Itf!m Nn,-,?I CITY OF SAN BERJORDINO - REQUEST O)R COUNCIL ACTION STAFF REPORT The state of California, under various statutes and titles, requires local governments to adopt and enforce the state Building standards Code. The state has updated its building codes by adopting the 1991 editions of the Uniform Codes, which became effective throughout the state on August 14, 1992. The adoption of these codes as part of the City's Municipal Code provides for local enforcement and administration. The California Health and Safety Code, Section 17958 provides that local jurisdictions may make amendments to these codes based on specified local conditions. As in the past, our philosophy has been to keep such amendments to a minimum. Most of our amendments are therefore administrative in nature. In reviewing Chapter 15.12 of the Municipal Code, in conjunction with the Public Works and Fire Departments, we found that many of the requirements and references specified therein were outdated. Therefore, most of the proposed changes are editorial in nature and intended to correct the deficiencies found. A summary of those substantive changes which are not purely editorial follows: SectioD 15.04.020: Adopts by reference the latest editions of the Model Codes. UBC Appendix, Chapter 12, Division III is a new Division in the code which addresses barriers for swimming pools, spas and hot tubs. These requirements are intended to l'imit access by small children to such bodies of water to prevent drowning accidents. This division includes detailed requirements for pool enclosures, and includes requirements for closing or alarm devices on gates and doors which open into the enclosure. UBC Appendix, Chapter 23, Division IV is a new division which provides requirements for Flood-Resistant Construction for buildings located in flood prone areas. These requirements are based on the Federal Emergency Management Agency (FEMA) and National Flood Insurance Program regulations. Adoption of this division will allow us to delete the flood-resistant construction requirements contained in Development Code Section 19.16.050. UBC Appendix, Chapter 25 is a new Division which provides prescriptive requirements for Conventional Light-Frame Construction in High Wind Areas. A homeowner or builder could use these prescriptive requirements in lieu of obtaining the services of an engineer for design purposes. page 1 of 2 '5-0264 o o SectioD 15.04.075: The w9rding was changed to require permits for fences which are over 3 feet in height. The current language does not specify a height parameter, and therefore such innocuous item as planter walls are unnecessarily regulated. SectioD 15.04.076: This section was inadvertently deleted by the last code adoption ordinance. It is in conformance with recent state legislation (S.B. 1321, H&S 13132.5) which requires wood roofing material to have a Class C fire rating. SectioD 15.04.083: This section codifies requirements for pre- permit inspections. SectioD 15.04.085: This section establishes fees for pre-permit inspections and meter resets, which are based on the cost of providing these services. SectioD 15.04.100: This section will extend the validity period of welding certificates from one year to two years and increase the fee correspondingly from $20.00 to $40.00, and therefore in effect is revenue neutral. The current fee of $20.00 per year has been unchanged since 1980, while administration costs have risen. This change will result in a slight reduction in the workload on the clerical staff. SectioD 15.20.080: Wording has been added to clarify that a certificate of occupancy is automatically revoked when a building is ordered vacated due to substandard conditions by the building official. SectioD 15.20.120: Wording has been added to allow the release and connection of utilities prior to the issuance of a certificate of occupancy when the building official finds that no unsafe conditions exist. Applicable Fees: Notwithstandinq the provisions contained in UBC 3041bl, UMC 3041bl. and UPC 20.4. the fees for bUildinq. electrical. mechanlcal, and plumbinq permits shall be as set forth in the latest adopted edition of the Uniform Administrative Code, subject to such amendments thereto as are adopted in this Chapter. Fees for other types of permits or items not specified by the Uniform Administrative Code shall be as set forth in the appropriate adopted code." B. Fees shall be waived for the fOllowinq. 1. Natural Disaster Damaqe - No fees shall be charqed for permits issued to owners for demolition or first rebui1dinq of damaqed or destroyed structures located in an area desiqnated as a disaster area by resolution of the Mayor and Common Council. This exemption shall applY only to property owners of record at the time of the disaster, and not to persons subsequentlY acquirinq the property. 3. Charitable Orqanizations - Fees may be waived or refunded in accordance wi th Chapter 3.13 of the San Bernardino Municipal Code." SECTIOR 7. The plan review fee shall be 95 percent of the bUildinq permit fee as set forth in Table No. 3-A for commercial. industrial and multifamily buildinqs and 75 percent of the bUildinq permit fee for sinqle family and duplex buildinqs. The plan review fees for electrical. mechanical. and plumbinqwork shall be equal to 25 percent of the total permit fee as set forth in Tables Nos. 3-B. 3-C. and 3-D respectively. A fee of 10 percent of the buildinq permit fee shall be charqed for plan review and inspections to meet any State mandated enerqy requirements. A fee of 10 percent of the buildinq permit fee shall be charqed for plan review and inspections of any State mandated requlations relatinq to handicapped accessibil1 ty imposed upon commercial. mUltifamily. and public buildinqs. An additional fee of 75 percent of the plan review fee shall be charqed for expeditious plan review requested by the applicant. The plan review fee for qradinq work shall be as set forth in Table No. 3-G unless otherwise amended in this chapter. The plan review fees specified in this subsection are separate fees from the permit fees specified in Section 304(a) and are in addition to the permit fees. When plans are incomplete or chanqed so as to require additional plan review. an additional plan review fee shall be charqed at the rate shown in Tables Nos. 3-A throuqh 3-G. 7 o o 1 SECTION 8. Uniform Administrative Code Subsection 305(il is added as follows: The BUildinq Official may require a pre-permit inspection be conducted prior to the issuance of permits for the rehabilitation, repair, or reconstruction of a structure whenever such structure has been ordered to be vacated by the buildinqofficial under provisions of this municipal code, has been boarded up and/or otherwise secured subsequent to identification as an attractive or public nuisance as defined in Chapter 8, has been identified as a substandard buildinq as defined in Section 1001 of the Uniform Housinq Code, or has been identified as a danqerous buildinq as defined by the Uniform Code for the Abatement of Danqerous BUildinqs. After payment of the appropriate fee, the bUildinq official will cause the structure to be inspected and shall issue a report which delineates the specific code violations discovered, necessary corrective measures for compliance with all applicable codes, and further specifyinq the portion of the rehabilitative work requirinq permits. Exception: The bUildinq official may waive the requirement for a pre-permit inspection 11 when he determines that the extent of existinq violations and the necessary repairs therefore ar~-minor in nature, or 21 8 ~ o o 1 2 3 4 5 6 7 8 9 when rehabilitation work is to be accomplished by a licensed contractor. To be considered for a waiver of the requirement for a pre-permit inspection. the contractor shall submit an itemized list of corrective measures to be taken. and siqn a statement approved by the bUildinq official aqreeinq to repair or correct any violations found durinq subsequent inspections and to obtain any additional permits as may be required. 10 Municipal Code is amended as follows: 11 SECTION 9. The BUildinG Official 10 shall prescribe rules and reGulations for the tests for 11 welders, and no operator shall be approved by the BuildinG 12 Official unless and until he has first successfUllY completed 13 such tests as may be Given by the Department of Adult- 14 Vocational Education, San Bernardino City Schools, San 15 Bernardino Valley ColleGe, or has obtained such approval 16 because he holds a current weldinG certificate based upon the 17 requirements of the California Department of Adult-Vocat ional 18 Education, prOVided it has the same or similar standards and 19 criteria as said Department of the San Bernardino City Schools 20 of San Bernardino Valley ColleGe. A certificate shall be 21 issued to operators by the BuildinG Official upon successful 22 completion of the required test or tests and/or approval as 23 aforesaid beinG obtained. Requests for the certificate shall 24 be made by the operator within thirty (30) days after 25 completion of the test. The certificate shall remain in force 26 for two years. (b) Every welder employed for weldinq of steel plate of No.8 qauqe thickness or less shall be qualified for liqht qauqeweldinq. Every welder employed for field weldinq shall be qualified to weld in the flat. vertical and overhead positions. Welders. includinq liqht qauqe welders who are employed for shop weldinq. shall be qualified in the flat. vertical and horizontal positions. (c) Structural steel weldinq operators shall be qualified as prescribed by the latest edition of the Structural Weldinq Code of the American Weldinq Society. (d) After a welder has passed the above tests. he must be capable of doinq neat and consistently qood work in actual operation. Carelessness. inability to maintain a uniform arc and poor workmanship will be deemed sufficient cause for revocation of the welder's certificate. (e) A fee of forty dollars ($40.00l will be charqed by the City of San Bernardino for each oriqinal certificate which shall be valid for a period of two years. A fee of forty dollars ($40.00l will be charqed for each renewed certificate which shall be valid for two years. (q) Testinq shall be done under the supervision of the San Bernardino City Schools, Department of Adult-Vocational Education of San Bernardino Valley Colleqe. SECTION 12. Section 15.04.120 of the San Bernardino Municipal is hereby amended as follows: "15.04.120 UBC subsection 7002(a) added - Scope. UBC subsection 7002(a) is added to read as follows: Sec. 7002.(a) This chapter shall also include those requirements set forth in the "Alquist-Priolo Special Studies Zones Act" and subsequent amendments (Chapter 7.5, Division 2, Public Resources Code, State of California and adopted by "State Mininq and Geoloqy Board," November 21, 1973). This Act is intended to represent minimum criteria only for all structures that fall within the boundaries as shown on the "Special Studies Zone Maps" as prepared by the State of California Divisio~ of Mines and Geoloqy." SECTION 13. Section 15.04.125 of the San Bernardino Municipal is hereby added as follows: "15.04.125 use Section 7002 is amended by adding Subsection (b) - Enforcement Authority. (c) is added to read as follows: 8 Sec. 7003. (c) On-site Improvement Permit. No person 9 shall construct anyon-site improvement for motor vehicle 10 storage, parking or vehicle circulation, the disposal of waste 11 through a private sewer main, or landscaping and irrigation 12 systems, without first obtaining a permit from the City 13 Engineer.
