In <:hecking with our Public Works Department., the only thing done to lbisroadway was a projcct back on September 1995. The project consisted of a traffic signal project at 34" & "E" Street, which mvolved some curb and gutter construction. The contractor performing the wode: was Avitia ConslIUction Company. 4022 N. '~F' Street, San Bernardino. Ca 92407. The owner oflbe company is a Mr. Richard P. Avilia. who can be reached at (909) 886-2257. The company in question does carry Liability Insurance and the City secured a Hold Harmless Agreement lOr the project. "E" Street Dear Mr. Cole: This will serve to acknowledge your letter dated February II, 2001. Per your request for insurance information for Avilia Construction Company, I contacted our Public Works Department. In checking the file on this project was back in the summer of 1995. They were unable to provide me with any insurance information on the contractor. However, I was able to locate the contract signed between the City and A vilia Construction Company, which was signed on May I 1.+995. Section 5 of the contract points out that the contractor is required to obtain Liability Insurance and have the City listed as an additional insured. As we discussed, I suggested that you formally filed your claim with A vilia Construction Company, as your allegations are that this contractor damaged your sewer lateral while widening the street.
