorney Mark Edwards and Mr. Withers of AAA Inland Empire Cab and Scott
Schaffer and Attorney Bill Lemann representing BeliN ellow Cab, summarized their
positions regarding the issuance of the 25 additional taxi cabs to be awarded by the
Bureau of Franchises.
Chairman Cole asked for comments from the public regarding the issue before the
Board. John Anaya Sr., advocate for Americans with Disabilities, spoke in regards to
transportation for the disabled and seniors. Mr. Anaya asked how many complaints are
received by BellN ellow Cab from the disabled community. Ms. Deaton responded that,
on average, a few complaints are received each month. Further discussion ensued
regarding complaints from the disabled community and how they were handled by
BellNellow Cab.
Chairman Cole stated that at the Council meeting, AAA Inland Empire Cab
proposed a reduced rate and questioned if that rate is in place should AAA be awarded
the 25 vehicles. Mr. Edwards responded in the affirmative. Chairman Cole asked if
AAA is making a commitment to the City that this rate will be in effect for a specific

time period. Mr. Withers indicated that it would be for a minimum of90 days. Chairman
Cole asked AM Cab what their commitment to the City would be on the six points
previously raised regarding service. Mr. Edwards, Attorney for AM Cab responded
they would:
. Strive for 10-15 minute response times
. Child safety seats
. Handicapped vans to pick up "on-call"
. Drivers in uniform
. 25 licensed drivers
. Apply for cab-stand in the Hospitality Lane area
Chairman Cole asked AAA Inland Empire Cab what mechanism they have in
their taxicabs for customers who have a complaint. Mr. Withers responded there is a 4X6
card mounted on the dashboard of the vehicle indicating a number for the taxi company,
Police Department and the City Council Office. In addition, Chairman Cole asked for the
number of handicapped vans they would have available. Mr. Withers responded that
AM Cab has six handicapped vehicles and two I a-seat buses capable of accommodating
two wheelchairs. In addition, 3 vans have recently been purchased and are being re-
furbished.
Chairman Cole indicated that he had read in the newspaper and heard comments
at the City Council meeting that there has been an offer of one company to buy another.
Chairman Cole asked both parties to respond. Mr. Edwards, Attorney for AAA Inland
Empire Cab, responded in the negative to Chairman Cole's question. Mr. Schaffer,
BelllY ellow Cab indicated that he had been approached by "one of the principles".
Mr. Lemarm, attorney for BelllY ellow Cab requested clarification from Deputy
City Attorney Empeno as to whether the Bureau is authorized under the Ordinance to
license non-ambulatory vehicles. Mr. Empeno responded that wheelchair vehicles are
provided for in the Ordinance and they would be considered non-emergency medical
transport vehicles and that a Franchise could be obtained separate from a taxicab
Franchise. Discussion also ensued regarding the taxi cab rates established by Ordinance.
Chairman Cole called for a motion by the Board. Board Member Martindale
made a motion seconded by Board Member Fernandez, that AM Inland Empire Cab
Company be granted a permit to operate 25 taxicabs in the City of San Bernardino. Vote
was taken with Board Members Turner, Enciso and Carson voting against and Board
Members Fernandez and Martindale voting in favor. Mr. Empeno reminded Chairman
Cole that he has a vote. Chairman Cole asked Mr. Empeno for clarification in the
instance of a tie vote. Mr. Empeno indicated that a tie vote would indicate the motion
would not carry and further discussion would be required by the Board to see if an
alternative motion could be passed. Chairman Cole then indicated he votes in favor of
the motion resulting in a 3-3-tie vote.
Discussion ensued and Board Member Carson made a motion to allow
BelllYellow Cab to have the additional 25 taxicabs. Board Member Encisco, with a
stipulation that BelllY ellow Cab have a definite time to correct all the items that were
previously discussed, seconded the motion. Mr. Carson re-stated his motion to approve
BelllY ellow Cab to have the additional 25 taxicabs and with that approval BelllY ellow
Cab will be required to address the following service levels:
1. 10-15 minute response time

2. Handicap accessible vans
3. Uniformed drivers
4. Cab stands in the City of San Bernardino
5. Child safety seats
6. All drivers licensed
In addition, the posting of a complaint process in each vehicle for customer complaints.
The Board will review the decision in 6 months. Board Member Turner seconded the
motion. Motion carried by a vote of 4 to 2. Members in favor: Fernandez, Turner,
Encisco and Carson. Members opposed: Martindale and Cole.
Chairman Cole requested that a draft of the complaint process be brought back to
the Board at the next meeting. Mr. Schaffer indicated he would have a draft document at
the next meeting. Chairman Cole stated for the record that the applicant understands the
appeal process.
Adjournment
At 4:40 p.m. Chairman Cole adjourned the regular meeting of the Bureau of
Franchises to Tuesday, October 8, 2002, at City Hall 300 N. "D" Street, San Bernardino,
California.

Dear Ms. Clark:
This letter will constitute a Notice of Appeal given pursuant to section 2.64 of the City of
San Bernardino Municipal Code, This Notice of Appeal is given on behalf of AAA Inland
Empire Cab Company, which wishes to appeal the City of San Bernardino Franchise Bureau
decision to award the 25 new taxicabs applied for by AM Inland Empire Cab Company to Bell
Cab/Yellow Cab. That decision was reached at a meeting of the Franchise Bureau on September
10, 2002.
At a City Council meeting on September 9, 2002 (addressing a matter for which a public
hearing was held on August 5, 2002) the City Council found, among other things, that taxi
service in the City of San Bernardino as provided by Bell Cab/Yellow Cab, was poor, was failing
to meet the needs of business travelers and the handicapped community, and that, despite having
a franchise to operate 45 cabs in the City, Bell Cab/Yellow Cab had only 12 licensed drivers in
the City of San Bernardino. Based upon those findings, the Council elected to overturn the prior
decision of the Franchise Bureau to deny AM Inland Empire Cab Company a franchise for 25
additional taxicabs. Pursuant to Municipal Code section 5.76,060(A) the Council then referred
the matter back to the Franchise Bureau for allocation of such 25 new cabs. The Bureau first
voted 3-3 on a motion to award the cabs to AM Inland Empire Cab Company, then voted 4-3 to
award such cabs to Bell Cab/Yellow Cab.
Pursuant to section 5.76.060 of the Municipal Code, the allocation of such 25 new
taxicabs to Bell Cab/Yellow Cab is "subject to approval, reversal, or modification...by the
Mayor and Common Council." AAA Inland respectfully requests that the Mayor and Council

reverse the decision of the Franchise Bureau and award the permit to operate those cabs to AAA
Inland Empire Cab Company.
To do otherwise defies the Council's own action, and the best interests of the City of San
Bernardino. To do otherwise has the effect ofrewarding Bell CabNellow Cab for the numerous
failures in its service, demonstrated by ample evidence at the Council hearing, and rewarding
BellNellow for its repeated violations oflaw. Conversely, as the process of AAA applying for a
permit has shown, competition from a second taxicab company will assure better quality of
service and provides a means of assuring compliance with the City Code and other applicable
laws by franchise holders.
Additional grounds for the appeal are as follows:
. At the Franchise Bureau meeting, Bell CabN ellow Cab adamantly asserted it was
operating 45 cabs during the day in the City of san Bernardino. In light of the City
Council's specific finding that Bell/Yellow had only 12 licensed drivers (increased to 16
by the date of the Franchise Bureau meeting) this constitutes an admission, by
BellNellow, that it is operating in direct contravention of the Municipal Code.
. At the Franchise Bureau meeting Bell CabNellow Cab specifically admitted it was not
providing on-call service to the handicapped community, thereby violating the Federal
Americans With Disabilities Act ("ADA"). Both the City of San Bernardino and
BellN ellow have a legal obligation to see that public transportation services are provided
in compliance with the ADA.

Fred, I just finished speaking with Scott Schaefer of Bell Cab. He had previously called and left a voice mail
message indicating that he wanted the appeal hearing to be scheduled for the 10/7 Council meeting to be
continued for two reasons: a) he was going to be in D.C., and b) the Franchise Bureau has not yet approved the
minutes of their last meeting.
1JIkll, when I retumed his call, he indicated that he has canceled his trip to D.C., as he wants to get this over with
so he will be ready to come to the hearing on 10/7.
Cindy has already prepared a draft Report for Council Action which is being reviewed by Henry Empeno and
which I will see when it gets back. I have asked Cindy to insert language from the Muni Code that directs the City
Clerk to schedule appeal items at the first possible Council meeting following the sixth day after the appeal has
been filed.

1. January 2002, the Bureau of Franchises notified AAA Inland Empire
Cab Company that their Petition for Franchise Permit had been
denied. AAA did not file an appeal of the decision. Instead, they re-
submitted their application based upon new information.
2. April 2002 - AAA Inland Empire Cab paid a new application fee.
3. June 2002 - The Bureau of Franchises considered the new
application. On a vote of 4-2, the Bureau of Franchises denied AAA
Inland Empire Cab's Petition for Franchise Permit.
4. August 2002 - The Mayor and Council voted to overturn the Bureau
of Franchises' denial of a Petition. In addition, the Council voted to
refer the matter back to the Bureau of Franchises for a determination
as to whether Bell CabN ellow Cab should receive an icnrease of 25
taxicabs or whether AAA Inland Empire Cab Company should be
granted a permit for the 25 taxicabs it has requested. The Council also
voted that the existing ordinance concerning taxicabs be referred back
to the Legislative Review Committee for review.
5. September 9,2002 - The Mayor and Council approved Resolution
2002-295 adopting findings in support of the Council's decision to
overturn the Bureau of Franchises' denial of the Petition for a
Franchise Permit for AAA Inland Empire Cab Company.
6. September 10,2002 - The Bureau of Franchises heard presentations
by both AAA Inland Empire Cab and Bell/Y ellow Cab and discussed
the matter at length. A motion was first made to grant the additional
25 taxicabs to AAA Inland Empire Cab Co. This motion failed on a
3-3 tie vote. The Bureau then determined that Bell/Yellow Cab
should receive an increase of 25 taxicabs. A motion was made, and
passed on a 4 to 2 vote, to grant the additional 25 taxicabs to
Bell/Yellow Cab; however, they imposed the following requirements
that Bel1/Y ellow Cab will be required to address service levels that
include:
. A 10-15 minute response time
. Providing handicap accessible vans
. Uniformed drivers
. Cab stands in the City of San Bernardino
. Provide child safety seats
. Ensure that all drivers are licensed
In addition, Bel1/Y ell ow Cab will be required to post a complaint process in
each vehicle for customer complaints. The Board will review their decision
in six months (March 2003).
7. September, 2002 - AAA Inland Empire Cab Company filed their
appeal which is before you today.
Options:
1. Uphold the Bureau of Franchises decision to grant BellNellow Cab a
permit to operate an additional 25 taxicabs (with the conditions as
stipulated) and that the Bureau of Franchises review their decision in
six months; or
2. Grant the appeal for AAA Inland Empire Cab Company to operate 25
taxicabs in the City of San Bernardino by awarding a Petition for
Franchise Permit to AAA Inland Empire Cab Company.

BLOOMINGTON -- Detectives in Los Angeles and San Bernardino
counties are investigating similarities in Monday's killings of two Yellow
Cab Co. drivers
Because the killings were only about two hours apart and the victims
were both Yellow Cab Co. drivers killed by a single gunshot, San
Bernardino County sheriff's and Pomona police detectives met Monday to
exchange information.
Sheriff's deputies responding to a report of shots fired shortly after
midnight in the 11100 block of Laurel Avenue found a Yellow Cab
abandoned and its driver, 26-year-old Andres Dominguez of Rial to, dead
from a single gunshot wound, said sheriff's Sgt. Robert Wickum,
Pomona officers found themselves responding to a similar call 2102 hours
later of shots fired in a residential area near Hemlock and Roderick
streets.
They discovered an abandoned cab and the lifeless body of its driver, 40-
year-old Victor Henderson of Azusa, dead from a single gunshot wound,
Pomona police Lt. Ronald McDonald said,
Detectives had little information to go on and were releasing few details
late Monday.
"We have no suspect information and no information as far as motive,"
Wickum said. "We're exploring all avenues and possibilities."
An employee at the Yellow Cab Co. in San Bernardino referred inquiries
regarding Dominguez's death to the Sheriff's Department and declined to
comment. Calls to the company in Pomona were not returned.

after they came to our phone booth one day. I waited over 2 hours for one of their cabs,
and was forced to call your company to come and pick me up. The Yellow Cab was
there in less than 10 minutes. Your dri\'Cl' \\'as friendly, and professional. I believc the
driwr's name was Todd.

I, Petra "Lynn" Rojas (Cab No, 303110 1066), submit the following statements as true
and to the best of knowledge:
" On t..Jay 16, 2002, I picked up a passenger narved Larry at Gotham, 295 E. Caroline St,
San Bcrnardino, I noticed a white and blue van (AAA's) van looking for a passenger. I
didn't think that AAA could pick up in San Bernardino, and was surprised to see Dave
Evans there, I spoke with the driver of the AAA Van (Dave Evans), he said that he was
looking for a passenger and couldn't find him. I drove to the back of the Club and there
was the passenger. The passenger said that he had been waiting for over 3 hours for
AAA Inland Empire Cab to pick him up. Each time the passenger called AAA to see
where his cab was the Dispatcher (Greg) would tell him it would be a few more minutes.
I called Greg (AAA's dispatcher on my cell phone) and asked him why the passenger had
to wait so long, he said that it was a good trip and that Dave Evans had to finish a
previous trip before he could pick up Larry, so he kept him waiting.

Dear Mr. Pashkam:
At the meeting of the Mayor and Common Council held on October 7, 2002, the following
action was taken relative to the appeal of the Bureau of Franchises' decision to grant Bell
Cab/Yellow Cab a permit to operate 25 taxicabs in the City of San Bernardino:
Due to there being a tie vote on Motion #2 to grant the appeal, the City
Attorney announced that the Bureau of Franchises' decision would stand and
Bell Cab/Yellow Cab shall be granted a permit to operate an additional 25
taxicabs in the City of San Bernardino, and that the Bureau of Franchises shall
review their decision in six months.
