STAFF REPORT
The Agreement with URS Consultants, for improvements to
Tippecanoe Avenue, Del Rosa Avenup- and "c" Street, was for Phase
I - Development of Road Alignment. After Phase I was completed,
a Scope of Services and fee were to be negotiated for Phase II,
preparation of construction documents.
Phase I was completed by the IVDA Board I s acceptance of
the Master Plan, with the inverted "h" pattern. A Scope of
Services and fee were negotiated with URS Consultants for Phase
II. An amendment to the Agreement was prepared to authorize URS
Consultants to proceed with Phase II, at the negotiated fee of
$210,850.
At the Council meeting of 4-19-93, the amendment was con-
tinued to 5-10-93, and the Director of Public Works/City Engineer
was directed to request updated Scope of Services and estimated
fees from the other four (4) firms that had submitted a proposal.
Scope of Services and estimated fees 'have been received
from the other four (4) firms. The updated fees are:

All costs incurred for engineering design services for
Phase II will be reimbursed by the IVDA.
Action needs to be taken to authorize execution of the
amendment to Agreement with URS Consultants, Inc., or to accept
the Scope of Services and estimated fee from one of the other
four (4) consulting firms, and direct the Director of Public
Works/City Engineer to negotiate an Agreement with the selected
firm.
This project will be submitted by the IVDA to EDA in
application for a grant to finance the construction costs. State
of readiness will be a prime factor in the approval process for
these grant applications.

5 BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE
CITY OF SAN BERNARDINO AS FOLLOWS:

SECTION 1. The Mayor of the City of San Bernardino is
hereby authorized and directed to execute, on behalf of said
City, an Amendment to Agreement with URS Consultants, Inc.,
relating to the provision of professional engineering design
services for the improvement of Tippecanoe Avenue, Del Rosa
Avenue, and "E" Street, in eonnmection with Norton, A.F.B., a
copy of which agreement is attached hereto, marked Exhibit "A"
and incorporated herein by reference as fully as though set forth
at length.
SECTION 2.
The agreement shall not take effect until
fully signed and executed by both parties. The City shall not be
obligated hereunder unless and until the agreement is fully
executed and no oral agreement relating thereto shall be implied
or authorized.
SECTION 3.
The authorization to execute the above-
referenced agreement is rescinded if the parties to the agreement
fail to execute

AMENDMENT TO AGREEMENT
FOR PROFESSIONAL SERVICES
This AMENDMENT TO AGREEMENT is made and entered into this
day of , 1993, by and between the CITY OF
SAN BERNARDINO, California, a municipal corporation, hereinafter
referred to as the "CITY" and URS CONSULTANTS, INC., a California
corporation, hereinafter referred to as "ENGINEER."

WHEREAS, City and Engineer entered into an Agreement on
December 21, 1992, relative to providing professional design

services for construction of the Tippecanoe/Del Rosa Avenue
Connector 1 and
WHEREAS, this Agreement was for Phase I, Development of
Road Alignment, with the stipulation that a scope of services and
fee would be negotiated for Phase II, Preparation of Plans,
Specifications and Estimate, upon completion of Phase I.
WHEREAS, Phase I was completed upon acceptance by the IVDA
Board of the Master Plan, which included the improvement of
Tippecanoe Avenue, Del Rosa Avenue and "C" Street (inverted "h")l
and
WHEREAS, a scope of services and fee have been negotiated
for Phase II, and it is mutually desired by City and Engineer to
amend their Agreement to include these items.
NOW, THEREFORE, it is mutually agreed, as follows:
1. GENERAL
The Agreement between City and Engineer is hereby amended to
include Phase II, "Preparation of Plans, Specifications and

IVDA/Ci ty agreement regarding Tippecanoe/Del
Rosa Connector
On July 6, 1992, the City accepted the lead on Tippecanoe/Del Rosa
Connector project by Council motion:
n... that the City assume responsibility for engineering
design services for the construction of the
Tippecanoe Avenue/Del Rosa Avenue Connector, from Mill
Street to Third Street, including the selection of
consul ting engineers and the execution of agreements
relative to providing these design services." (Council
Minutes 7/6/92)
On November 24, 1992, the Economic Development Agency of the City,
SANBAG, and IVDA entered into a three-way agreement to provide
funding for several projects, including the Tippecanoe/Del Rosa
Connector.
By this agreement, SANBAG agreed to loan IVDA $800,000, and the
Redevelopment Agency agreed to guarantee the loan. There is no
language in the agreement restricting the City's action, as covered
by the July 6 City motion.
