properties within district boundary.
11-08-84 - Resolution No. 84-448 adopted determining public
interest, convenience and necessity require formation of
~aintenance district and establishing district.
06-19-89 Resolution No. 89-195 adopted awarding a contract to C &
D Landscaping for the low bid price of $13,870.00.
06-04-90 Resolution No. 90-196 adopted awarding a contract to
Mentone Turf Supply for the low bid price of $12,705.00.
06-03-91 Change Order No. One, extending the contract one year,
at no increase in the contract prices, approved.

STAFF REPORT
Bids for maintenance of landscaping in Assessment District
No. 959 were opened at 2:00 p.m., Tuesday, 4-20-93.
A total of 9 bids were received, ranging from $69,015 to
$124,660. The low bid of $69,015 is 41.0% below the Engineer's
Estimate of $116,916.
Below is an estimate of the total annual cost for
.providing these landscape maintenance services, from 7-1-93 to 6-
30-93.

Funds to finance the costs that will be incurred for
providing these services will be provided from the Assessment
District Reserve Fund, Account No. 254-361-53925.
Inspection of the maintenance effort by the Contractor
will be provided by the Department of Parks, Recreation and
Conununity Services.
We reconunend that a contract be awarded for the low bid
price.
SYNOPSIS OF PREVIOUS COUNCIL ACTION Cont:
05-18-92 - Change Order No. 2 approved, expanding the scope of
the contract to include Zone 1 of the Shandin Hills
Landscape Area, at an increase in the contract price
of $10,839.25, from $12,705.00 to $23,544.25.
06-15-92 - Change Order No. 3 approved, expanding the scope of
the work and extending the term of the contract for a
one year period, and Resolution No. 92-207 adopted
approving an inter fund loan from the Sewer Line
Construction Fund (245).
08-03-92 - Change Order No. 4 approved to adjust contract price.

1 RESOLUTION NO.
2 RESOLUTION OF THE CITY OF SAN BERNARDINO AWARDING A
CONTRACT TO MENTONE TURF SUPPLY FOR MAINTENANCE OF LANDSCAPING IN
3 ASSESSMENT DISTRICT NO. 959.
4 BE IT RESOJNED BY THE MAYOR AND COMMON COUNCIL OF THE
CITY OF SAN BERNARDINO AS FOLLOWS:

SECTION 1. Mentone Turf Supply is the lowest responsible
bidder for:
Maintenance of Landscaping in Assessment District
No. 959, per Plan No. 6363-B. A contract is awarded accordingly
to said bidder for the total amount of $69,015.00, but such award
shall be effective only upon the contract being fully executed by
both parties.
All other bids, therefore, are hereby rejected.
The Mayor is hereby authorized and directed to execute said
contract on behalf of the City, a copy of the contract is on file
in the office of the City Clerk and incorporated herein by
reference as fully as though set forth at length.
SECTION 2. This contract and any amendment or modifica-
tions thereto shall not take effect or become operative until
fully signed and executed hy the parties and no party shall be
obligated hereunder until the time of such full execution. No
waivers
modifications
amendments,
are
oral
agreements,
or
intended or authorized and shall not be implied from any actor
course of conduct of any party.
SECTION 3. This resolution is rescinded if the parties
to the contract fail to execute it within sixty (60) days of the
passage of this resolution.
