STAFF REPORT
SUBJECT
Resolution of the Mayor and Common Council of the City of San Bernardino authorizing the
execution of a contract with Inland Acoustics, Inc. for the ADA remodel of the 5th floor
restrooms at City Hall in the amount of $38,335.00.
BACKGROUND
As part of the ADA transition plan, the lobby and the 2nd & 3rd floor restrooms have been
brought into ADA compliance. The City now needs to bring the public restrooms on the 5th floor
in City Hall into compliance with ADA requirements. These restrooms need to be
remodeled/renovated to ensure that they are ADA compliant. To that end, staff sought to procure
the services of a qualified contractor to remodel/renovate these restrooms.
On August 23, 2001, two bids for this project were received in response to bid request F02-21
that was mailed to seven vendors, the San Bernardino Chamber of Commerce, advertised in the
Sun newspaper, and posted on the City Web site. Only two bids were received: one was from
Moody Construction, Inc., Cherry Valley, CA., for $72,960.00 the other was from Inland
Acoustics, Inc. for $49,210.00, a local San Bernardino businesses.
After detailed review of the bid specifications and the pricing scenario offered by Inland, staff
negotiated with Inland to reduce the overall costs while not sacrificing the quality or intent of the
project. Negotiations were necessitated since the lowest bid exceeded the budgeted amount.
Upon conclusion, an amount of $38,335.00 was finalized. Savings were realized by reducing the
scope work through a project review/quality engineering process. The contractor was brought in
and allowed to review and ask questions on the previously remodeled restrooms on the second
and third floor. This review allowed him to reduce his bid with the knowledge of exactly what
was located behind the existing walls, and how solutions to construction problems were resolved.
This price is still higher than the $27,000 spent on the third floor restroom. The increased costs
are due to inflation and access issues related to the fifth floor of a high use building with three
elevators.
FINANCIAL IMP ACT
The contract cost for the remodeling and renovation of the public restrooms on the 5th floor in
City Hall will be $38,335.00. To fund this project, the EDA authorized reallocating monies from
the cancelled ADA City Hall 6th floor restroom and the City Hall auto door projects. The Sixth
floor restroom was moved back due to the need to complete the fifth floor first, due to higher
citizen traffic. Phase II of the City Hall auto door project was moved back for the same reason.
CDBG funds in the amount of $38,000 have been awarded for this project. The remaining
$335.00 needed for this project will come from the Facilities Management FY02/03 general fund
budget (account number 001-325-5507).

supplies, and to construct the project in accordance with the
contract documents, within the time'set forth therein, and at the
prices stated below. These prices are to cover all expenses
incurred in performing the work required under the contract
documents, of which this proposal is a part.
Bidder hereby agrees to commence work under this contract on or
before a date to be specified in written "Notice to Proceed" of
the Owner and to fully complete the project.within 90 Workinq
Davs, thereafter as stipulated in the Specifications. Bidder
further agrees to pay as liquidated damages, the sum of $100.00
for each consecutive calendar day thereafter as hereinafter

RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE CITY 0
SAN BERNARDINO AUTHORIZING THE EXECUTION OF A CONTRACT WIT
INLAND ACOUSTICS, INC. FOR THE ADA REMODEL OF THE 5TH FLOO
RESTROOMS AT CITY HALL IN THE AMOUNT OF $38,335.00.
BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY
OF SAN BERNARDINO AS FOLLOWS:
SECTION 1. Inland Acoustics, Inc. was the lowest responsive and responsible bidder
for the ADA remodel of the 5th floor restrooms at City Hall per Specification No. F02-21. A
contract is awarded accordingly to said bidder in the total amount of $38,335.00. Such award
shall be effective only upon being fully executed by both parties. All other bids, therefore, are
hereby rejected. The Mayor is hereby authorized and directed to execute said contract on behalf
ofthe City; a copy ofthe contract is on file in the office of the City Clerk and incorporated
herein by reference as fully as though set forth at length.
SECTION 2. This contract and any amendment or modification thereto shall not take
effect or become operative until fully signed and executed by the parities and no party shall be
obligated hereunder until the time of such full execution. No oral agreements, amendments,
modifications or waivers are intended or authorized and shall not be implied from any other

course of conduct of any party.

SECTION 3. This resolution is rescinded if the parties to the contract fail to execute it

within 60 days of the passage of this resolution.
