Dear Fire Chief Lawrence Pitzer,
As Custodian of Record with the power to authorize the release of records pertaining to
all matters involving the City of San Bernardino Fire Department, I respectfully request to
examine the following public record under the California Public Records Act:
Government Code Section 6253(a)(c).
I specifically request to examine the legal instrument creating the fire department in 1878
signed by the founding fathers of the great city of San Bernardino and which is commonly
referred to as the "Charter of the San Bernardino City Fire Department. "
Although the above description of the document may not be accurate as to the title I have
used to describe the official record, I have had knowledge of it' s existence since 1980
when it was shown to me by Steven R. Shaw, an employee of the San Bernardino City
Fire Department. I was led to believe by Mr. Shaw that it was the original and began to
offer proof by leading me over to a display of 19th Century fire and police badges.
I recognized these artifacts as those depicted in photographs of firefighters on display in
the lobby of Fire Station 1 located at 200 E. Third St. in the city of San Bernardino.
Together with this evidence and his unsolicited statements, I found no reason to dispute
what he said.

My best recollection of the actual physical appearance of the document is described as a
single sheet of parchment like paper approximately 12 inches by 20 inches with language
attesting to the official organization of a municipal fire agency named The San Bernardino
City Fire Department. The document is festooned with an embellished border common at
the time of its origin and was signed by the founding fathers and governing body of
1870' s San Bernardino.
1 also have knowledge that while Steven R. Shaw was assigned to Fire Station 8, located
at 3398 E. Highland in the city of San Bernardino, Captains Carl Overcast and Mark
Graham and their subordinates, Firefighters Steven Davis and Albert Bailey observed a
copy of this document hanging on the most southern wall in the captains office.
It is highly probable other fire department personnel have also seen this copy while either
assigned to station #8 or rotated through on a temporary basis.
1 recently asked for the return of related S. B. fire artifacts and had made specific
comment in my January 14, 2002 letter (Copy enclosed) to you concerning this
information. However, since that time and as you have indicated in your letter to me dated
January 15, 2002, it appears either you have no need for this information because the item
to which 1 speak has been recovered or it is not an issue worthy of your effort.
Chief Pitzer, it would do me a great service and to your organization if 1 was informed
whether the knowledge I have is out dated or to offer another reason for me to consider
this matter a dead issue. Otherwise, 1 have no other recourse other than to bring this issue
to others with the same intentions as I, and that is to have this document returned to the
rightful owners. I only seek your council in an effort to serve the citizens of San
Bernardino.

Dear Mr. Rieter,
1 appreciate your and the fire departments efforts to provide public documents to me in a
timely manner and look forward to our meeting on or before February 22, 2002.
There was some confusion after receiving your February 5, 2002 letter with a photo-copy
ofa recorded event dated around the time of the document I had requested. Thank you for
speaking to me on Wednesday and c1aritying that the fire department does not possess the
document 1 asked for in my January 25, 2002 letter to Chief Larry Pitzer.
1 respectfully request that in the event the document described as the document or other
written instrument pertaining to the founding of the San Bernardino City Fire Department
on October 3, 1878, becomes available for public view in the future, that I be allowed to
examine it.
May I also ask your indulgence and be allowed to reexamine the public documents
pertaining to the fire inspections ofthe S.B. City Fire Dept. Central Fire Station,
Fire Station #11 and S.B. City Hall when we meet next?

Chief Pitzer,
On August 16, 1999,1 band delivered a box containing fire department relics to Mayor Judith Valles with
a letter explaining my reasons for allowing the return of these antiques to the City. I expressed my desire
to contribute a genuine cultural gift that would enrich the citizens of the great city of San Bernardino.
I now realize how naive I was considering I never received a thank you from the Mayor or for that matter,
neither from you for my noble gesture.
The lack of appreciation is exacerbated when it is considered how I offered information leading to the
return of the original charter signed by the founding fathers creating the fire department in 1878.
I apprised the Mayor that the same person holding the aforementioned instmmcnt, also was in possession
of many nther artifacts of eqnal historical significance. Alas, 1 never received an inquiry and since visiting
the lobby at Fire Station #1, I have observed the items I fonnally owned are still the only artifacts on
display.
Needless to say, since you returned these items to me in the past (See enclosed letter) and have adequately
demonstrated a lack of interest in pursuing information leading to the return of other San Bernardino Fire
Dept. antiques, I find the best repository for their proper preservation lies within the hollowed walls of the
San Bernardino County Museum where they will not be subject to the vagaries of independent action.
I formally demand the return of the following items;
. A yellow fiberglass fire helmet.
. Four black framed glossy 8" x 10" photographs depicting old images of fire department personnel and
appamtus.
. 1 fireman's badge and 1 fireman's class "A" hat piece with the number 9 in the ccnter of cacho
. A 1910 oval shaped black and white photograph of Hose # 1 Driver, AI Glatz in a similarly shaped
black frame.

Honorable Mayor Valles and members of the Common Council,
My name is Darrell Hess, I live at 2389 Palo Alto Way, Running
Springs, CA.
I'm a retired San Bemardino City Fire Captain. I'm appearing before
you today dressed in an old-fashioned City fire department uniform to
help make a point about the value of preserving the City's F.D. history.
After numerous failed attempts to negotiate a remedy to the issue of
the publics right to their fire departments provenience, I have no other
recourse other than to address you in the hopes public pressure will
stimulate a sense of duty on your part to do the right thing.
Be advised, I have knowledge San Bemardino City Firefighter Steven
R. Shaw is in possession of significant 19th and 20th century
S. B. F. D. relics after appropriating them under nefarious particulars
from his father, former S. B.City Fire Chief Raymond Shaw.
Family character traits aside, the saying the apple doesn't fall far from
the tree certainly seems to apply when it is considered public records
speak to Firefighter Shaw's arrest and subsequent demotion for
stealing a pain medicine prescription while answering an emergency
call at an elderly woman's house while on duty July 7, 1998.
Firefighter Shaw has acquired numerous one-of-a-kind police and fire
badges prominently displayed on the uniforms of the City's first
firefighters seen in the photographs I've brought along today.
Mr. Shaw also has in his possession the original document creating
the San Bernardino City Fire Department on October 3, 1878. This
instrument reflects the essence of the City forefather's mission in
providing organized public safety for purposes of preventing
devastating conflagrations in the city.
The public should be made aware San Bemardino Mayor Judith Valles
and current Fire Chief Larry Pitzer have had knowledge of the
whereabouts of these priceless antiquities since 1999 and have
chosen an indifferent ambivalence to the legitimate ownership of these
F. D. relics when tasked to do so.
Together with Firefighter Steven Shaw, top city leaders have
adequately demonstrated deviant behavior and should be made to
return these priceless relics to the citizens of San Bernardino City
before the items are lost forever.
In the final analysis, I hope you will see that I've exhausted all
available remedies in an effort for reasonable discourse to prevail.
My only intent is to protect the public's best interest and to encourage
participation in a noble effort to reintroduce these relics back into the
mainstream rather than allowing capering individuals to secret away
these valuable antiquities for their own perversion or profit.
Therefore, members of the common council, I beseech you to
intervene and leave you with copies of this letter as well as earlier
correspondence to and from the fire chief and city attorney's office
speaking to my ongoing attempts to resolve this matter.
